Please find the original incident report from the accident attached, as well as the verbiage in response to their refund request belowAll camp families are responded to as soon as possible when they have questions or concerns in regards to refunds, and are told that responses are sent towards the end of the summer when our camps have endedIn regards to some points in her actual complaint filed with you: - There were not total kids this summer, let alone the many years we have been in business, to have fallen on ‘slippery steps’Steps are made of typical outdoor wood/decking material and were not faulty- Parents were contacted by our nurse and able to speak to their daughter after they returned back from the medical facilityThis is in accordance with our medical treatment procedures as written in our Parent Handbook: PROCEDURES: A camper not feeling well can go to the Health CenterOur nurses either treat the camper or send them to a local physician, or in the event of a significant health issue, the hospitalOur nurses will call parents only if a camper is in the Health Center more than one nightThey will not call parents for routine care, non-emergency x-rays, being placed on medication or for medical issues that have been resolved- The no refund policy is clearly stated in our enrollment contract, details of which are explained in the verbiage belowIf you have any further questions, please don’t hesitate to ask To the Family of [redacted] Re: Camp Shane Refund Request [redacted] : It was unfortunate and we are truly regretful that Colin did not complete the session for which she was enrolledWhile we are of course sorry that she was injured, it was purely accidentalOur nurse arrived on scene within a couple of minutes and reported that there was no indication of an actual injuryColin displayed vital signs and told the nurse herself that she was “fine.” All of this was relayed to you by the nurse herself It is evident that the account she gave the doctor in the Emergency Room was significantly different than the one she gave our nurse as well as what she communicated to you directlyIt is the belief of our nurse that Colin didn’t particularly enjoy camp which could have potentially led her to exaggerate symptoms with the hope of going home earlyAll incident reports and medical records were previously sent for your reviewWe understand from you that she has spent some time rehabilitating at home and trust she is doing well No Refund Policy The risk of not completing a session and our refund policy are clearly described in our Enrollment Contract paragraph #No adjustment, allowance or refund of the deposit or balance of the tuition fees shall be made except as follows: A - Where a Camper notifies Camp Shane prior to February 1st that he or she will be unable to attend for any reason whatsoever, a full refund will be made of all fees previously paid less a non-refundable registration fee of $B - If cancellation is due to non-payment of tuition, all money received by Camp will be treated as liquidated damagesReduction of sessions must be requested before May 1st C -The Camp shall have the right to receive collection and attorney's fees on any unpaid balance, plus interest, expenses and court costs Due to the seasonal nature of summer camping, there is no refund or credit for any portion of the camping period not completed including late arrival, early departure, dismissal for cause, illness or accident, disability or withdrawal for any reasonThe parents recognize that there is a risk that their child may not complete the season and in that event, assume full financial lossTuition and fees already paid and/or due are agreed to be the fair and reasonable sum as and for liquidated damagesAll claims for refund or credit are expressly waived and released by the parents and/or guardian of the childWe strongly recommend parents purchase insurance to cover the cost of tuition in the event the camper does not complete his or her enrollment Of course, it is upsetting to pay for services not usedI understand that, and I am truly sorry However, regardless of the reason behind a camper not completing the season we realize virtually no cost savings as our expenses are mostly fixed, like insurance, taxes, rent, employees, utilities and more – and they continue without reductionIf our policy were otherwise, we would incur a financial loss that we feel is not fair for us to assume We have only one short season for which a contract was signed making a commitment for a specific period of time Insurance Please take note that you did not elect to purchase the optional TravMark Summer Camp Protection InsuranceTheir information was presented in our Parent Handbook as well as on our websiteIf this plan was purchased there is a possibility that the camp tuition may have been reimbursed I know this is not what you were hoping for, but please try to understand the reason behind our policy We wish Colin the best of luck and health Kind Regards, David E [redacted] Director /Founder Camp Shane Mary B [redacted] ***

It is the belief of our nurse that Colin didn’t particularly enjoy camp which could have potentially led her to exaggerate symptoms with the hope of going home early.
