RE: Complaint...

Report Case: XXXXXX
[redacted], [redacted]
[redacted]
Camdenton, MO XXXXX
(XXX) XXX-XXXX
RESPONSE:
CRASH MAGIC EXTREME AUTOBODY AND RESTORATION has had contact with [redacted]. We agreed to address and correct her complaints, which were: 1) paint flaw on driver door 2) loose screw/bolt on door threshold 3) check the seat belts she purchased (we installed ONLY) to see why they wouldn't retract -
We picked up the car on September 18, 2014 at her home and drove it to our shop. The car had severe road vibration and poorly repaired frame damage. It was in need of correct frame repair as well as front end rebuilding - replacement of +30 year old lower control arm, all bushings, and ball joints. The frame had been welded - poorly - and needed a subframe replacement or repair. Big motor + bad frame and front end = a very dangerous car. Had we known the condition when we picked it up we would have NEVER driven the car around the block. We found those problems when we inspected the car at our shop - and communicated the problems to [redacted]. She chose not to make those repairs at that time.
The car was dark green. Customers elected to change the color. They picked out the color and we painted the car per their instruction - to the color they chose. They were given the paint code. It is NOT a custom mixed paint. It is also NOT an original 1973 Corvette color. They agreed to and approved the color BEFORE the car was painted. They picked the color, we didn't.
The car was stripped, fiberglass repaired, numerous difficulties were repaired before we painted the car. The car has been in numerous accidents and had been repaired badly. Those things were repaired and corrected - and we fixed numerous things that were not included on the original estimate. At each turn we talked to and explained the situation to the customer - and gave them the option to repair or not to repair. [redacted] chose to buy parts and have them shipped to our shop. Those parts were not original type factory equipment. The seat skins she purchased are cheap fake leather/plastic. Knowing that she would not be happy with the skins we suggested the seats be sent to an upholsterer for the best end result. We had the customer pay the upholsterer to install the skins - at her choice. The seat belts that she complains about are seat belts SHE purchased. She has a warranty on those seat belts and told us she has a year to replace them - all we did was put them in the car. And, they aren't original equipment. They're cheap and aren't working - not our fault. Hers.
Further, we offered, according to our policy, to address any complaints [redacted] had and to fix those problems at no expense to her. She wanted us to pick up the car at which time she was told that the car was unsafe and a liability for us to drive, in fact, she admits that it was unsafe for her to drive and that she had additional repairs made in order for it to be safe for her to drive. We repair cars - we are not a transport service.
This 1973 Corvette is not and never will be a show car. It, at most, would be a passable driver. We documented the repairs and bodywork and have proof, as well as outside witnesses, as to the way the car looked when it left our shop. We also offered to correct any/all paint problems or problems that originated with our work. CUSTOMER REFUSED AND MADE APPOINTMENTS SHE FAILED TO KEEP. SHE FURTHER STATES THAT SHE WANTS A REFUND OF [redacted] WHEN SHE STATES SHE PAID [redacted] She didn't give us the opportunity to correct her complaints even though she made appointments she clearly had no intention of keeping. She also took the car to another shop voiding our warrantee.
[redacted] is a customer no one wants. She has an old brittle 73 Corvette that will never be a show car. Either her intent is to pawn this vehicle off to an unsuspecting buyer as a 'show car' or she has no idea what a show car really is. Anyone who owns or has owned an old Corvette knows that they are fraught with problems - and they came off the factory line that way. This is not a car that has been set in a garage - it is a car that has been multiply wrecked and badly repaired. At best it has the potential of being a pleasure driver that will never be reliable.
Again, we keep photo record of our restoration/repairs. Those are available. When we do a restoration, use the best parts available, not the cheapest. The seat skins, seat belts, and mirrors were [redacted]'s purchase. We did not agree to a full restoration. Our contract was for 'paint job and body work' - only.
We've offered numerous times to correct the so-called paint flaw, to check to see if the seat belts she bought were jammed (and she was told she might have to return them to where she bought them) and to put in a couple screws that she claims are missing. We booked an appointment for the car's return to our shop - which she failed to keep.
Finally: No one can please someone with unreal expectations. [redacted] got a lot more than she paid for and she's still not happy, We did all we can/will do.
Initial Consumer Rebuttal /* (3000, 10, 2015/03/19) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Before I received this Corvette from [redacted]'s shop I received am email stating she was "Ready To Go." All issues which I am unsatisfied with SHOULD have been addressed BEFORE I paid the [redacted] to have the Corvette shipped to Camdenton.
As far as seat belts not working, driver's door not opening and shutting as they should, seats being bolted down with ONE bolt per seat, how did [redacted] expect me to drive this Corvette 90 miles to take it back to his shop? Should I mention the fact of the door sill on the passenger side not even being screwed down? With the mention of all this and [redacted] thought she was "Ready to Go?"
Yes, I did have the lower control arm, ball joints and bushings replaced. So the car would be mechanically sound. The mechanics which performed this work assures me the front end of this Corvette is now as it should be. As far as [redacted]'s stating that this Corvette has been wrecked several times this is news to me. And his degrading my Corvette has nothing to do with the lack of quality HE has demonstrated in repainting/restoring the interior of my Corvette.
BTW our Corvette was NOT DARK GREEN when [redacted] received it it was MEDIUM BLUE. Perhaps [redacted] has my Corvette confused with another? [redacted] does show a picture of a Dark Green Corvette which he supposedly worked on in one of his [redacted] advertisements.
Currently this Corvette is sitting at a local Chevrolet Dealership waiting for [redacted] to send replacement seat belts which will be installed. This dealership will also bolt seats to frame with FOUR BOLTS rather than ONE.
As far as the paint flaw is concerned I will take this Corvette to two local body shops which specialize in painting fiberglass to get estimates on repainting the section of this Corvette's Passenger side door, T-Tops and hood where head light covers are rubbing the paint off.
IF that is in fact all that need to be painted to get a color match. I am NOT dissatisfied with the paint color. It is exactly the color I chose to have this Corvette painted. I AM dissatisfied with the result of the paint application.BTW The paint flaw is NOT on the driver's door as [redacted] states It is on the Passenger door.Again are we certain [redacted] does not have my Corvette confused with the Dark Green Corvette which he has had in his shop in the past?
[redacted] mentions the quality of the products I purchased and provided to him for restoring the Corvette's interior.Except for the seat belts I am perfectly satisfied with each product.
[redacted] states I paid him [redacted] amount was for the repaint, and repaint prep work. The total which I actually paid [redacted] is [redacted]
In view of the repainting cost I will be paying to correct [redacted]'s deficiencies.Plus cost I've paid and will pay to correct issues which SHOULD have been addressed BEFORE I paid [redacted] to have this Corvette shipped. It is my thought that I should be reimbursed for these costs.
Final Business Response /* (4000, 13, 2015/03/20) */
Yes, the color was blue green - and I, [redacted]/co owner of the shop - remembered it as a faded dark blue green - not really a true blue. I didn't confuse cars.
[redacted] was offered the opportunity, many times, to bring the car back down and have us address any and all difficultties or problems that originated with the work we did. She chose NOT to do that. The fact that she has incurred extra charges where her choice entirely. There is also a problem that we refused to transport the car from Lake of the Ozarks (again) to Springfield, MO. Had we known how difficult she is to deal with we would have NEVER allowed the car in our shop. When it was time to deliver te car SHE sent the transport - which was a choice only she made. As far as it being repaired now, there is no reason why it couldn't have been returned for any and all problems to be correted. That would have been free to her. There were also numerous repairs and body work that she wasn't charged for - and there will be no refunds. She voided the warrantee and destroyed any and all good will by failing to show up when she scheduled a return appointment and chose to go elsewhere - without allowing us to screw in a couple bolts and do some spot touch up for problems that she claims, but we've never seen. That should have been more than acceptable.
Final Consumer Response /* (4200, 16, 2015/03/23) */
(The consumer indicated he/she DID NOT accept the response from the business.)
My 73 Corvette was in [redacted]'s shop from 9-18-2014 till 2-10-2015.that a period of 5 months. In those 5 months he has produced a Very Poor repaint. I have forwarded several pictures of the areas of the car which will need repainted. I am in the process of having 2 qualified body shops view the paint and give me quotes on the cost of repaint of those areas.I have emailed pictures of the poor paint quality results to the Revdex.com.I have emailed pictures of the Corvette's paint color Before [redacted] did the repaint.

The seat belts have been removed from my car mailed to [redacted] for exchange. The dealership which removed the seat belts says they were broken.Since I was never able to get the seat belts to retract this was a factory default or an improper install.
As far as my not showing up for an appointment, that was not the case. March 7 I emailed asking when they wanted the 73 back in their shop. A few days later [redacted] replied giving March 16 as the day I should take the car back.I Did Not Reply to that email. Therefore I did not confirm the date.
The reasons I did not take the Corvette back to [redacted]'s shop are numerous. The driver's door was not shutting, the seat belts were not useable, and the seats were bolted with ONE Screw per seat rather than Four screws per seat. All of these issues are safely related and HAD to have been obvious to [redacted] Before I was sent the email telling me the car was Ready to Go.
I paid a transporter to pick the car up partially due to the fact of [redacted]'s telling me it needed the lower control arm bushings and ball joints replaced. He says he had no one in his shop qualified to install those parts.
[redacted] states I voided warranty by taking my car to other shops getting the door adjusted so it would stay closed as I drove the car.and having the seat belts issue taken care of.
The very day I received this car from the transport company I emailed with info regarding the seal belts, poor paint quality, door issue, carpeting, radio issue door sill not being screwed in on passenger side, etc.
I seriously feel all this shows a great deal of lack of ability on [redacted] part to perform this repaint and interior restoration.Plus his not being concerned with he safety issues he had created.
I chose not to give [redacted] a second chance to correct this issues due to the fact they should have been corrected before I paid to have the car shipped. It would cost me time, money, inconvenience great deal of stress not knowing what condition my Corvette would be in when I received the next email telling me she was Ready to Go.
I have each and every email which was exchanged between myself and [redacted]. I believe these emails prove my statements and [redacted]'s lack of ability in repainting and restoring my 73 Corvette.
