I am the General Manager of Budget Auto Sales.I understand that this customer is frustrated with the service that he/she has received and I offered to help, recently in fact, but the customer did not schedule with our shop or return our phone calls.There are also some items that are not entirely true This vehicle was delivered on 7-2-15, not 7-3- We did offer to deliver the vehicle before the fourth of July as we are always closed that day This vehicle was in drive able and salable condition according to what we are required to check by law This vehicle was sold and without warranty I have documentation signed by the customer in which he/she knew of this before taking delivery We put on the contract and in our "we-promise" form to check the brakes and do an oil change, as these where the only concerns of the customer We use this form if there are things promised to the customer as part of the sale so there is no misunderstanding I find it hard to believe the customer had other issues, since the only two things in writing were the brakes and oil changeWe did replace brake parts and do the oil change as promised Lemon law vehicles only apply to new cars and not used I personally remember the time you came in to our repair facility for a vibration I was there that day It was in July After doing the alignment, we thought there might be a bent rim which we rotated to the rear You were ok with that at the time We also informed you that we could order a rim, but you would have to pay for that, and you were going to wait and see Also, you never mentioned anything to me about the heat, but I do realize it was in the middle of summer.I know you have had very poor communication from ***, who is no longer with us I talked to you several months ago and voiced that this was unacceptable on our part and you should deal strait with me with any concerns I also told you to contact our shop so we could see how we could help with the heat, which you said was "all you were concerned with" Since then, our shop has tried to contact you twice and left you a message They never reached you and you never contacted me since that phone call.I still stand by what I personally told you on the phone Lets get the car into our shop and see what is going on with the "no-heat" There will be no charge to diagnose the vehicle I will agree to pay half of the labor and half of the parts on what needs to get fixed so the car has heat

It appears that [redacted] may be confused about the circumstances she alleged in her complaint The key issue is the down payment On the day of the sale, Ms [redacted] did in fact put $down, she also agreed to pay the other $in days When Mr***, **followed up with her on the down payment, he asked her to verify that she paid the whole $down At that point she said that she would not pay the additional $down Mr [redacted] then explained to her that if she did not pay the balance of the down payment, that would be a misrepresentation to the bank and they would not cash the contract and she would have to void the contract and return the vehicle to us Attached you will find a copy of the Motor Vehicle Delivery Agreement, signed by Ms***, stating that if we are unable to assign the contract to the bank, she would have to return the vehicle to us immediately We have refunded the $that she paid down and got our vehicle back If I can be of any further assistance, I will be glad to do so Respectfully, [redacted] Finance Director

I am not sure who *** *** is as I've been dealing with *** *** who told me he was the manager
To correct some things: I was never once told when I bought this car that I would need to title it in NevadaI have never, ever bought a car in another state so I had no idea what would be involved in it. Had I been told I would not have bought the car because I couldn't title it in Georgia, as I didn't live there, and I couldn't drive the car 3,miles one way just to register the car and drive it back another 3,milesThat is incorrect that I was told anything about registering the car in Nevada. I walked out of the dealership without any paperwork at allThey told me they would mail itI had to call several times just to get the bill of sale mailed to me in Nevada
The problem here is the title is lost to the car and they are the only ones that can get it without a surety bond, which is what I would have to do if I were to apply for itThe title was never transferred to me because it was lostThe ONLY way to get this title is through Budget
I could never register this in Nevada because there was no title, that had nothing to do with me doing anything in a timely mannerI've been dealing with Budget and this car for monthsI was told the only way I could register this car was to live in Georgia, which I now have a residence in so that this should be an easy fix, but now Budget is refusing to cooperate with giving me my title or helping me obtain this titleThis has included, lying, avoiding and hanging up on phone calls that I've made
In this time where they think I've not done things in a timely manner, I've bought two other cars and registered them, so it's not likely that it's meI have proof of this if needed
This complaint is to address the stall tactics employed by Budget to prevent me from getting my titleThey won't return phone calls, they hang up when I do get to talk to someone and have generally been impossible to work with and highly unprofessionalIn addition to stalling on answering any of my questions and denying that they received paperwork from a state agency (which I verified with three different people in Nevada) they also have been difficult to work with when repairing the junk car they sold meI've never dealt with a dealership like this in my life, and I own three other carsI was also told that since I made a complaint with the state that they would not be dealing with me any longerSo now the only way to get them to cooperate is through Georgia, or by hiring an attorneyVery unprofessional

At the time of purchase in July 2013, Ms*** asked that her paperwork for the purchase of a Toyota Camry be sent to Nevada as she was living there She signed all paperwork that included the
address in Nevada We did just as she asked and sent all title paperwork to Nevada
She states in her complaint that the paperwork was returned to Budget Car Sales by the State of Nevada on Jan 24, To this date, we have received no paperwork from Nevada
After Ms*** contacted our dealership we informed her that we never received the paperwork that she says Nevada sent to us on Jan 24, On Jan 31, 2014, the day of Ms***'s visit to our dealership, we contacted Nevada , and once again asked them to send us the paperwork through regular mail To this day, we still have not received the paperwork
She states in her complaint that she has obtained a lien release from the lien holder on the Camry
All states have a deadline to complete your paperwork once it is received at the tag office, we mailed her paperwork to her state of residence in a timely manner The state of Nevada contacted her and told her it was there She failed to take care of the matter while living in Nevada She has moved back to Georgia without taking care of the car in the state she moved from From July to Jan is plenty of time and past the time limit, to get her vehicle registered
As soon as we receive the paperwork from the state of Nevada, assuming we do, we will notify Ms*** that we have it But as of today, March 4, we do not have the paperwork in our possession

We received the paperwork back from Nevada on March 4th and have been trying to contact Ms*** since There is no answer on her phone and no voicemail, the call goes to fax
I have all her paperwork ready to be picked up and also have a paper that I need her to sign that states that she is getting possession of the title and she will take it to the tag office and get it registered in her name
I have copies of the UPS label showing that we sent the paperwork in a timely manner, where Nevada signed for it when they received it and the certified letter dated Feb 26, where Nevada mailed the paperwork back to me We were not and are not holding the title from Ms*** The first time I heard ANYTHING about this was on Jan 23, 2014, the day she stormed into my office when I was helping another customer and demanded that she receive her title right then I told her I had to research it and I would have *** *** get in touch with her *** is the manager in Fitzgerald where Ms*** bought the vehicle Zach stated that he has tried to call Ms*** several time but gets no answer

Ms*** has been loud and rude every time she has contacted us The tag office in Fitzgerald said she was rude and nasty to them also I want the matter settled as soon as possible
I do all the title work and I can honestly say that I have done everything possible to get the paperwork back and sent it to Nevada because that was the address on the paperwork that Ms*** signed and
where she held a driver license at the time So, I was doing her paperwork the same way I do any paperwork for someone who lives in another state

Mr. [redacted] then explained to her that if she did not pay the balance of the down payment, that would be a misrepresentation to the bank and they would not cash the contract and she would have to void the contract and return the vehicle to us. 
Attached you will find a  copy of the Motor Vehicle Delivery Agreement, signed by Ms. [redacted], stating that if we are unable to assign the contract to the bank, she would have to return the vehicle to us immediately.  
We have refunded the $500.00 that she paid down and got our vehicle back.

Review: Back on July 3rd, 2015, I was prompted to pick up a car before the holiday so the sales people could go on vacation. I had expressed many issues with the car including why the marker on the window showed nothing on the car being of "passing" quality. Upon bringing that to the attention of the supposed owner, he ( [redacted] ) made sure to get rid of that piece of paper and supply one with "correct" information regarding everything on the car has been inspected and shown to be in working order. The vehicle in question, a 2002 Lincoln LS V8, was still not in drivable condition after test driving. I stated that the breaks were soft, steering and shaking persisted, no hot air was blowing out of the vents, and the transmission shifted extremely hard. The dealership informed me once the papers were signed, that they would make sure everything was taken care of properly. I proceeded to contact them several times at which point I was finally responded back to and told to bring the car to Baumgarts on Wisconsin Ave for an alignment and tire rotation. A mechanic that worked directly under budget auto and affiliates informed me that a new rim would have to be ordered as it was been and had sent the order over to the owner for processing. After that point, the car was not shaking as bad between the alignment and the tire rotation placing the "temporary" bent rim on the passenger rear wheel well. I was told to wait for the new rim and everything would be fine. I still proceeded to complain about the transmission as it was top priority. At each interval, the "owners" ( and I place that in quotation marks as each time I called I was told someone else owned the business ) would state that "thats how Lincoln transmissions operate". The owners refused to inspect the car again and kept delaying phone calls. I was still informed that they owners would make sure to help me in every moment to make sure I did not get a lemon vehicle. Eventually, months later and once way past the 30 day mark, under which the warranty had expired, I was told it was past the warranty and they refused to fix the heat or transmission. I have had to suffer thru this winter freezing in this car and worrying about the next time I would be able to drive this car. After many attempts and failed call backs, I am reporting this company along my first of many steps and in making sure this company is held responsible for their failed and false promises. This company does not hold up to their guarantee and customer service.Desired Settlement: I am simply asking for the company to take responsibility of their actions and hold to their promises so I can own this car with out further issues and worry of when I can actually drive it.
