Review: We hired C&D to lay asphalt on a side walkway and a parking pad. They laid the asphalt on 6/9/15. They said they would be back in a month to seal the asphalt. They have not returned. My husband, daughter and myself have places roughly 8 or 9 calls to the company to tell them that we want the job finished. We have been told that someone will get back to us, or that they will be out to finish, but no one has come to seal the asphalt. A few times we called, we where not even able to reach a person or leave a message.Desired Settlement: We want the asphalt sealed and sealed properly and immediately.

Review: We hired C&D Asphalt Services to replace and seal our asphalt driveway and made the mistake of paying Mr. [redacted] the agreed upon price up front. On 9/19/12 Mr. [redacted] and his crew dug out the old and laid new asphalt but used the sealer we paid for to re-seal my neighbor's driveway (for which he was also paid) instead. I was okay with this at the time because I was not pleased with the unevenness of the asphalt (i.e., it looked like a jig-saw puzzle with multiple pieces/sections, and he used a low-grade asphalt with coarse aggregate). Mr. [redacted] agreed it was not his best work but assured me he "stands by his work" with a "lifetime guarantee" and promised his crew would return in a few days with the roller to rectify this before sealing the driveway. When they did not return, I made several phone calls to Mr. [redacted]. Each time, he would make similar assurances and promise to come back "soon" but never did before the first snowfall. When spring came, I resumed calling Mr. [redacted] to remind him he never completed the job and to request he do so because we were listing our house for sale. Each time, he would promise to seal the driveway "in the next week or two" but he never did so before we sold our house. Thus, I requested a refund for the sealer + labor to spread same, which Mr. [redacted] agreed to (and advised would be between $100-$150) on 5/17/13. He promised to drop off the refund at our house within a week but failed to do so. After we moved out of our house on 6/1/13, I made monthly calls to Mr. [redacted] requesting that he mail a check for the agreed upon refund to our new address. Each time, he promised he would do so "shortly" before abruptly hanging up on me. Finally, on 9/4/13 I called Mr. [redacted] to advise him I would give him until 9/19/13 -- one year from the date we paid him in full -- to mail me a check for $100 or else I would file a Revdex.com and/or civil complaint. This led to a text exchange wherein he said he'd pay me in "due time" and called me a "dush" [sic]Desired Settlement: Ideally I would like the full value of the sealer plus the value of the labor required to spread same, but I am willing to accept the "low end" of Mr. [redacted]'s estimate of $100-$150.

To whom it may concern,

You have asked me to provide the address of the business (i.e., C & D Asphalt Services) which I filed a complaint (#9734662) against yesterday. Unfortunately, I could not locate a SPECIFIC address either on the card I received from Mr. [redacted] (see attached) or through a Google search (i.e, see https://www.google.com/#q=c+%26+d+asphalt which simply returns "Braddock, PA 15104" along with the phone number "412-773-0094" from the attached card). I know Mr. [redacted] lives somewhere in the Woodland Hills school district since one of the reasons we hired him was the fact that he was "local" (we lived in Forest Hills at the time).

FYI -- I ran out of space on my complaint, but the following is the text exchange I had with Mr. [redacted] on 9/4/2013 -- my last contact with him -- when I advised him I would file a Revdex.com and/or civil complaint against him unless I received the agreed upon refund by 9/19/13 (i.e., one full year after he started the job):

HIM: Listen the agreement was to seal your driveway if you do not quit harassing me I will still [sic] that driveway and you can kiss my b[redacted] however I'll be happy to send you money in due time.

ME: The agreement was amended when you never same back before we MOVED on 6/1. Due time? 9/19 is 1 full year -- check for $100 in my hand by then or Revdex.com + lawsuit.

HIM: I'm just gonna seal it and that is all you're owed. Knock yourself out bro we can play games for a hundred if you want and I assure you ill [sic] respond to ypir [sic] claim.

ME: You agreed to a refund on 5/17 + 5/24 (+ numerous "check in mail" promises) so I'll cite your reversal in today's texts in my Revdex.com/civil complaints on 9/19.

HIM: I said iid [sic] pay today you just had to b a dush [sic] so my friend feel free to waste as much of your time as you like.

ME: Sorry, but "due time" not good enough. Last word from me: $100 in my hand by 9/19 or Revdex.com/civil complaints.

I include this exchange to evidence his acknowledgment that he owes me money and to illustrate his unprofessionalism by putting me off with uncertain promises to pay "soon" or in "due time." If there is anything else you require from me, please do not hesitate to contact me.
