I am rejecting this response because: Boost Media and Nicholas F* continue to misrepresent themselvesThey have failed in every aspect of communication and delivered a poor quality product lateThe owners of the business were involved in the process and they told Nicholas several times that they were dissatisfied that's why they offered to reshoot the interview and of course, now they are going back on their word, which shows their lack of professionalism and continued misrepresentationThe previous detailed emails with their admission of delay and offer to reshoot are enough to show that they are only concerned with collecting money and delivering junk workNo one has been impressed in their product or encounter as a company
They have no clue as to what client satisfaction is

***'s accusations are unfounded and baseless because she was not part of the sales presentation, the contract discussions, the filming process, the production process or any part of this process until after we had delivered the high quality video productSo she cannot possibly know what she is talking aboutWe believe that she is not even an employee of the client and since she was not part of any of this process, she cannot know anything that took place, let alone make these allegations. We always explain our services clearly and concisely, represent exactly what we offer and provide examples of our video products that the clients review and decided if they want to use our servicesThe representative of this client that we dealt with throughout the process was someone named *** ***, and she was presented our media kit, examples of our videos from other clients and an email with a detailed outline of our services*** informed us that the client was very impressed with our offer and the tremendous value we provide and moved forward with our servicesWe delivered this client's video product in accordance with the terms of the contract they signed with us and are ready to provide the balance, however, we do not state in the contract that we will incur additional costs of doing it all over again just because they didn't like the way their office looked that day or the way they presented themselves in the videoWe cannot control that aspect and it would be absurd to have to keep incurring expenses and re-filming until they felt that got it rightIt is a one time filming that is includedHowever, as a good faith gesture, we agreed to consider filming again, even though we are not required to do so per the contractWhen we realized that the client was abusing our good faith gesture and the demands were unreasonable and we were treated very rudely, we decided to withdraw the offer to re-filmAgain, we are not required to re-shoot per the contract and it is the contract that governs this matter, not ***'s opinionThere is no satisfaction guarantee in this contract because that is a variable that is uncontrollableAlso, it is important to note that there is no basis for saying there were delays when there is no time line for delivery in the contractThere are many uncontrollable variables such as when the doctor or patient testimonials will be available to participate in the filming of their part of the interview, what dates the practice will be available as a location to film the interviewsThat is why it took several months before the client could even set a filming date which they cancelled and had to reschedule due to other matters they had to tend with. In summary, we we have delivered a high quality video product that is comparable to all of our other videos and certainly what was presented to client initially which they were very impressed withThat is why they entered into the contract to hire our services We have always been prepared to fulfill the balance of the contract by providing the tv airings (exactly as we represented), however, the client wants us to shoot another video which we are not contractually obligated to do and that is our position and where we are

*** *** *** and *** *** entered into a contract with our company Boost Media, Incto provide them with video filming and production services to film and produce an interview discussing *** *** Treatments and interviewing their patient testimonialsAs part of this
contract, we were to provide them with marketing their services by running small clips from the interview on tv cable networks in the Woodbridge, Virginia areaWe gave them a tremendous value that was 50% off of our regular price as part of a promotionWe also told them that we will place the video on their website and optimize it on *** so that *** and other search engines can find itAs per the contracted services, we arrived with our camera crew and female interview host to the *** *** *** office in Woodbridge, Virginia and filmed the interview, patient testimonials, and video of their *** *** technology and their officeWe then produced a short version of video for them and where in the process of producing their long version as well when *** *** began complaining that we had agreed to film a female model that she had stated she would provide and have available during the filming sessionShe even stated in an email that she confirmed that the female model would be available at the date of the filmingWhen we arrived on the agreed upon date we learned from *** *** that she was not able to secure any model and since there was no model present as she promised, that we should film her and her staff modeling their technologyWe also filmed her client testimonials and her office per the terms of the contractWe incurred quite significant costs beyond what we normally incur due to the fact that *** *** requested that our female host that we provided to conduct the interviews should read several long pages of scripts that *** *** providedWe fulfilled this request even though this project ran significantly longer than our time that we schedule for these projectsThis resulted in much greater costs for us, however, we accommodated her wishes*** *** then began complaining about the quality of the video before even seeing the final draft of the video and informed us that she wanted to cancel the contract even though it specifically states that it is non-cancellable (we can provide a copy of the signed contract should you request)It is important to note that we had already incurred significant expenses with our camera man, female interview host, multi-hour filming session and in providing the services she signed up for*** *** then falsely claimed that she lost revenue based on our relationship and asked that we give her a refund and in addition that we should pay her $to compensate her (We can provide copies of her emails should you request)This claim was totally baseless and we believed that this was an attempt by *** *** to scam us for money that she may have desperately needed to keep her business afloatWe replied to her that the contract clearly states that it is non-cancellable and that we will deliver the services stated in the contractWe were even generous enough to be willing to incur further additional expenses by letting her know that will come back out to her office and film additional videos should she want and that she should have the model that she originally was required to do present at the filming. Our position is that the contract is non-cancellable and, therefore, we cannot accept her cancellation and provide the refund that she is requesting, especially since we have already incurred considerable costs for this project and this would result in a great loss for our businessThat being said, we have stated to *** *** that we have always been and continue to be prepared and ready to complete the production and deliver the products/services per the signed contract which is what we are required to do, nothing more and nothing less

This person *** that now handles their marketing is extremely rude and obnoxious and demanding and we will not incur expenses to reshoot, re-edit and produce the videoHowever, we informed them that we stand ready to fulfill the remaining services that they contracted us for and that is to provide them with a dvd of the video, air the clips on tv for months and place it on their website and on ***They indicate that they either want us to redo everything or they want a refund which we will not provide because we have delivered the top quality video per the contract and incurred significant expenses to do soHowever, again, we will fulfill the remaining balance of the contractThat is our position and where we standI will be happy to provide you with a copy of the signed contract should you request it. Throughout the entire process, we deal with [redacted] who informed us that she handled their marketing and who we were more recently informed no longer works with them. Late last year, we spoke with [redacted] about our services and presented her with detailed information including costs, procedure, processes and also included links to examples of interviews that we had produced for other medical and dental practices in the region so they would know exactly what they were getting. After reviewing everything, they wanted to move forward to retain our services so on December 2, 2014, The [redacted] Center and Dr. [redacted] entered into a contract with our company Boost Media, Inc. to provide them with video filming and production services to film and produce an interview discussing Sleep Apnea Treatments and interviewing their patient testimonials. As part of this contract, we were to provide them with marketing their practice by running small clips from the interview on tv cable networks in the Washington, DC area. We gave them a tremendous value that was 50% off of our regular price as part of a promotion. We also told them that we will place the video on their website and optimize it on [redacted] so that Google and other search engines can find it. They waited until April 14th to setup the filming date, so we arrived with our camera crew and filmed Dr. [redacted]'s interview, multiple patient testimonials all promoting their practice and services. We then produced the final video for them that was consistent with what we presented to them and what they signed up to receive. We incurred quite a lot of costs because they were very difficult and picky throughout the process.  Complaint: [redacted] As opposed to my account, which is very consistent and contains the timeline of the facts and events proving that Boost Media failed to deliver the product they signed me up for, the response provided by Boost Media on this forum is purely subjective, confusing, and based on their assumptions and alleged “hurt” feelings. Two brothers Rocco F[redacted] and Nicholas F[redacted] who got me into this shameful enterprise openly refuse to admit their failure to produce to the contract that Rocco F[redacted] fraudulently obtained from me. Prior to me signing this doomed contract, Rocco F[redacted] made multiple phone calls to me soliciting this contract before making me sign it under the pressure of false pretense and Nicholas F[redacted] who “directed” the flop using the outdated script must be fully responsible for running their fraudulent enterprise. The only condition under which I finally gave up and signed the contract was that there will be a female narrator who will talk about the business. BEFORE SIGINING THE CONTRACT I made it very clear to Rocco F[redacted] that I must not be in the footage. His response was “not a problem, we have a female host so she will cover for you.” On the day of the shooting, as agreed, I had my two customers/models ready and waiting for the crew (which was one hour late, by the way, for the filming). The female host had no idea she was supposed to talk about the [redacted] business. I caught her literally last moment as she was leaving and made her do a voiceover, which she hurriedly did in the pantry room of the salon. That voiceover has never been used in the clip. The value of the movie they did was a zero; it was a complete flop. IMPORTANT: After Nicholas F[redacted] sent me the flop their produced, I reviewed all other movies produced by Boost Media (represented by Rocco F[redacted] and Nicholas F[redacted]). ALL of them have the owner who talks about the business proposition and the value their business brings to the community. The video with [redacted] Prince William is the ONLY one that does NOT have a voiceover talking about the value of the business and the new laser [redacted] technology. When I pointed out all these shortcomings, Nicholas F[redacted] responded that I had received the first draft in error and that Boost would send me the correct 9-minute long version, as promised. After repeated requests for the “correct” version, Boost finally admitted that there was no other version and that the 1.29 minute version (including the unauthorized footage of the receptionist and me, but without the information crafted by me) was all that Boost had available. (I HAVE AN EMAIL FROM NICK F[redacted] IN SUPPORT OF THIS CLAIM.)I paid $1500 for this fraudulent contract, which failed to deliver what has been agreed upon. $1500 in advertisement on [redacted] AdWords buys me on average 50 customers who pay $100 each for their services. I potentially lost $5000 in revenue because of Rocco F[redacted] and Nicholas F[redacted] failure to deliver according to the agreement. In Rocco F[redacted] and Nicholas F[redacted] response, I am seeing nothing but sheer lies and the desire to cover the lack of professionalism by flimsy excuses in an inconsistent, confusing account.  These men obtained a contract from me fraudulently by intentionally lying to me and giving the promises they knew they would be unable to keep. Therefore they must refund me $1500 and end this farce immediately.
