I purchased a new Home from [redacted] at C & E Builders in Reno Nevada. It has been a fight since the day I bought his spec home for him to fix things. I have a major erosion problem that he refuses to fix. Expects me to pay to install French Drains around the house when he installed the Gutters after the landscaping was done before I bought the house. He had his site engineer recommend he fixes the issue with installing splash guards and 50 feet of black hose that I need to put out before it rains.Desired SettlementHe installs proper French Drains at each Gutter and repair the major erosion problem.Business Response To whom it may concern:[redacted] has filed a complaint with the Nevada State Contractors Board regarding this issue. [redacted]'s statements are inaccurate and I feel that it would be best to allow the NSCB the time needed to address this situation. An on-site inspection was completed on 10/15/14 and I expect a letter of determination based on that site visit. Please update your records to reflect that I will provide a more detailed response upon receipt of the NSCB's determination.C&E Builders, LLC looks forward to resolving this matter.Regards,[redacted]Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)The Contractors Board did find there was "No Code Violation" But when you purchased a New Home you expect items to be completed with no major issues. If [redacted] installs gutters after landscaping was installed and does not properly plan where the water will go when it rains that is my opinion poor planning. I now have major erosion issues all around the property that will cost thousands of dollars to repair plus I now have moisture under the house by his poor planning of the gutters. I have been fighting from day one to get items fixed under his "2 year new home builders warranty " that is written into the sale contract.The Contractors Board says if it is not on the house plans (The French Drains)then they can not enforce the contractor to fix the issue. I said what about the missing rock streams that is on the APPROVED plans. They said well the contractor can change the plans...this makes no sense...Now I have a stream that runs through the property when it rains causing more erosion. I guarantee I could not sell this house without fixing the erosion caused by [redacted] poor planning after he installed the gutters. It is my opinion that the subcontractor that [redacted] used should have informed him of the potential damage that would be caused by not installing the French Drains. After the damage was reported to [redacted] on July 18th 2014 with pictures.. by [redacted] his warranty employee his response to [redacted] was "Well he bought the house without French Drains" this is what I was told by [redacted] a few days later.The right thing for [redacted] to do was stand behind his job and see the damage that was done to my property by his poor planning of the landscape drainage issue and fix it. [redacted]'s solution was to provide me 50 feet of Black Irrigation Hose or Splash Plates because he could see the damage and that what was also recommended by his Site Engineer. He expects me to go lay out black irrigation hose all over my property above ground before it rains. This in my opinion is absurd..and not on a 700k plus home in Reno Nevada.The Contractors Board said in the end that this was instead a Civil Matter and now I have to take him to Civil Court to remedy the major erosion issues and missing Stream Rocks. All [redacted] has to do is install the french drains and the missing stream rocks and repair the erosion...at a cost of a few thousand dollars to remedy this problem.Sadden First Time Home Owner...
