Review: I frequently review my credit report and try to keep up with any inaccuracies. I'm trying to secure more credit to bring up my score and eventually buy another home. When credit card companies reviewed my credit they denied me because of this inaccurate account with CREDIT BUREAU OF YORK. I paid this account in full after I was (verbally promised a deletion in return for payment. Later I called CBY and asked why this account was still on my report and I was told "Sir we can't remove the account because that would be illegal" . I told them I was promised that in return for payment and was told, "either they lied or you are lying". Great feeling to be called a liar by someone who doesn't know me whatsoever.

So, this account is actually preventing me from securing new lines of credit and as a result preventing me from putting food on the table or a roof over my children heads. This account is completely inaccurate and those inaccuracies should not be showing on my report. I disputed this account on my credit report with Equifax, Experian, and Transunion 45 and 90 days ago as well and yet they still remain. This inaccurate negative reporting has resulted in REPEATED denials of credit, lost opportunity to receive credit, economic loss, damage to my reputation, loss of self-esteem, invasion of privacy, interference with my normal and usual activities, and emotional distress. The original debt holder could not provide any contract or anything with my signature whatsoever!! But in good faith after promise of removal I paid the bill even though I knew it wasn't mine to begin with! Imagine my suprise

when after paying the bill, and phone calls, that this continues to prevent me from reaching certain financial goals.Desired Settlement: I want this REMOVED from all 3 credit bureaus

I am responding to the complaint I received on 10/3/13 by **. [redacted] within the 10 days you requested. It is my understanding from the complaint that **. [redacted] is not necessarily disputing the validity of the debt but rather disputing the reporting of the debt to the 3 national credit bureaus. As a point of reference here is my summary of the timeline:

10/12/07 Equipment was rented from our Client and the transaction and Date of Charge incurred

5/15/08 Our Client submitted the account for Collection Activity, CBY sent letters on 5/19/08, 6/19/08 and 7/7/08 none of which were returned and we also made phone calls on 6/26/08 and 7/7/08 with no contact.

11/18/11 **. [redacted] disputes through [redacted] and all three national credit bureaus investigate and find that the debt is valid and allowed to remain on their credit files

5/25/12 **. [redacted] calls our office and we read him the Mini Miranda rights and he requests a contract that the actual invoices are not proof of the debt

6/21/12 **. [redacted] pays the debt in full

8/26/13 **. [redacted] disputes directly with our office, stating the zero balance on the account should not be reported at all on his credit report and we send the attached letter and invoices explaining why the debt is valid and why it is legal for the account to stay on the credit file under FCRA.

**. [redacted] did not dispute in the alotted 30 day validation period from the time the debt was turned over to collection and he recieved our first notice informing him of his rights to dispute the account or it would be reported on his credit file. If someone disputes the account in that time frame and it is found to be an invalid debt it would not be reported to his credit file. We also offer as an incentive, not as a requirement by law, that if a consumer pays a debt in full within the same 30 day validation period, we would not report the debt to the credit files. However, **. [redacted] never disputed the debt with CBY or the national bureaus until 2011, almost 3 years after being made aware of his rights.

As our letter states, as a regional credit bureau, we believe in the integrity of the credit records to reflect all payment activity, positive or negative, so that the credit report is an informational tool for creditors to know the true and accurate credit history of the consumer. If we removed entries every time someone paid a debt years after the fact, the credit report loses value to the creditors trying to make a lending decision.

CBY has followed the FDCPA and FCRA laws regarding this account and believe it to be a valid and reportable debt with a zero balance.

Please advise your determination of this complaint to be resolved or if there is any further action CBY needs to take.

I am rejecting this response because:

As stated in reply that I requested contract on 5/25/12 NEVER was I provided ANY contract or ANY invoices whatsoever from the CBY or the company that alleges that I rented from them!!! There is absolutely NO record whatsoever of any invoice or contract provided to me proving that this indeed was my debt!! I requested a contract or invoice SOMETHING and was told " well we don't have record of that...".I even contacted the original company directly and received the same answer!!! So how can you validate a debt and report when you have no invoice or contract proving this?? I dont think I was being unreasonable requesting something with at least my signature on it!! I went ahead and paid the debt because I wanted it off my credit report and it was only 90 dollars....Payment in no way shape or form proves that it is valid debt or rightfully mine!!! I paid for removal which is what I was told would happen. And low and behold after a year this is still haunting me....We are not talking about a large sum of money or me paying less then what was showing. I PAID in full a debt that wasn't and couldn't even be proven to be mine!! And I did so with a verbal promise that once it was paid in full it would be removed. This is utterly ridiculous to have to go threw all this for a 90 dollar debt that cant even be proven belongs to me..During the 3 years brought into question I had went threw a nasty divorce and when I got back on my feet and was able to financially take care of a few things to get my credit back on track I started taking care of stuff. I was gullible in the fact I didn't realize there are certain steps needed to be taken before you just pay something on your credit report. Especially things you couldn't even recall being yours...I feel taken advantage of in this situation and lied to ...But I'm sick and tired of being told one thing on the phone and something else happening. To reiterate I PAID DEBT FOR REMOVAL....AT NO POINT DID I SAY DEBT WAS MINE!! PAYMENT DOES NOT VALIDATE OWNERSHIP!!! I would appreciate as stated to begin with that this be removed from my credit report!!! Thank you....
