Revdex.com:
As stated by CACRM no agreement on other grievances has or will be executed at this timeI expect refund of stated amount $to my credit card company as stated by CACRM on April 16th However, it is May 8th and there is no confirmation of this by my credit card company.
I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution would be satisfactory to me. I will wait for the business to perform this action and, if it does, will consider this complaint resolved

As of April 16, *** *** and CACRM have resolved the complaintA letter
was sent to the customer's credit card company "Dispute Resolution Department" (attached) and as requested in the "Pre-Arbitration Notification" we have included proof of the contract and the refund policy, executed by the claimantsThe contract states "There will be no refunds for any of the above individual services not performed if treatment is canceled after initiation, only credits will be applied towards future treatment " Please note the refund offered to the claimants regarding their IVF/FET was contingent upon them executing the "Release Agreement" provided by Hegeler & Anderson Law OfficeUnfortunately the claimants threaten the clinic with unreasonable and frivolous lawsuit, therefore prompting attorney Anderson to compose and request the Release Agreement
However due to the multiple discussions and several unsuccessful attempts to resolve this matter and although we have not received the executed release from the claimants, *** *** and CACRM without fault and solely as a good will gesture have agreed to release the funds to the claimantsWith the release of the funds we except to have this disagreement resolved

Review: Below paragraph is one of a few emails provided to Navy Federal in regards to a charge for services never performed that were promised verbally and again in writing on 11/11/2013 by [redacted] owner of CACRM to be refunded. She refuses to refund this charge and has tried to dispute Navy Federals reversal of charge. Navy Federal suggest contacting Revdex.com for assistance in this matter. I can provide a copy of the 11/11/2013 email from [redacted] stating CACRM would refund the charge of $3350 for services that were never performed. Your assistance in this matter would greatly be appreciated.

"Dear Navy Federal, Thank you for reversing the charge that CACRM said they would refund and reverse then later refused to do so. This charge as stated and showed in previous messages was for sevrices never recieved or completed that were scheduled for 10-30-2013. As agreed by CACRM and [redacted] they were to be refunded. She even reiterated this in an email dated 11/11/2013. Unfortunately other separate medical negligence, malpractice issues and fraudulent charges are being dealt with as well with CACRM. She hired an attorney and this is when she refused to refund the charge to NAVY Federal visa of $3350. Since this reversal I have received 2 threatening emails from her attorney stating if I do not release CACRM and Dr. [redacted] from all liabilities and claims they will not refund this $3350 charge for services that were never performed and promised to be reversed and refunded. Please be aware of this when they falsely try to claim this charge was valid. I will attach the threatening emails. One last fact Dr. [redacted] of CACRM stated and reiterated in the 11/11/2013 email the charge would be refunded before any discussions with attorneys. Thank you for your consideration!"Desired Settlement: Either [redacted]/CACRM drop dispute of reversal of charges done by Navy Federal or refund Navy Federal credit card in the amount of $3350 as promised twice, verbally back in September 2013 and in writing November 2013.

Re: ID Number: [redacted]

To Whom It May Concern:

As of April 16, 2014 [redacted] and CACRM have resolved the complaint. A letter was sent to the customer's credit card company "Dispute Resolution Department" (attached) and as requested in the "Pre-Arbitration Notification" we have included proof of the contract and the refund policy, executed by the claimants. The contract states "There will be no refunds for any of the above individual services not performed if treatment is canceled after initiation, only credits will be applied towards future treatment ... " Please note the refund offered to the claimants regarding their IVF/FET was contingent upon them executing the "Release Agreement" provided by Hegeler & Anderson Law Office. Unfortunately the claimants threaten the clinic with unreasonable and frivolous lawsuit, therefore prompting attorney Anderson to compose and request the Release Agreement.

However due to the multiple discussions and several unsuccessful attempts to resolve this matter and although we have not received the executed release from the claimants, [redacted] and CACRM without fault and solely as a good will gesture have agreed to release the funds to the claimants. With the release of the funds we except to have this disagreement resolved.
