On April 24, *** *** purchased a BMW Xwith 117,miles on itThe vehicle was inspected and serviced prior to deliveryPlease See attached repair invoicesThe instrument cluster had no lights on indicating any problem with the vehicleAfter the vehicle was picked up by
*** *** she called me at around 6-7pm on Saturday April 25thDuring that phone conversation I tried to explain to her that I had already closed for the day and that I would be happy to address any of her concerns on MondayFrom what I could understand of her screaming she said that the vehicle had oil leakingI asked her if she was broken down or if any lights were on or if there was a puddle of oil under the vehicleShe said no lights were on but that she took the vehicle to Jiffy Lube and they said that there was some leaking from the rear differential and that they re-inspected the vehicle but that there was no puddle under the vehicleShe began to scream at me and threaten meShe claimed she had filed a police report and her exact words were "You are going to get it" I then told her that all future communication would be through text or email because I wanted to have her threats in writingI have attached all text communication dated from April through Monday June 1stI explained to her that she needed to call the repair shop that I use (***'s Garage) and set up an appointment to drop the vehicle off so that the leaking differential could be repairedShe set up an appointment for Monday April 27, However she did not bring the vehicle in until I believe Wednesday April 29thI supplied her with a loaner vehicle while her BMW was in the repair shop as to not inconvenience her because it appeared this might have been a pre-existing issue that was missed during the initial repairs***'s Garage addressed her concerns of the leaking differential, the missing dust cover for the engine, and a low tire pressure lightAll the repairs were completed by Thursday April 30thHowever *** did not come back to pick up her vehicle until May 5thAt that time there were no lights on in the instrument clusterAll of those repairs were at no cost to ***On May 19th *** texted me that the 4WD light, ABS light and a Brake light were onI told her to set up an appointment with ***'s Garage so that he could diagnose the problem to see if it was related to the previous differential leaking because if it was I would cover the cost of the repairI supplied her again with a loaner vehicle as to not inconvenience herThe problem that was found is that the Transfer Case needs to be replacedPlease note the Bill of Sale and the Craigslist Advertisement to see that I included the price of a month/ 24,mile warranty with her vehicle because it was over 100,miles at time of sale and therefore had no warranty with meAlso, please see the attached lemon law signed by her which states that she was aware of the fact she had no warranty with meAlso please see attached her hand written dated and time stamped letter that she left for the repair shopShe had set up an appointment to leave the car in the morning of May 19th but did not drop the car off until after closing at 6pm***'s Garage is a very busy repair shop and when appointments are not kept the next available time slot for a vehicle to be looked at might not be until a couple days later*** diagnosed the bad transfer case and then took the vehicle to *** BMW to confirm the repair needed was the transfer caseYou can call them to confirm their diagnosis at ###-###-####*** called the WEC Warranty Company to begin a claim to have the transfer case repairedThe warranty company then called *** to verify the vehicle was at ***'s Garage for repairAt that time *** told the warranty company that the car has been broken since she bought it and that I Whitney L***, owner of All Phases Auto Sales should be responsible for the cost of the repairAll of this however is a lie and the text messages, her hand written letter, and the signed lemon law prove otherwiseThe transfer case did not fail until May 19th as she states when the lights came on, which is days after the day of saleDue to the fact that she said this to the warranty company they now do not want to cover the cost of the repairHad she told the truth to what has happened with the vehicle it would have already been repaired and the cost covered by the warranty companyAddressing her complaint: 1) Sales Person Name is not BrittneyMy name is Whitney as it states on my business card that she has and on all the signed documentation I have given her 2) The purchase price was not $16,as you can see from the Bill of Sale that she signedYou can also double check that information with the bank Credit Acceptance Corporation that holds her loan3) Disputed amount: She has not paid for any repairs at this time 4) Desired Settlement: She has not paid to have the car checked over, She has been provided with a loaner car so she did not miss workAny time she dropped her vehicle off it was at late hours never during the day5) I have also attached the advertisement on craigslist which is where she found the vehicle for sale with the sale price, which clearly shows that I included the price of her year warranty and she did not pay the advertised price of the vehicleAttached is the signed Lemon Law document showing that she was aware that because the vehicle has over 100,miles there was no warranty with me, All Phases Auto SalesAlso, I have attached our entire text conversation, which is still saved on my phone in need case it be seen along with all of her voicemailsCopies of all repairs to the vehicle are also attachedMy business will
