I have reviewed the offer and/or response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
After discussing my complaint and sharing all of the evidence that I maintain with numerous lawyers, CBE has been advised of their acting in violation of landlord-tenant law -- specifically violating statutory requirements surrounding a move-out inspection (the conduct of the inspection, failure to provide documents for signature as required citing issues uncovered at the time of inspection, attempting to hold tenant liable for issues that existed -- and were documented in move-in inspection paperwork and with photographic evidence -- at the time of tenant's move-in or issues 'discovered' 2 weeks after tenant move-out and owner move-in, etc.). CBE has seemingly chosen to ignore the legal advisement and has made no effort to ensure that the tenant was treated fairly and in accordance with the law. CBE served as the property manager for the property -- it is understandable that their allegiance lies with the owner/landlord, but if, in execution of their duties, they allow laws to be violated and deposit money withheld in bad faith, that is inappropriate. Consumers (potential renters and landlords, alike) should be made aware that CBE will allow homeowners/landlords to make false claims against tenants and withhold deposit money they are not entitled to -- if this issue isn't resolved I will be taking additional steps towards ensuring all consumers in the area are at least aware of the way that CBE chooses to do business, while also taking necessary steps towards recovering the deposit money that was illegally withheld.

Review: CBE has acted unscrupulously and is looking to debit our security and pet deposits (which were provided in good faith) for:

1) 'damages' that were documented during the move-in inspection by the tenant as being the condition of the property at move-in;

2) services that were not performed prior to move-in but 'requirements' as set forth in the tenant handbook - a document that was not provided to the tenant until 2.5 years of the lease term had expired (NOTE: services that the company admitted, in writing, that the tenant should not be required to pay for because the tenant did not receive the home in a condition where the service had been performed prior to move-in);

3) remedy issues/discrepancies which were not identified to the tenant during the move-out inspection;

4) neglected to inform tenant (resulting in unnecessary, unreimbursed tenant expenses) of non-functioning - and not to code - equipment such as the pool pump/filter system and wood stove ventilation (which may have aggravated the tenant's severe allergies and severe asthma - known as C.O.P.D.); and

5) once it was determined that the pool would be unusable unless a significant amount of money was spent on repairing pumps/equipment that was either known to be faulty or was not inspected prior to allowing the tenant to occupy the home, the owner refused to repair the equipment, and CBE refused to reduce the tenant's rent (despite marketing the home as a home with a pool).

Pictures and correspondence with company substantiating all of the aforementioned claims is available and can be provided upon request.Desired Settlement: CBE reimburses tenant $6952.

+$500 pool cleaning (that would never have been attempted if the pool pump/filter was known to not be functional)

+$3600 ($100 for every month that the tenant paid rent for a property that was supposed to have a pool)

+$2800 (return of security and pet deposit)

+$102 chimney cleaning (CBE stated - in writing; retained by tenant - that tenant should never have been required to pay because chimney cleaning had not been performed prior to move in)

-$50 leaf removal
