Dates listed by the student in the complaint are not correct, and should be approximately 1 year earlier. Amounts listed by the student are also incorrect. The student was enrolled for five courses in the Spring, 2014. These courses were sequential in nature and students complete them...
one after another. She was awarded $10,250 ($10,141 after the loan origination fee) in federal unsubsidized Stafford loan and received two scholarships totaling $1,000. The student was billed $10,455 for her term (not the full year or full program), and after financial aid was applied, she received a refund of $686 on 4/21/14.
On April 24, the student took out an additional Graduate PLUS loan in the amount of $8,720 ($8,347 after the loan origination fee), which brought her financial aid award up to the budgeted cost of attendance of $19,970. The student received an additional refund of $8,347 on 4/28/14.
She successfully completed her first three courses, which again were sequential in nature. However, with her fourth course in the term (7/27/14-08/30/14), the student posted on July 28th and then became unresponsive to outreach attempts. The student was withdrawn by Student Services on 8/11/2014 due to inactivity. She was not due a refund for the course according to the tuition refund policy.
She was withdrawn from the university due to inactivity on 9/11/2014, and a full refund of $2,091 for the cost of the fifth course was refunded back to the student on 9/15/14. Per federal regulations, a Return to Title IV calculation was performed on the student’s account on 9/16/2014 where it was determined that the student earned 61.1% of her aid based upon her participation in the term. Therefore, no funds were required to be returned to the student’s lender. She was sent a notice of the completion of the Return to Title IV calculation along with a separate email notification for exit counseling on 9/16/14.
In summary, the student received $18,488 in federal loans (net), $1000 in institutional scholarships and $11,124 in refunds back to her. She completed 3 courses and began a 4th, which she was withdrawn from. The tuition for her 5th course was refunded back to her and is part of the $11,124 in refunds she received.
Her last class participation was July 2014. If she attempted to re-enroll more than a year from that date, she would be required to reapply for admissions under university policy.
