Please be advised that I represent Beacon Homes, LLC (Beacon) as it pertains to the complaint form filed by [redacted] and [redacted] (Consumer) for the above reference matterOn January Consumer entered into a contract with Beacon Homes, LLC for the construction of single family home on Lot **/ [redacted] ***, [redacted] NY [redacted] in the [redacted] subdivision From the beginning Consumer made it very clear to Beacon that because of their financial position they could not afford to build a style home that Beacon was offering for the [redacted] subdivisionAs a result Consumer provided Beacon with a foot print of a home that they could afford to build provided the cost was not greater than $302,Beacon agreed to proceed with their plans and price pointBeacon offers two types of finish packages for the construction of their homesThey consist of the Gold Series (Standard Package) and the Platinum Series (Upgraded Package) I have attached a copy of the Series description for your reviewThere is a $30,cost difference between these two seriesIf you read the paragraph entitled "Exterior Features" of the Gold Series you will see that vinyl windows are included If you read the paragraph entitled "Exterior"of the Platinum Series you see that wood windows are includedI have also attached a copy of the purchase contract entered into between Beacon and the Consumer where each page was either initialed or signed You will see by their initials that the Consumer selected the Gold SeriesThe wood windows that they reference in the selection center are for prospective buyers who wish to upgrade to the Platinum SeriesI have also attached a copy of the final building plans that were part of the Purchase Contract and initialed by the Consumer All window model number's referenced in the building plans are [redacted] vinyl single hung windowsI have also attached an email from Amanda Mof Beacon sent to architect John Kthe draftsman of the final building plansYou will see that the windows that MrsMdirects the architect to use for Consumer home are [redacted] series single hung windowsConsumer received exactly what they contracted forThere was no deception, fraud or misrepresentation made by Beacon to Consumer on the construction of there homeI have spoken with the [redacted] Window representative who has advised me that the icing of the windows is the direct result of Consumer allowing too much humidity to collect in the home during the winter monthsThey were advised to use a dehumidifier during those months

I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is satisfactory to me. The windows were delivered in January and the business started the window installation in MarchIt was finally finished in AprilIt took a long time, the job is finally done and so far so good

construction of single family home
on Lot **/[redacted], [redacted] NY  [redacted] in the [redacted] subdivision.  From the beginning Consumer made it very clear to Beacon that because  of their financial position  they could not afford to build a style home that Beacon was offering for the [redacted] subdivision. As a result Consumer provided Beacon with a foot print of a home that they could afford to build provided the cost
was not greater than $302,900.00. Beacon agreed to proceed with their plans and price point. Beacon offers two types  of finish  packages  for the
construction  of their homes. They
consist of the Gold Series (Standard
Package) and the Platinum Series
(Upgraded  Package).  I  have
attached a copy of the Series description for your review. There is a $30,000.00 cost difference between these two series. If you  read the paragraph  entitled  "Exterior Features" of the Gold  Series you will see that vinyl windows are included.  If you read the paragraph  entitled  "Exterior"of the Platinum  Series you  see that wood windows are included. I have also attached a copy of the purchase contract
entered into between Beacon and the Consumer where each page was either initialed or signed.  You will see by their initials that the Consumer selected the Gold Series. The wood windows that they  reference  in the selection  center are for prospective  buyers who
wish to upgrade to the Platinum Series. I have also attached a copy of the final building plans that were part of the Purchase Contract and  initialed  by the Consumer.  All window model number's referenced in the building plans are [redacted] vinyl  single hung windows. I have also attached  an email from Amanda M. of Beacon sent to architect John K. the draftsman  of the final building plans. You will  see that the windows that Mrs. M. directs the architect to use for Consumer home are [redacted] series single hung windows. Consumer received  exactly what they contracted for. There was
no deception, fraud or misrepresentation made by
Beacon to Consumer on the construction of there home. I have spoken  with  the  [redacted] Window  representative  who  has  advised  me  that the icing of the windows is the direct result of Consumer allowing too much humidity to collect in the home during the winter  months. They were advised to  use a dehumidifier during those months.

Revdex.com spoke to Andrea at business and the following was relayed: The business has agreed that Ray will schedule an appointment to go and verify the window size openings. The window replacement depends on when the windows are received, custom orders take between 4-6 weeks. In addition, Beacon Homes LLC agrees to the following: - Business agrees to be responsible for the actions of their employees or other individuals (if self-employed) who will be providing the labor to replace the windows while they are at customer's home. -  Business agrees to remove and dispose of all the [redacted] windows on 1st floor of our home. Beacon Homes LLC agrees that at the end of the work day no window space will be left open to the elements. - To provide all necessary tools and materials (insulation, caulk, sealants, etc.) to install the new windows. - Business agrees to professionally install the new windows in compliance with building codes and manufacturers specifications and to be responsible for any damage caused to the new windows during installation. - Business agrees to restore to original condition or better, the window sills, trim, and any other interior or exterior areas of our home, including drywall and siding that are disturbed or damaged during the removal of [redacted] windows or the installation of the new windows. - Business agrees that all trash and clean-up will be taken care of daily. - Business agrees that the workmanship will be guaranteed by Beacon Homes LLC for one year. If there is an issue with the window itself, that will be the responsibility of the homeowner to take up with the manufacturer. - Business agrees that Ray will over-see and/or supervise the project from start to finish. The removal and reinstallation of our window shades and any interior painting or paint touch-up will be the customers responsibility. Beacon Homes LLC and Amanda agree that the replacement project will start within 14 days of the window delivery and that the project will be completed professionally and to our satisfaction within 10-12 days of the start of the project. Business does include that, if necessary, the project will have to allow for reasonable delays due to weather. Business also states that this is only to reinstall windows that will fit the current openings. If there are any window openings that will need to be enlarged, the additional cost of doing so will belong to the customer. Sincerely, Amanda
