I have personally spoke with Ms [redacted] and have ensured her all issues will be taken care of next week based on when she is availableI will ensure you are also updated after it is all completeThank you

Initial Business Response / [redacted] (1000, 8, 2015/10/16) */ We have been in contact with Mrs [redacted] regarding her concerns and are working to complete the job to her total satisfaction Initial Consumer Rebuttal / [redacted] (2000, 10, 2015/10/26) */

Initial Business Response / [redacted] (1000, 5, 2015/12/01) */ Mr [redacted] s lights have been on backorder and we have been assured by the manufacturer that they will go out within the next day and wil be expedited so Mr [redacted] will receive them end of week or beginning of next week Initial Consumer Rebuttal / [redacted] (3000, 7, 2015/12/01) */ (The consumer indicated he/she DID NOT accept the response from the business.) Its ok that they have been backordered but they did not tell me thisAnd what I want to know is why they do not answer the phones I have called everyday since I filed this complaint and no one answers

To say I am confused at this response is an understatementI have spoke with Ms [redacted] atleast a dozen times myselfI assured her today not only that we would be flying a representative out to check and see what exactly is going on, but that if there were any plumbing or electrical issues that we would hire contractors to take care of those issues directly while we are there to ensure it's done correctlyIf the issue is with the physical tub itself, no license is needed but we will not know that until we get there and see what the issue isWe do not have anyone in the state ourselves so this is the best way we have to ensure it's all done correctlyI let her know he would be contacting her to schedule this for next week when she is available and that he would not purchase a ticket until she was sure she can be around those daysAgain, I personally have spoke with Ms [redacted] many times including today and Monday and three times last weekWe are doing everything we can to get this handled for herWe did not install this tub, a Washington plumber did, so without a rep of ours being there to determine the issue we cannot figure out what the issue isDanny will be contacting her her directlyI did provide her Danny's phone number and she has his office address on her paperworkI will not be providing his home addressDanny is a liscensed contractor and fully capable of determining what the problem is and how best to fix it to her satisfaction

I have confirmed with the warranty company that a new unit was shipped to customer and installed on December I hope this solves the problem and if the customer needs any additional help, please do not hesitate to call

I am rejecting this response because: Actually, I'm rejecting this latest business response in part and simultaneously accepting it in part, primarily due to perceived inaccuracies or incompleteness in the statements made by the businessWhile 'Gail ***' has perhaps spoken to us on several occasions of late, the do not amount to 'dozens of times' and until 2/6/the only conversations directly with her have been those initiated by me when I was on occasion able to have her answer the phoneNONE were her returning recorded messages left by me asking for someone at ABS to call me backIn a conversation with a family member on 2/9/she tried to claim she spoke with me multiple times, but finally admitted she had no record of the dates or times of these supposed conversations with me and conceded she didn't log any of them in her office records at the timeSo, let's just say ABS's assertions in this regard can not be reconciled with the notes and recollections of me and my family.Moving on to matter of late concerning ABS offers to have representative 'Danny' come to Washington from Minnesota to inspect the malfunctioning wabathtub and ABS hiring contractors to address plumbing and electrical issues, this is a step in the right directionHowever, research done by us shows that 'Danny' is NOT a licensed contractor, either in Minnesota or WashingtonAlthough 'Gail' had previously refused to supply any identifying information on 'Danny', including his company affiliation, business address or last name, we were able to independently determine his full name, Daniel P***e, and his status with Labor & Industries in Minnesota'Gail' has just now on 2/finally admitted that 'Danny' is actually an employee of ABS, not an independent contractor and his 'address' is actually that of ABS in Eden Prairie, MN - while this address is, as 'Gail' stated, shown on the Sales Agreement paperwork I have, no where does it show Daniel ***e's name, so there is no way I would be able to discern that their address would be his.He is what Minnesota calls a 'Qualified Person', and personally holds a 'Qualified Builder' or 'QB' registration number with Minnesota Labor & IndustriesIt is NOT a license of any kind and his Registration does NOT permit him to do any physical operations such as plumbing, electrical work or construction of any kindHis 'QB' only allows him to align himself with a business operation (in this case ABS) as their designated 'Qualified Person' so the company (ABS) is able to apply for and obtain a license in their nameIn this case, ABS has used 'Danny's QB to get a Residential Building Contractor's license in the State of Minnesota ONLYThis allows ABS to act solely as a General Contractor, meaning ABS and it's own employees can NOT actually perform any tradesmans' operations, but can only sub-contract such things (like plumbing, electrical and construction of any kind) to other, unassociated, licensed construction businesses or individuals. 'Danny' can inspect and oversee their work, but can't physically perform work except perhaps the bathtub body itself - not any of its plumbing or electrical connections or parts of any building or structure housing the bathtub. In a conversation with 'Gail on 2/9/she stated that 'Danny' was in contact with and coordinating with a local Washington State based Plumbing Contractor, *** Plumbing, to meet him at my residence during the week of Febto perform any needed plumbing or electrical work to address the bathtub's problemsWhen asked for ***'s address, contact name and phone number 'Gail' said we should Google it ourselves if we wanted that informationThat has now been done and they are a licensed and bonded Plumbing and Construction company in Everett, WashingtonHowever, we have not been able to speak with anyone at their offices so farHopefully someone at *** will call us back in response to a recorded we message leftIn our speaking with 'Danny' about his contact and coordination with ***, he has informed us he hasn't had any contact with them at all, but that 'Gail' is the only one at ABS who has.At the present time, ABS has offered to have 'Danny' do an inspection starting Mon2/and staying to supervise the arrival of *** Plumbing at my home on 2/to perform any repairs identified by 'Danny' in his 2/inspection of the bathtubHe has stated if efforts to resolve all issues is not completed by the end of the day on 2/he will stay in town to oversee it till it is completeThis is somewhat contrary to what 'Gail' told us on 2/9, in that she said 'Danny' will have to leave on 2/regardlessIt would seem to me it makes no sense for him to leave, possibly never to return again, before things are completed and to my satisfactionIn any event, if the main tub body is cracked or defective, no 'patch job' repairs will be acceptable, as its integrity will have been compromised and the tub will have to be fully replaced with like kind and quality at no expense to me and/or the full purchase price refunded along with all anticipated ancillary costs to repair damages done to the residence. In that regard, the issues of the previously reported water damages to my floor and carpeting from tub leak flooding and restoring my door casing and walls from damage caused during the tub's installation and not fully repaired at that time have not been addressed, or even mentioned by Gail or ABS, in this latest 'response' from the business, nor discussed by 'Gail' in the latest phone conversation with her on 2/Apparently 'Danny' has not been informed of these damage issues, either, and is not presently prepared to deal with them during his upcoming inspection visit this next weekIt is hoped he will be given direction and authority prior to his arrival to address and resolve those matters. The above being said, the recent assurances by ABS to have the malfunctioning tub inspected and contractor(s) hired and fully paid for by ABS is a good startBut, as at present nothing has actually been physically done they remain only promises and assurances

To say I am confused at this response is an understatement. I have spoke with Ms...

[redacted] atleast a dozen times myself. I assured her today not only that we would be flying a representative out to check and see what exactly is going on, but that if there were any plumbing or electrical issues that we would hire contractors to take care of those issues directly while we are there to ensure it's done correctly. If the issue is with the physical tub itself, no license is needed but we will not know that until we get there and see what the issue is. We do not have anyone in the state ourselves so this is the best way we have to ensure it's all done correctly. I let her know he would be contacting her to schedule this for next week when she is available and that he would not purchase a ticket until she was sure she can be around those days. Again, I personally have spoke with Ms [redacted] many times including today and Monday and three times last week. We are doing everything we can to get this handled for her. We did not install this tub, a Washington plumber did, so without a rep of ours being there to determine the issue we cannot figure out what the issue is. Danny will be contacting her her directly. I did provide her Danny's phone number and she has his office address on her paperwork. I will not be providing his home address. Danny is a liscensed contractor and fully capable of determining what the problem is and how best to fix it to her satisfaction.
