[redacted], I am responding to complaint #[redacted]. Our customer information is basically correct. They did buy a total of $17,552.75 worth of furniture. We had a clearance sale at that time and had some great buys. Our customer was unable to close the contract on the house they were buying, so...
we cancelled the sale and refunded their money on 4/20/16. Our sales person called them back saying that these items were on our clearance sale and that you made a great buy and it would be a shame to lose these great deals. Our customer agreed and on May 2 gave us a deposit to hold these items until they bought a house. We told them we would hold items as long as they need until they could get a new house. On 9/23/16 they called to cancel the sale. We told them that we would be willing to hold the items longer, but they did not want anything, just their deposit back. We cannot refund their deposit after holding the items in our warehouse for 5 months. We held up our end of the deal. Several of the items they bought were items marked AS IS all sales final. All the items they purchased were removed from our showroom marked sold and stored in our warehouse. These items were not available for sale to the public since we thought they were sold to our customer. [redacted]

I am rejecting this response because: They seller claims to have held up his end of this bargain and this is not the case. I have attached the Conditions of Sale on the back of the original invoice. No items ever left the store and we never received any item in this transaction. This particular transaction is not outlined in any of the conditions of sale. Our understanding was always that the deposit was refundable. This was evidenced by the initial refund that we received of the deposit. During the follow up conversation we had the understanding that the second time we made the deposit we would be subject to the same terms, a refundable deposit.The fact is that the seller still has all of this furniture and has a store front available to market and sale the furniture. I don't believe an out right claim of "holding up their end of the bargain" is adequate.
