Response:

I am in receipt of your complaint letter from [redacted] about the work he requested, authorized and had done at our shop. These are the events as they transpired.

On Sept. 19,2012, Mr. [redacted] brought his truck in with the complaint of it “jerking at 52mph". I drove the vehicle, ran diagnostics on it and found cylinder misfires. I checked the plugs and found they were the original spark plugs, I spoke with the customer, he said it had never been tuned up and to go ahead and tune it up. He said it had a torque converter shudder so we told him we would add a transmission conditioner to see if that wound help, which we did.

On Oct. 24, 2012, Mr. [redacted] again dropped this truck off at our Shop saying that it had a “slight jerk" at 52mph still and thought it was his torque converter. He said he had searched forums on the internet and found that was probably his truck’s problem and asked us to replace it. I did quote him a price of $600.00 to do the converter. While replacing the converter, we recommended servicing the transmission since we would be replacing most of the fluid anyway. He authorized us to do this.

On Oct. 29, 2012, Mr. [redacted] came in to our shop and said his truck would not back out of his driveway. We then went to his home, started the truck and drove it to our shop, with his permission. We let it set for a while and drove it again and it would not pull when cold. After the temperature rose to normal, it would pull fine. We pressure tested the flow of the transmission fluid and found that pressure was below specs. We found the front pump in the transmission to be defective and recommended replacing it. He authorized this work and we did the labor at no charge to him. We also replaced the torque converter under warranty although when we returned it to our supplier, they opened it for inspection while we were there and saw no problem with it.

Finally, on Nov. 27, 2012, Mr. [redacted] came in with the complaint that this truck was “slipping between gears”. We drove the truck and recommended replacing the transmission, which we offered to do for only the cost of the part. We were not going to charge him any labor to do this. He picked up his truck and told us he would have to think about it.

On Dec. 12, 2012, Mr. [redacted] came into our shop and said he had a friend that he was going to have rebuild the transmission in this truck. His fìrst question was if the torque converter was still under warranty. He then asked us how much money we were going to refund him since he said he spent $1150.00 with us and we never solved his problem. We told him we could not refund any money, since he had authorized us to do all of the work and we had done the transmission pump and warranty torque converter replacement at no charge for the labor. We had also, once again, offered to replace the transmission with no charge for the labor.

From the first time this truck came into our Shop until the last time it was brought in, Mr. [redacted] had put a total of 3513 miles on the truck.

We feel that we have been fair in our dealing with Mr. [redacted] and that we do not owe him any refund. Copies of the invoices for the work done are available upon request.

Sincerely,

Consumer

Response:

I have reviewed the response made by the business in reference to complaint ID 9336131, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

Regards,

this is not acceptable, cars told me that the torque converter would fix the problem.I told him that I didnt mind spending the money as long as it fixes the problem. He assured me that it would fix the problem. He said he had talked to someone he new that worked at the dodge dealership and agreed that was the problem. I am not a mecanic, and do not know anything about transmissions, I took the man for his word sence he has done other work for me,and I was very satisfied.I belive he thought that was the problem.bottom line is,I just aurthorised what he said would fix the problem. Its not fixed, its worse than it was when I brought it in there.

I think a refund is only fair.

Response:

We are in receipt of your second letter regarding complaint # 9336131. However, we do not feel that any additional action is warranted. We never, at any time, guaranteed Mr. [redacted] that replacing the torque converter would fix the problem. We feel we have been fair in our dealings with him.

Thank you,

Consumer
