Initial Business Response /* (1000, 5, 2017/05/02) */
*** came to All American Auto & Diesel on 12/13/to get an EGR delete done to his Ram HD, *** came in explaining that his truck had a terrible shutter and has had it since he got it, he said he believed his truck was crashed
before he bought it and no one told him, he complained that the programmer for the EGR would not program his transmission, *** told him that it doesn't come with that, *** wanted to address his shutter thinking the EGR delete would fix itThe next time he came in was 02/27/and he was complaining about his transmission still shuttering and the EGR delete didn't fix it, *** asked why he didn't take it to the dealer since his truck only had 45,miles on it and should be under warranty, and his transmission is not due for service till 100,miles*** said he was kicked out of Dodge in Carson City for trying to get them to replace the transmission, and being out of line so he could not bring it in there to be serviced, and that he did not want to drive all the way to Reno, but since he got the EGR delete the truck was no longer under warranty anyway
*** and *** worked together on this truck, dropped the pan and informed *** that there was metal in the pan and in the filter*** then got his scope and took pictures of the metal in the pan, and showed it to *** told them the transmission needed to be serviced even though he was informed of the metal in the pan*** told *** servicing the transmission would not fix his problem, but he wanted it done either way*** stood in the back with *** and *** while they performed the service, asking questions and watching everything
*** came up to the front to ask me if he could pay early before his service was done and I told him I did not have all the information in the computerHe then went in the back again to ask ***, and came back up front to pay againI told him the total and he argued with me that it was not correctI told him I have to go off what the computer tells me in the estimator, so he went in back and got ***
*** told him that I have to go off what the computer tells me when it comes to labor hours, so as a courtesy, *** generously lowered the bill, and I only charged him for quarts of ATF* was informed of the discounts he was receiving at the time and paid for his service*** then went back outside to test drive ***'s truck, he drove from Industrial way up Jakes hill, and back, when he came back he walked outside with more ATF and topped his truck offChecking all the fluids while *** stood next to him watchingHe also acknowledged the amount of ATF put into his truck when he told *** that his truck takes quarts of ATF, *** told him it doesn't take 12, they usually take 6-quarts when servicedThe service was paid for so I couldn't add the extra quarts of ATF to the bill
*** then left with his truck, it wasn't until the middle of March he came back in complaining about his transmission, telling us there was no fluid in it and that he himself went and bought ATF to put in itHe came in with a box of random, old bottles and started showing *** a video on his phone, *** told him there is no way the transmission could have been empty or quarts low as *** indicated*** then said he would work something outHe would remove the EGR delete for free so he could take his truck in under warranty to get it fixed, *** shook his hand and agreed to removing the EGR delete, and then made an appointment with me for 4/4/in which he never called or showed up
He came back in the Friday after *** went in for surgery 3/24/2017, I went in the back and got *** so he could hear our conversation, and so I was not alone with himI told him *** was not here, and that he missed his appointment, when it was just the two of us, he was aggressive, angry and threatening, he told me he knew he missed the appointment and it was because he changed his mind, that it was pointless because he knew Dodge would not fix his transmission since he had been 86'd from them, and that he wanted *** to fix this problemI told him *** would be out of the shop for a while so he could recover from surgery*** told me to have *** call him or he would come back in and rudely said "you do not want me to have to come back down here."
*** came back in on 4/11/very angry and demanding *** has to pay for his new transmission and give him a full refund of the services done on his truck, *** told him they made a deal that *** agreed to and *** did not show up and he was not replacing the transmission because it had those problems coming in, *** started to get more angry so *** told him to leave and not come back
That day I called Dodge in Carson and talked to a manager to find out what happened, he told me that *** had brought his truck in, in February of with 5,miles on it complaining of a shutter, he returned to them April of with 9,miles on it with the same issue, Dodge agreed to look at it but did not repair it*** lost his temper, they kicked him out and told him he was not welcome back, they said when *** left he "burned out of the parking lot of dodge, driving over all curbs and almost hitting vehicles." They warned us to be careful dealing with him and said it sounded like we may have been set up
*** is trying to say there was never a shutter in his transmission until we serviced it, but the shutter is the reason he wanted us to service it and he's been bringing it into shops since with only 5,miles on it with this same issue he's trying to accuse us of causing
*** called multiple times making threats, and came in multiple times before being told to not come back, Jerome, the other owner of the business, respectfully emailed *** asking him to not contact All American Auto & Diesel again and to talk to our attorney if he had any further questions regarding this issueWe have not seen or heard from him since
***'s original email to us:
"***, I wanted to take this opportunity to try to come up with, in my opinion, is a more than fair resolution for the damage caused by under filling my 68ref transmission in my Dodge Ram 4xI know we are both aware that the transmission service in dropping the pan and replacing the two filters requires quarts to refill the fluid that was lost during serviceI can prove that a 68ref 4xtransmission will require quarts of +transmission fluid with a hour laborThe labor I was charged for the same service at All American was hrs and only quarts were replacedI also have a transmission fault code of low line pressure freezed framedMy transmission is friedI never had any shuttering during shifting until after All American serviced my transmissionI know how many quarts I had to add to bring the transmission to full when transmission was at running tempdegrees in neutralA total of quartsWhat I feel is more than fair is to be reimbursed for the transmission service of 2hrs labor and parts with shop supplies required to service transmission and 1/the cost for a rebuildTransmission assembly-tune-Applicable models, should have been service transmission and replace filters and fluid, with parts and shop supplies came to $along with 1/the cost of a 68ref trans would be $2,For a total of $I have received Multiple estimates that average to $I feel that I am being more than fair, but wanted to advise you if we can not come to a agreement, I would have no other course, but to go thru legal steps to resolve this issueOn that note being said, I would then include full restitution on the complete rebuild along with a refund on the transmission serviceThankyou, I am awaiting your response."
*** response:
"I have in my office a complete file documenting what services were provided to youWe have pictures of your transmission while openIt is also well documented that you were there to oversee the work done on your vehicleYou saw the level of fluid checked for the second time by the technician before you leftSomeone like yourself, with such a hands on approach and such a knowledge of vehicles would never let anyone short you even one quart of anything
You complained about the price of our work and hounded *** while you watched him perform his dutiesThree people are willing to document what happened and what you saw and didYou were charged for only quarts because they were being kindThe rest of the bill was already made out
We work a flat rate that we look up on a computer*** works very, very hard at keeping a great reputation at the shopWhile working on vehicles he does not have one complaintPlease do not contact anyone at All American Auto & Diesel, LLP again

WOW! What an imagination,***! Im having a difficult time believing that you wrote this completely fabricated story filled with so many blatant liesThe lie I like the most is when you said Im upset that a programmer, that generates 135+ hp, didn't fix my transmissionSERIOUSLY ? That's like, in my years specializing in electrical- mechanical engineering, a customer hires me to design and wire their businessThen they complain that the job I preformed did not fix the bathroom toiletI cant even address this complete fabricated story of lies and fiction that *** submitted as an responce to my complaint, That his uncertified helper/tech solely preformed a transmission service and failed to fill my transmission with the required amount of +transmission fluidUsing and charging me for 6qts instead of the minimum 1/required to service a 68ref 4xtransmission, while I had a conversation with *** as he was changing out a water pump on another vehicle***, when you fabricate a fictional story in such detail and you are completely dishonest as to what was discussed and what actually took place, you become extremely vulnerable for me to prove your being dishonest regarding your responce to my complaintI think the perception of you trying to portray me as a unreasonable, aggressive, argumentative person offends me the most, except for insulting my intelligenceMore so than the fictional story you fabricated to cover your(you know what)I pride myself on being a decent, honest, trustworthy and forgiving individualI am lucky to have parents that raised me on the principal of treating those as you would like them to treat youIm saddened that you must have not been as lucky as IHonesty doesn't necessarily have to be taught, It comes from having a conscious, and after reading your response to my complaint, It becomes quite apparent and easy to prove you don't have oneYou have been in business for about a year now and with those work ethics the chances of your business, in my opinion, becoming successful is slim to noneI read the other complaint, against you business, that was submitted to the Revdex.com and at first after reading your response to his complaint I thought this complaint is unreasonable, but NOW after reading your fictional response to my complaint, I have a complete different perspective as to who is actually at faultEverybody makes mistakes but when you cant admit when your wrong and be responsible for your error I would expect there will be more complaints to followEvery time you make a mistake and refuse to resolve the situation in a fair manner people will complainI wont argue against a fictitious story you created to defend yourselfIts pointless, although I will, if need be, prove that your story is full of liesI can only hope you come to your senses or develop a conscious and admit your error and be honest of the events that took placeI first met you when I came to your business for an alignment and you sold me on the idea of installing the eflive programmer because you had just installed one on a white ram 2500, just like mine, and the customer reported to you that he got 16mpg towing a fifth wheelREMEMBER? After talking to you the first time, I felt comfortable with you working on my truck. That was "YOU" working on my truck, not a unqualified or certified new hirebut you not being able to be responsible for you or your new employees error has disappointed me, but Im more disappointed in myself because im usually good at judging characterGood thing I recorded conversations that took place when I attempted to resolve the issue and the attempts in trying to meet with youFor you to attempt to turn the situation around and try to portray me as the dishonest one and you the victim is so wrong, its almost evilMay god forgive you! Im so tired of dealing with greedy people that will lie, cheat, steal and are unethical for self gain that it empowers me to not quit or just go away, but to expose you for who you really are and what lack of ethics you have in running ALL AMERICAN DIESEL-AUTO

This is all just rudrickI will see *** in courtsueing for $
The fact of the matter is if I would not of had the transmission serviced by All American diesel/auto LLC I would not of had any problems with my transmission pulling my travel trailer to SoCal as I have in the past aprox timesI plan on filing in small claims for full restitution on trans rebuild and the transmission service preformed at All AMERICAN DIESEL/AUTO LLC along with punitive damage for the lost usage of my vehicle fuel and time spent contacting and getting estimates, expert diagnosis, not to mention the fact I missed the birth of my 1st granddaughter and is unable to visit my ailing mother on mothers day due to this serviceThe facts I have and will submit in small claims with prove that All American diesel/auto LLC is liable for the transmission failure

Our position remains the same and we are willing to present our case in court

I know about this lady. I got a couple of emails from her.
She said she had "suddenly " become disappointed with the insoles which sounded like they were broken. She was quoting the one year warranty, but asking for a refund based on a year warranty. She purchased them about 6 months...

earlier.
I called her and asked a few questions.  It turns out they are flat and I offered to replace them of course. I explained that the 30 day refund was expired and she seemed ok with the replacement.

I am currently waiting on a parcel from her and her sister to replace not only her pair but an exchange for the sister. It seemed like everyone was happy.

To whom it may concern-
I am writing on behalf of All American Auto & Diesel LLP with regards to [redacted] filed complaint. I believe he has misrepresented his complaint and left out several other issues and details pertaining to the...

repair of his 1978 Corvette.
On [redacted] first visit to our business was May 27, 2015. This was for the repair of a broken exhaust header stud on the drivers side header and an intermittent stalling issue when coming to a stop. We first repaired the header leaks. The second complaint of stalling when the vehicle came to a stop was repaired with a new carburetor which we installed and adjusted. The carburetor was previously repaired at [redacted], also located in [redacted]. They had tried to replace the needles and seats in the carb. After their repair, the carburetor still had an issue with seats leaking when coming off throttle, and this caused the engine to flood out. By restricting the fuel to the carb the vehicle would start again. With the new carb installed and adjusted, [redacted] test drove his vehicle to [redacted] Lake (roughly 40 miles round trip). He returned and had no issues with the way his vehicle ran. He was actually quite happy with his vehicle remarking he drove it "over 100 mph up the grade to [redacted]". Both repairs were completed as part of his initial $868.14 repair.
[redacted] second time in our shop took place on June 12, 2015. He had a complaint of the engine cutting out and losing power under load. I performed diagnosis of the vehicle for the customer complaint. I found the fuel pump losing prime. I also found the right side engine mount bolt was too long; being pushed into the side of the fuel pump which had damaged the housing. [redacted] had mentioned having to get his money back from Pro Tech Automotive, also located in [redacted] for not fixing his vehicle properly. They had replaced all mounts and resealed the engine. We agreed to replace the fuel pump and replace the bolt in the right engine mount. This repair in total was $344.63. The Corvette ran great, that is until [redacted] drove his vehicle to [redacted] a few weeks after the repair.
[redacted] came in to see us a third time after he drove to [redacted] with the air conditioning on and traveling at 45 mph. He said "the engine was overheating and got to temps of 260 degrees." I offered to check out the overheating issue. It was a failed fan clutch causing it to get hot. At no time during his drive up the climb to [redacted] did he think to pull over and let the vehicle cool down, or even turn off the air conditioning. [redacted] demanded that this repair be done for free believing incorrectly that it had to do with the previous two repairs we had performed. Our shop refused to replace the fan clutch and reseal his oil leaks that were caused by the overheat condition for free. After we refused to perform this repair for free he became irate and threatened to report to the Revdex.com, and here we are.
In the time we have been open, [redacted] has been our only customer that we have had complain; be it to this level or on a minor scale. I have a feeling [redacted] has made this his routine, filing complaints with various shops in our community. Both repairs that All American Auto & Diesel LLP performed were agreed to by the customer and shop beforehand. We have the repair invoices which we would be happy to fax to you if needed. If you have any questions or concerns relating to this manner please feel free to contact me via the business phone number or email listed below.
Thank You
