Review: My name is [redacted] My complaint is with [can do auto] phone no. [redacted] I bought a ton truck off of this dealer, 1 ton, [redacted] truck 3500 also [[redacted] ] for not fîxing the truck, after spending over 3,743,00 with them. And they put parts that was not needed. 1. I learnt the next day after buying this truck it had a problem, it was missing and back firing and would not run right, and it was heating I call the car lot and he told me not to bring it back because it was heating and might something up but he refuses to fix the truck. 2. So I call [redacted] auto to get the truck fixed- lst time they told me that the air flow sensor was bad and the cluster needed replaced and this would cost l,020.21 dollars, so I told them to fix it. it was no good to me not running. So they did that, but the truck was not fixed and did not change the running at all. So I called them back and told them, so they said bring the truck back so I did, the 2nd time about -3 weeks went by they called and said the truck was ready but when I tried the truck it did not change at all. It was not fixed. So I called them back and told them it did not fix the truck, so they said bring it back. So I did, and they call and said. both head gaskets was blooded, I know this was about impossible. That both head gasket blowing at one time. I asked how much this would cost they told me l683,00 so I told them to fix that, they did that and it did not fix the truck. It did not run any better then the first time I took it to them. So I call them the 3rd time, and told them the truck is still not running right there was no difference in the truck. They said bring it back we look at it . So I take it back, to them. 4. So I took it back the 3rd time. They told me the injectors was stop up so they removed and replaced 2 injectors, and aid they cleaned fuel rail and changed the filter. And this cost me 742.06 dollars. But I tried the truck and it also did no fix the truck. It no better to day then the day I found out it was messed up. I believe it was not my responsibility to fix the truck in the first place, but can do auto will not fix it, my question is- am I stuck with a truck that wont run, that I can do nothing with, paying payments of 3,24oo dollars month for the next 3-1-2 years for a truck that wont run. And the way he talked he knew the truck was messed up. He said he sold the truck once and they brought it back, I see why. 5. All I want is for [can do auto] to fix the truck or give me back my money, that I paid on the truck. And the cost I amout, or [redacted] auto fix the truck they got pay to fix, with out costing me any more then it all ready has. I don't believe I am being unreason able.Desired Settlement: Refund

Business

Response:

My name is Larry Crigger and I am the owner/operator of Candu Auto Sales & Service, which is located in Rural Retreat, Virginia. I opened my business as an Independent Automobile Dealership in May of 1985, and in the 28+ years I have been in business, I have never had a complaint lodged against me with the Revdex.com.,.until now. I feel that the complaint is unfounded and detrimental to the reputation for honesty and integrity which I have worked hard to achieve through my business dealings with my customers throughout the years. I would like to address the complaint filed against me. The vehicle in question is a 2002 [redacted] 1 ton dump truck which I purchased from Radford Auto Auction under a. "green light". This means that the seller was saying that the vehicle did not have any announced conditions or known mechanical problems. On March 28, 2013, the complainant purchased this vehicle from me “AS IS: No warranty". He signed 2 separate documents: Buyer's Order (Bill of Sale) and Buyer's Guide (copies attached) which signified that he understood that the vehicle was being sold "AS IS" "with all faults and is not covered by any dealer warranty". The Buyer's Order further states. "I understand that the dealer is not required to make any repairs after I buy this vehicle. I will have to pay for any repairs this vehicle will need." The Buyer's Guide is marked “As Is-No Warranty" and states, "You will pay all costs for any repairs. The dealer assumes noresponsibility for any repairs regardless of any oral statements about the vehicle". The complainant drove the vehicle prior to the purchase. He also could have asked for a pre-purchase inspection where he would have had the vehicle inspected by his own mechanic either on or off of the lot. The Buyer's Guide, which he signed, spelled out the details of the pre-purchase inspection. The complainant chose not to have this done. The complainant was borrowing money from his bank to purchase the vehicle and he did not have a trade-in. I gave him a $900.00 discount off of the original purchase price. On March 29, 2013, the complainant called and said that the truck started "heating and missing" on his way back home the day before. He asked about bringing it back to me for my mechanic to check. but I advised him that driving the truck the distance (79 mile/ travel time: one and a half hours) back to Rural Retreat from his home in Cedar Bluff was not a good idea. If the tuck was over-heating, driving it that distance could cause major damage to the engine, I recommended that he find someone closer to him to check the vehicle out. Approximately three months later (June), I received 4 different bills from the complainant for parts for and work done to the truck by: [redacted], Inc. ($42.80 & $1,020.00), [redacted] Auto ($23.09) and [redacted] Auto ($248.82), Several of these bills were not related to a vehicle missing or heating up. I have always dealt fairly and honestly with my customers and generally if a vehicle I have sold "As Is" needs repairs within 30 days of the sale, I will pay half (50%) of the cost of those repairs' Even though 90 days had passed since the date of the sale, I sent the complainant a check (#[redacted]) for $667.46 to cover half of the expenses he had incurred. This was simply a good willgesture on my part, not because I was in any way legally obligated to do so, The wording in both the Buyer's Guide and the Buyer's Order is very specific as to what an “As Is" Sale denotes. As far as I knew at this point, the vehicle had been repaired to the complainant's satisfaction. According to one of the Invoices (MO 48401[redacted]) from [redacted], Inc. dated June 21, 2013, the mechanic there had replaced a blown fuse; test drove the vehicle, and stated, “Vehicle is currently operating as designated". In October of 2013, I received another letter from the complainant with bills for additional work done on the vehicle by the same garage as before ([redacted], Inc,). By his own admission (in the letter he sent to me and the complaint he filed against me with Revdex.com), he took his vehicle to this same garage three (3) times. The mechanics there worked on the truck allthese times and charged him for parts and labor; however, he said the work performed "did not change the running of the truck". I do not know why this particular garage has not fixed his truck, but the work they are doing and the parts they are replacing seem to be excessive and in some instances, unnecessary. I cannot be held accountable for the inability of another garage to fix a problem or this vehicle 61/2 months after the sale. I am very sorry that the complainant is continuing to have problems with this vehicle and I have tried to deal fairly with the complainant going beyond what I was required to do. That being said, I do not appreciate the threatening tone of the last letter I received from him or having an unfounded complaint lodged against my business. Also, in his complaint, the complainant said that I told him that I had "sold the truck once and they brought it back", This is incorrect. I told him that a lady had previously made a down-payment on the truck, but was unable to get bank financing so the sale did not go through. Her deposit was refunded to her. The truck never left my lot and was never in anyone else's possession. For the record:I never refused to fix the truck, but was afraid for the complainant to drive it for the distance back to my place of business (a trip of l 1/2, hours) if it was overheating (which might result in damage to the engine). I am not responsible for work done by another garage or their failure to correct the problem. The vehicle was sold “As Is" and the complainant signed 2 separate documents stating that he understood that he would be responsible for any future repairs. In a good will gesture, I paid 50% of the repair costs done up to three months after the original sale date. The invoice from [redacted], Inc. indicated as of June 21, 2013. after a test drive. The “vehicle was currently operating as designed". Again, I am sorry for all that has happened to the complainant, but I feel that his complaint against my business is unfounded. Thank you for your consideration in this matter. If you should wish to contact me or need further information, please do not hesitate to call me at ###-###-#### during normal business hours. Respectfully yours,Larry F. Crigger, OwnerCandu Auto Sales & Service

Response:

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below. My name is [redacted] and I feel that Larry Crigger the owner of Candu auto sales knew the 1 ton dump I bought wasmessed up. When he sold me the truck, even told me to put pure gas in the truck. He says my complaint is unfounded Mr Criggersaid he bought the truck at an auction under a green light. I don't know what this green light means, but it did not mean it was ready to go. It has not run right for 6 months. May be my mistake signing a paper that I did not read fuIly. But this [as is,] paper should be on the truck. Where people would see it when they look at the truck. If this paper made me responsibleto fix this vehicle that was messed up when I bought the vehicle off the lot I will take this responsibility. And pay it myself. But I feel it should be ready to run when you bring it off the lot. Mr. Crigger is right about one thing, some of the work that [redacted] did was unnecessary the only thing that was wrong with the truck not running right was sand in the gas tanks. Mr Crigger said he never refused to fix the truck, but how did he think it was going to get fixed, if he did not want me to drive it back unto the lot to get it fixed. He said in good gesture I paid half the bill. The way I counted it was not half, it was not even a third. He said [redacted] tested the vehicle and it was operating as designed. When I picked up the vehicle and on the way home it quit on me it not design to quit on me, until I cut the key off. It was not made to miss and make all kinds of noises, I think any vehicle should be ready to ride that you buy off a lot-- at [least a few weeks or a month.] After that the owner should fix it. If I am responsible for a truck that was messed up when it cameoff the lot then drop this case. against candu auto. This truck still has problems -but what can I do ? Regards,[redacted]
