Disagreed with the training approach of our dog trainer and they refused to refund the remaining sessions or future classes.
We had used All American in the past with our other dog, and felt very confident in having Dave work with our new Service Dog. We signed up to have Dave do 3 training programs, Basic Obedience, Advanced Obedience, and Service Dog Training. They offered a discount if we paid in full, and given our positive experience prior, we decided to take them up on their offer.

After 3 training sessions in basic obedience, it was clear that our dog was not taking well to the negative re-enforcement methods. My wife asked Dave about trying other methods and to stop the negative re-enforcement; however, he was adamant that his way was the only way to be successful. We called and spoke with his wife, and asked for our money back as the program was not a good fit for our dog. They refused to refund $1885, even though only 3 sessions were completed.

I called to discuss paying for the entire full course, and to refund the other two courses, but have not heard from them. They have threatened their lawyers.

Desired Outcome

I would like to receive not a full refund, but a refund for the advanced and service dog training courses. As we haven't started those yet. This would come out to approximately $1,256.67 or 2/3s of the initial payment. I believe this is fair for both parties and hope we can settle this matter with respect.

In our contract it states that are packages are non-refundable . We held an evaluation on November 20th with your wife, ***, and went over all of the training plan and what would be entailed in our training with Sadie. On December 4th your wife entered into contract with us agreeing that she wanted to go through Basic Obedience, Advanced Obedience and Service Dog Training. At that time your wife asked if I would offer a discount if she paid in FULL, I told her since she was a previous client of two other dogs, I would offer $100 discount. She agreed to pay in full. We completed 2 weeks of training with your wife before we found out that she had purchased another Online Dog Training program through My Service Dog and *** At that time on 12/12/19 we advised her that it was a conflict of interest as the training programs were completely opposite and Sadie would not respond appropriately to our programs as she is using a clicker with positive only reinforcement. At that time your wife stated she was putting her other program on hold. On Dec 19th Dave came out and completed the 3rd lesson of obedience, your wife asked why Sadie was tucking her tail and he explained that because she had been implementing the positive reinforcement training and that now Sadie is being told "no" she is like a child who was given candy and now told "no" and not all positive all the time. Training is a step by step process and three training sessions is not enough time this is why we have packages to ensure by the end of your dog's training that she is where you want her to be, this is why we complete an evaluation prior to starting your training. When your wife called on 1/6/20 and asked about the training contract we explained the non-refundable contract again she started yelling at Hope in the office and telling her she was not continuing the training and that she was using the online program from My Service Dog and *** therefore making our training not effective. At that point *** stated that we would be hearing from her lawyer as she would be taking us to small claims court. When I spoke with *** on 1/6/20 I did give her options for the contract and tried to help to find a resolve. You have a copy of your contract that states its a non-refundable contract. *** signed the contract on 12/4/19.

Unfortunately the service contract is void as the company has not scheduled additional services. It is an unfair business practice, for a company to not render services, and I as the customer should receive those services if I paid for them. After my wife disagreed with their teaching method and asked for them to stop the negative reinforcement, she asked for a refund of the services, but she never canceled them. It has been 3 weeks, and we have not received the agreed to services.

Seeing as they are in breach of the contract, I think it is fair that we receive a refund. As stated, I am willing to pay for the first basic obedience course in full, but feel it is an unfair practice to pay for the other 2 courses that have not even started.

As a customer, I have certain rights, and if service is not rendered then they should issue a refund.

Also I have called 3 times now, and left voicemails and they have refused to return my phone call.

On 1/6/20 *** called the office and spoke with Hope, at that time Hope offered to continue her training. At that time *** stated she did not want to continue training with Dave because she felt that now that she requested a refund he would treat her and Sophie differently. I then turned around and offered to put my training supervisor, Tommy on the job. At that time *** stated NO, she did not want another trainer to come out to do the training and that she wanted to cancel the training and have a refund on her contract as she was utilizing the online program she purchased "My Service Dog and Me", At that point I again advised her of the contract being a non-refundable contract. She stated that I would be hearing from her lawyer and she would take us to small claims court.

The company is not being truthful. We have not received the services we paid for. My wife, *** called to seek a refund, which Hope denied. That was weeks ago, and I have tried Cali g multiple times with no response. The company is now 6 weeks without proving their service. When a customer pays for something they should receive it. In this case, this company is refusing to even return a phone call to fix this situation. At this point they are in default on our contract for not proving the service. I am still demanding a refund of at least the 2 courses that haven't started. If they refuse, I will have no choice but to issue a certified letter seeking a refund as services have not been received and the company is in a breach of contract. Then we can settle this in small claims court. Dave, you are an honorable person, do you find it fair that you take someone else's hard earned money without providing the agreed upon service? I your method did not work on my dog. So because you failed, I should be out my financial assets? Do you really think that is morally or legally acceptable?
