Refund should be issued due to move, but because I paid in full and have been paying them for over 4 years they show little consideration.
First the corona cane and gyms closed I get it. During this process I moved away from *** for work and tried to contact the store . I was able to get ahold of the *** area manager and he said he could switch me , in which we did. I went a few times and the new location is over 30 minutes away for me , so with the corona restrictions and the distance I don't feel the fit 4 life is where I need to be. I need to be somewhere closer to me to try and get back into the gym and get out of this rut that I am in. I called both my old location and *** location and was told because I paid in full I could not receive a refund. I emailed corporate which for some reason has no phone number and asked about the refund and was told no in their email . Signed corporate office. They can not even be nice in that.

I'd like my money back, and my wife's . I used the gym in June , but would like from the start of corona until June refunded for me and my wife's from the time corona hit considering she only went to classes and did not lift .

Desired Outcome

I'd like a refund from the day the Gym shut down from Covid , all the way until October which I have paid for. Subtract June since I was able to go and did 5 times . I'd like my wife's refund from shut down until the end of membership

Was charged for services never used even after key card was discontinued. I never had a contact with the gym only a month to month basis

signed up as member of Fit 4 Life of Zebulon on 1/27/16 under a 12 month contract of $39.99 for his monthly dues. We have a one time fee of $39 for our facility improvement and addendum. On his agreement there is in bold "At the end of agreement contact will continue on a monthly basis until notification in writing or cancellation form is filled out. Must give 60 days notice upon cancellation."
Mr. had failed to fulfill his monthly payments thus creating a balance of $1137.83. Every time a monthly fee did not go through he was charged a $20 return fee.
Multiple attempts have been made to collect the monthly due but were unsuccessful and Mr. was cancelled out by manager's requests on 7/31/17 so no further payments will be required stopping the balance from increasing.
We can provide a copy of his original membership agreement that he signed for review.

On June 23, 2017, I became a member of Fit 4 Life of Zebulon, NC. I was convinced to do so by an employee named ***. I was very reluctant to join because I was afraid I wouldn't frequent the gym enough to make it worth the membership fee. *** assured me that I could cancel my membership at any time and it would only cost me a 2-month membership fee at the time of cancellation. I signed a contract that she showed me stated this.

On November 13, 2017, I went in to Fit 4 Life of Zebulon, and told the general manager, ***, who happened to be at the front desk, that I'd like to cancel my membership. He looked me up in the system and told me I was unable to cancel my membership for a year when my contact was up. I explained to him that I am not using my membership and his employee had told me that I could cancel with a 2-month membership fee at any time. Mr. informed me at this point that ***, the lady who had convinced me to sign the contract, had been terminated from Fit 4 Life of Zebulon, for misleading clients among other things.

Desired Outcome

Other (requires explanation) I would like my membership contract for Fit 4 Life of Zebulon to be terminated as I was deceived into signing it. Thank you.

Every new member is given a copy of their original membership agreement/contract which is a tangible carbon copy of the contract we keep on file. Written in bold in the bottom of the contact is the "Consumers Right To Cancellation. Three (3) Day Cancellation Policy."

There is an injury waiver below and in BOLD and ALL CAPS:
"At end of agreement contract will continue on a monthly basis until notification in writing or cancellation form is filled out. Must give 60 days notice upon cancellation.
Cancellation clause: If you move more than twenty (20) miles, you may cancel your membership after providing proof of such move, I.E., utility bills, upon payment of a 2-month membership fee or a $50 cancellation fee, whichever is greater. Fit 4 life memberships are not transferable to any other fit 4 life."

As stated Mrs. had signed up with a previous employee (***) but she is not employed by Fit 4 Life anymore. Reasons are not to be discussed and were not discussed with Mrs.. It was assumed for reasons Mrs. stated above.
*** had came in wanting to cancel and due to the membership contract I am unable to cancel her. She let me know that is was due to money issues and the monthly fee was a bit to much for her so offered to lower the rate as means to ease the load while still fulfilling the 12month membership contract term that she did indeed sign. Mrs. did not like what I had offered and said "this is not right, you will be hearing from my lawyer" then walked out.
"I do not understand why you can't cancel me out as *** said" was her argument. I told her she is not with us anymore and I can only go with what I have in writing and the signed contract.
Nothing was mislead but missed understood but looking over the membership agreement all things are printed in bold.

I also have a scanned copy of her agreement if needed.

On the agreement that I signed it states word for word "MUST GIVE 60 DAYS NOTICE UPON CANCELLATION". The Fit 4 Life employee that signed me up, explained this meant that I could cancel my membership at any time, but would have to pay for 2 months after I cancelled. I was more than willing to fulfill the agreement I was led to believe I was making.

I am not using this membership, do not plan to use this membership, and any amount of money is too much to throw away on nothing.

It is very deceitful the way in which I was coaxed into signing this agreement if that's not what that sentence means. Therefore I would like my membership terminated immediately.
