enforcement of rules/policies for people of color when they are not necessary but not enforcing those same rules against people who are not of color
30 May 2019, Appx 10:00 am
I entered the 10 Fitness at the Bryant, Ar,location
today not to workout considering I was fully dress in clothes not workout clothes, Since I had taken my son to the Dr which was within a mile of the facility, I decided to drop by to have him meet a trainer That grew up with my daughter. My son is not quite old enough to workout in the facility yet. I told him before we entered to stay at the front desk (tables) while I go get my friend. I have seen this practice for years at all 10 Fitness locations. Even the ones that do not have child care facilities. Saw at this one a few time this year.

Before I could fully enter the facility, The lady at the front desk blurted out No children allowed. I told her I'm aware of the policy he has been told to stay at the front while I go get my friend. I then asked her why didn't she say anything to the man who is not of color when he had two female children at the gym who were not only at the front but in the offices and one even came onto the floor where I was working the chest machine. (In harms way)! Of course she wanted no part of that conversation. I told her to enforce the policy on all people not just people of color. I then went in to get my friend and I told him about it, and informed him that I have been on this earth for over 50 years and a know a racist tome when I hear one. And that I was going to file a complaint today because it was not warranted because my son had been informed on the rules and what to do. We had barely entered the building. Don't judge a race of people before you know or see their intentions. But be fair, you had nothing to say before about what I described earlier. This is the same person who 95% of the time will not even acknowledge me. I can check in at the desk in the morning and its like I'm not even there. Someone (not of color) can be behind me and she will look through me and acknowledge them and sometimes even have a full conversation with them. This I have noticed for months. Just because I do not say anything doesn't mean I'm not paying attention.

For the last few months I have been having issue with my 10 Fitness App. It will log me in but was not adding my reward points. I ended up having conversations via email with 10 Fitness representatives as well as netpulse who is the company who built the app for them. I have a whole email chain from them as well that I have saved in a file. they final acknowledged that myself and others were having that same problem. They told me to go to my location to have the rep check the login(s), dates for verification. She would not assist me even after I showed her the email chain. I don't know if it's just me, my race or what. I just know it's not right!!!!!!!!

Desired Outcome

To be contacted by the business and given an explanation why other kids was allowed to roam freely and no-one said anything to them even though they were in the workout area. while my child had already been informed of the rules and told to stay at the front table while I go get my friend to meed him. Not to assume the a person of color is coming in to break the rules without giving them the benefit of the doubt first. I know(expect) them to stick together especially since I told them I was gonna lodge a complaint about the activities today!

After speaking to multiple employees they have given these statements:
Employee Number 1- "On Thursday May 20th around 10 AM I was standing at the front desk. A member then walked in dressed in casual clothes with a child that was not the proper age to workout. I then informed the member the policy that we have regarding children working out and being able to walk around the club. The member then continued to walk around the front desk heading toward the free weight area. I then stopped him again and told him the child was not able to walk around the gym. He then said he was here to see a trainer and wanted his son to meet him. He said that he was just going to sit in a chair at the front and I said that was fine. He then continued to walk behind the front desk and led his son to a chair. His son sat in the chair while the member went to get the trainer who was at the time training a client. His son then poked his head around the corner and waived to the trainer. Then they both left the gym."

Employee 2: "I had just gotten done with my workout so I bought a drink and was talking to the employee at the front desk. He came in with his son who was clearly under 13 years old. She asked him if he could keep his son at the front desk. He quickly responded saying 'Don't give me that, I have seen other children up here in the past.' She asked again and so he told his son to sit down in the chair closest to the scale. As he was walking out she told him to have a good day and he ignored her."

Employee 3: "I was the employee that responded to the Netpulse issues. I passed him to Netpulse after trying to work on his app and having no luck at the front desk. Upon receiving another email I informed him that it was a company wide issue. If I'm not mistaken I offered him a complimentary shirt to make up for the reward points that he had lost."

Our company policy is that no children under the age of 14 are allowed in the gym. We try as a company to enforce this policy at every gym at all times, for the safety of the members and the children themselves. I apologize for the misunderstanding that has occurred in this instance and want to again emphasize that this policy is across the board, for all members with children.
