I listened to a call containing a voice mail our agent left-The agent did clearly identify that he was calling from Agway Energy Services "This is Eric calling on behalf of Agway Energy Services"The other call is where the customer returned the call to the sales agentThe sales agent again says this is "Eric on behalf of Agway Energy Services"He even states we are a licensed supplier with [redacted] ***'s energy choice programAt no time did our agent represent himself as anything other than calling on behalf of Agway

I am in receipt of the rejection notice filed on February by Mr [redacted] On behalf of Agway Energy Service ("Agway"), I offer the following additional responseOn April 6, 2013, Mr [redacted] spoke with our third party verification (TPV) company to verify the terms of the agreementMr [redacted] agreed to a variable rate program with his first month rate being cents per therm for the gas and cents per kwh for the electric, with no guarantee of future savingsThis was expressly stated to Mr [redacted] during the TPV callI have attached the TPV for Mr [redacted] to review the call from April 6, 2013, wherein Agway stated that Mr [redacted] was receiving an introductory offer and then his price would be variable with no guarantee of savingsShould you have any further questions, please do not hesitate to contact meVery truly yours, Lauren GCounsel

I am in receipt of the above complaint filed on May 27, by Ms [redacted] On behalf of Agway Energy Service ("Agway"), I offer the following response to the complaintLast year, on May 26, 2015, Mr [redacted] authorized Agway to be their electric supplier by way of a third party verification (TPV)Mr [redacted] was asked twice if he was authorized to make changes to the account of Ms [redacted] and he confirmed that he wasPrior to the TPV, Mr [redacted] provided Agway with the pertinent information regarding the account with NYSEG in order to enable Agway to switch the service over to Agway as requestedOn December 18, [redacted] called our office and asked how Agway became her providerWe informed Ms [redacted] that Mr [redacted] provided the authorizationDuring this call, Ms [redacted] never terminated service with AgwayOn May 27, 2016, Agway processed Ms [redacted] 's request to cancel service after speaking with her and we were provided with an end date of June 9, from NYSEGAgway valued Ms [redacted] as customer and although she terminated services with Agway, we would always welcome her as an Agway customer should her electric service needs change Since Agway was authorized to transfer the service, no refunds will be issuedShould you have any further questions, please do not hesitate to contact meVery truly yours, Lauren G., Counsel

down or they experience electrical issues within their home, Agway will send a service
technician to their residence to make the necessary repairs at no additional cost to the customerFor the reasons stated in this letter, Mr*** was
priced correctly and in accordance with the terms and conditions
that were supplied to him at the time he selected Agway as his alternative
electricity supplierAgway valued Mr***as an Agway customer and
although he has decided to terminate services with Agway
asof May 25, 2016, we would always welcome him as an Agway customer should

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below
Agway stated that they would save me money...as they just stated in the email where it states "they don't guarantee any savings outside of the first month introductory rate" that is the same thing as saying they guarantee me a savings...doesn't it? it may have been for the first month but they did not state that to meIf the audio recording was pulled it would say they would save money and nothing about an introductory rate or for the first month...Agway needs to be held accountable for the scam that they are running

HEY  INSTEAD OF SENDING  LITTLE E-MAILS  BACK EN FORTH WHY DON;T YOU  DO SOMETHING   APPARENTLY YOU HAVE NOT LOOKED AT OTHER COMPLAINTS  AT THIS  RIP= OFF COMPANY. ITS TO EASY TO SAY ITS A THIRD PARTY  ISSUE   ;; WHY ARE THEY GETTN A KICK BACK  ALSO,,, MAYBE ALL THESE  THIRD PARTY COMPLAINTS  SHOULD BE SENT TO ALBANY  TO GET THE STATE INVOLVED  JUST  LIKE [redacted]  DID A FEW YEARS BACK[ PRICE GOUGE N ]    OR  MAYBE  A NEWS FEED  TO OPEN OTHER PEOPLE EYES,, SEE HOW MANY  3RD PARTY S WILL BE SENT RUNN.  FOR GOD SAKE    Revdex.com HAVE [redacted] AND STAND UP FOR US WORKING PEOPLE.

Additionally, we informed Mr. [redacted] that our program included our home
heating repair program. The rates that Mr.
[redacted] was charged for supply were correct. [redacted] determines the
