The foundation crack water leak problem was raised in as warranty defect
within warranty period, then there was no landscape and grade passed
inspection
Since then Perry has been trying to patch it from inside,
but never fixed itMain reasons for this to drag so long are Perry's slow
response, and we had to wait for a heavy rain to verify if the repairs fix the
problemThis sometimes means next season or next yearBack and forth a few
rounds until now
Also we did our best
to work out the problem with Perry warranty repairman patiently, who promised
to fix the problem and we believed himBut the problem was getting worse and
worse, finally we had other licensed concrete company to check the cracks in
and they concluded the cracks had to be sealed from outside where lack
water/damp proofing, and provided bid for it (about $3,then, just for the
cracks near window well, not whole foundation, so it did not cost too much)I
presented this to Perry repairman; he dug places to try to find tar from
foundation outside, but no sign of itSo he said to report to Perry management
and got approval for the repairBut I never heard anything back
All these happened well within year statute Perry claimed
itThey never told me it was landscape grade issue, or asked me to sue them
before it was too lateFinally I wrote letter to Perry management to follow up
the repair, first they told me it passed warranty period, I responded that this was warranty defect
never been fixedThen they blamed landscape, I told them this happened when
there was no landscape, then they told me it passed year statute, I should
sue them earlier, it was too late. Now
they claim year statue (since this is warranty issue according to people I
talked to), they well know this and drag this very long on purpose, and then
told consumer it was too late to sue them
I attach pictures for the water leaksMoreover, the
cracks in foundation should be fixed anyway even without water leak, since this
is most important structure of the house
One reason I bring this to Revdex.com is to let other consumer
aware of this builder's practice, drag it long, then tells consumers that they
should sue them, but it's too lateThis is not about my dispute with Perry
homes alone anymore, so my advice to other consumer is to be careful about
Perry's short year warranty, sue this builder ASAP instead to work with them patiently
to resolve the problem, which is they will tell you eventually

Dear Revdex.com,We have been in constant contact with this Homeowner regarding this problem now for years.  We had this problem evaluated by experts (even a third party inspector), who indicated that a negative grade is the reason for the entry of what is extremely minor amounts...

of moisture into the concrete foundation of this home.  In fact that amount of moisture that is claimed to have entered is so minimal it is likely a non-event, and certainly not a defect in the concrete.  We have told this homeowner to address the negative grade in his landscaping by altering the grade of the underlying soil to ensure a positive transition away from the home will divert any water runoff from the foundation.  He has refused this recommendation to date.  Finally, this homeowner has complained of this problem now for at least 7 years but has never proceeded legally which is very surprising if this issue really is the problem he contends it is.  At this point, even the 6 year statute of limitations on construction defects has run its course, so we are finished addressing this matter further.  Nothing we recommend he do has solved this customers concern and we are not willing to tear out all of his landscaping and water proof the exterior of his foundation wall (which is not likely a solution with his negative grade) as he has continued to demand.  From our perspective, this matter is closed.  Thank you

We have already responded multiple times to this homeowner about their wood floor concerns, we will do so one more time here and then turn the matter over to our legal department because we will not continue to answer the same concerns over and over. The floor has been looked at and worked on a...

couple of different times to try to get it to the liking of the home owners even though the concern on the floor is extremely minor. We have attempted to send back the wood floor company again to try to fix the minor flaw in the finish which is hardly noticeable, and the homeowner declined the service call because they want the floor entirely refinished. We will not agree to refinish the entire floor because its a completely unreasonable request on a floor that more than meets industry standards and the home owners have been told we cannot achieve perfection, yet this is the standard of perfection that they are trying to demand.  What the buyers don't understand about the furniture repair specialist is that when it is a very small or minor repair, a furniture repair specialist who by the way has done wood floor repairs as part of his business for better than 10 years, is paid a premium for these fixes and is an expert wood repair specialist and he has fixed it once, been offered to try again and it's still not good enough. The same type of repair has been done many times in the past and has been more than acceptable by the home owners its been done for. The problem once again here is a standard of perfection in the home owners mind which cannot be achieved no matter what is done. This is the same home owner which called to complain that a window we agreed to re-clean had never been cleaned. We in fact had sent cleaners to re-clean it and she emailed insisting it had not been done by our professional cleaners. We promptly responded to her that, in fact it had been cleaned and we  had pictures  of the window being cleaned to prove it, unfortunately we know we have to go to these lengths with this buyer to prove things. Once again this is evidence of the unreasonable standards the home owners are trying to insist upon. Unfortunately some home owners can't be pleased not matter what level of service is provided.

I am rejecting this response because:We are not looking for perfection.  What is interesting is that the furniture repairman even told us that he could not fix it yet they keep sending the same person out to do what he says he can't.  This is not a minor issue.  The owner of [redacted] has not responded to calls or requests to look at the floor that his employees damaged.  We did not decline the service but rather rescheduled it.  There is a difference but no one called us to see what happened.  Again, the took the word of the company that has yet to look at the floor themselves.  The furniture repairman came out and did what he could but the floor looks like it is water stained.  I don't know about you but if someone makes an error they should fix it.  Perry keeps saying we want perfection however we are not seeking perfection.  We want the wood floor we paid for that was damaged by their contractor who put water on bare wood, stained it, and sealed it.  I don't know why that is too much to ask.  [redacted] is the one that told us the floor needed to be sanded again and redone.  If that's not an option then figure something else out.  By the way, since filing this complaint Perry has not responded to other issues we have including our annual walk through.  I find it interesting that Perry brings up a dirty window to deflect that conversation.  If the window was cleaned then why have it done again.  We would have accepted that and moved on.  The issue is that Perry doesn't want to own up to it's mistake and fix the issue.  They want us to go away just like many others we have spoken who got tired of calling with not response.  If I broke something I would fix it but I guess that isn't the case with Perry.  Yes, they build a nice home but their service after you move in is terrible.  If you pay this amount for a home then one expects certain service levels and conversations to happen rather than hiding behind a receptionist and not addressing the concerns.  If they would like to take it to legal then that's fine with me.  I have all the documentation, conversations, and statements I need to plead my case.  We have requested a face to face meeting with a representative from Perry and the owner of [redacted] to come to our home and see the damage but have been denied that as well.  We are cordial individuals that have been accused of complaining and making outrageous claims.  That is not the case as we simply want what we paid for.  I don't think that is too much to ask.  It is funny how they aren't responding to the other issues with the floor either as it makes a cracking noise every time you walk on it.  They have been told how to fix it but avoid doing that even.  They can say we want a perfect floor but that is not the case.  If someone damaged their new wood floor by putting water on bare wood then what would they do.  The bottom line is that they do not care nor want to be accountable to their contractors to get this fixed.  We keep hearing that we are being irrational when all we want is a solution that works.  What has been done hasn't worked, and in fact made it worse, but no one has come to look at the work so how do they know it is ok?  They listen to the word of the company that damaged it in the first place.

Perry Homes has already responded to this concern and will not continue to do so again.

I have reviewed the most recent correspondence and appreciate you sending it to us. We do not agree with the recitation of the events as set forth in the correspondence.  Also, given the number of letters and the breath of this file, we are not going to even attempt to revisit this issue in this forum.  Finally, and most ironically, the two pictures attached to the correspondence which show leaking in the foundation show water intrusion of such minimal amounts that these would be deemed normal and not defective as a matter of industry standard.  Indeed, as we indicated to this customer on numerous previous occasions, concrete foundations are not waterproof, the code does not require them to be so, and very minor instances of water intrusion are not uncommon and are not defects.   This again was the reason that we invited this customer to readjust his landscaping to change the grade away from his foundation which would probably cut down on the minimal foundation water intrusion complained of.  He has obviously chosen not to do so and instead to make this an ongoing issue with involving the Revdex.com whose reputation and  role in ensuring consumer satisfaction we respect.   Because he does not have any legitimate claims here at this time, we kindly ask that you close this matter.  Kind regards, Perry Homes Utah Inc.

Dear Revdex.com,
The water leak problem happened long before the landscape was
done by professional landscaperWhen there is a heavy rain, the rain water
drops into window well directly, the water then penetrates the basement wall through
cracks due to lack of damp/waterproofing in foundation
We had been working with builder's repair personnel
patiently for a long time and trying to fix this problem, but he mainly put
some kind of coating from insideThen we had to wait until next storm coming
to verify if it was working, which might be next season, back and forth a few
times for more coatingThe repair personnel told us not worry; he would take
care of us and fix it, so we believed him, legal action and time limit was not
something in our mind like Perry lawyer suggested
We did our best to work out the problem with the repair
personnelBut the water continued to invade, so we asked a couple licensed
concrete company to have a look, they concluded that not enough waterproofing
in foundation and the cracks needed to be sealed from foundation outsideSince
only cracks next to window well had water leaks, they were easy to access
through windows, did not cost a lot to dig out window well. I discussed this with Perry repair personnel,
he tried to dig in two places and look for tar sign, but nothing foundHe told
me he would pass the info to Perry management and lawyer, asked for approval
Since then I hadn't heard anything back from him for a long time, I knew he had
surgery, so I waited a little bit longer and sent letter to Perry management to
inquiry this, finally I got response from
Perry lawyer, it was October alreadyFirst he said the water leak
was caused by landscape grade level, I told him that the problem existed at
beginning before there was landscape years later, and the landscape is fine,
even with drain built into it next to window wellFinally the Perry lawyer
told me that I should sue them over this, but it was too late
This is the whole long story, here we are in The
foundation is the most important structure for the house, even if there is no water
leaks, the cracks still need to be repaired to prevent further expansionWith
the water leaking in through cracks, mold grows easily, especially if the
basement wall is covered up when finishing the basement, which will make the
house unlivableSo this is not small trivial problem
A lot of good builders provide years warranty for
structure like foundation, only year from Perry? That does not sound like
from a prudent builder claiming high quality fine home, who cannot stand behind
its product for more than yearMany defects in house take much longer than
year to manifest and show symptomEven all the new cars now have at least
year or year warranty; some even have years, but not house? Be aware of
this, the future house buyer/consumer
Through Revdex.com I would like to work out this problem with
builder, but if the builder is closing it, then it's my beginning for other
actions

I am rejecting this response because: The business did not offer us 4 other air conditioners as they claim. We simply wanted to keep our own property regardless of what value the business placed on it, which apparently isn't much. It was our rightful property and it had value to us. and they disposed of it even after multiple times of us telling them we wanted it back. And some WOULD pay $600 for a broken one because they can repair it and still save money on a new one that is more than double that price as the receipt shows.  They need to be responsible for their own mis-management. We, the customer shouldn't have to pay for their negligence.

I am rejecting this response because:They are being dishonest, and have continually ignored my requests for a simple phone call to discuss.  Floor: the (one) expert that came to qualify the floor job is the same guy that did the job, no other Perry Home "experts" have seen my floor.  If the streaks were hard to see, I wouldn't have an issue, but they are visible enough to have people ask us what happened to the floor.   If they would have answered any of my five requests for a phone conversation, they would have learned that i've had two third-party experts give an opposite opinion; I was told the job was rushed, and not carefully done. Concrete: if they would have answered any of my multiple requests for a phone conversation they would have learned that my sinking began before I put my sprinkling system, or my yard in.  They would also learned that I don't have any sprinklers shooting toward the sinking area, nor do I water more than the city limit (2-3 times a week).Instead of just talking to me, I get canned legal responses and insulting emails.  Hardly the customer service that Perry proclaims.
