knocked over into the pool and ripped the linerAt that time we told Ms*** that we would talk to *** *** *** and investigate the matter furtherAfter talking to *** *** *** and finding out that they had no incident report pertaining to the property in question and also factoring in that during that weekend there was a terrible storm with wind gusts up to m.p.hwe determined that this unfortunate accident was an act of natureOn December 29, we were contacted by Ms*** and her real estate agent and discussed the situationWe explained that because there was no proof of negligence of the part of Carmel Valley Pest Control or *** *** *** that we were not liable for any damages due to an act of natureAfter our discussion with Ms***’s agent it was our understanding that the matter was closed and that no further action was needed on the part of us or the fumigation companySincerely, *** *** Office Manager Carmel Valley Pest Control [email protected] 858-350-

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.
The table in question was in the same position for the last 12 plus years. Also, there was a pool cover reel in front of the table that is on wheels. if the wind was strong enough to blow over the table why wasn't the wind strong enough to move the reel? The table in question has not blown over in 12 plus years and my neighbor told me the wind was not bad that weekend. I have known trees to have been blown over in years past, however, that table has always stood fast.
