I have gotten three akitas from this breeder and the dogs are perfect in behavior which she breeds forThey are great companions and are show qualityNot to mention that the dogs have lived a very long timeOne lived to be one lived to be and the one I have now is already

To: [redacted], [redacted], and to all who may be concerned in this matter:My name is [redacted], owner of CR Akitas. I'm writing in response to the complaint filed by **. [redacted] on 02/07/14, It is with most importance that It be made known that the...

account given by **, [redacted] is both inaccurate and unjustified, and I was both surprised and concerned upon .reading it. Her account is a true misrepresentation of the business ethics I practice, and I feel like her claim has the magnitude to take away from the great name CR Akitas has, and has continued to have for over 21 years.On 12/8/12,[redacted] made arrangements to come to my home/ the business premises, In search of a companion puppy. It was during this initial meeting that **. [redacted] and I engaged In a written contract regarding a deposit on a future puppy. At that time, I had recently done a breeding with the a fore mentioned sire and dam, and I was most hopeful of the prospects and success of this breeding, as I had paid nearly $1,000,00 for an artificial insemination in hopes of a greater chance of the breeding taking. At this time she was more than satisfied with CR Akitas. I explained that a breeding cant be guaranteed,however, I guaranteed that I would be able to accommodate her with a puppy.I also explained that in order to guarantee her a puppy from the next litter, she would have to put up a non refundable $100,00 deposit. Because there are so many expenses that incur when doing a breeding (especially an A.I), the deposit is non refundable. At this time, I had never forgone such a long period of time with out any successful breeding after so many attempts.Because I dont have the authority to guarantee if a breeding takes, my contract states that upon receiving a deposit,the client will receive a puppy from the next litter. Obviously **.[redacted] was fine with these conditions, as in fact she signed the contract.As for her claim that when we spoke on the phone and I refused her a refund. It Is very important that it be made known that part' of the conversation never happened, as **. [redacted] never would have even asked for a refund, because (again) she was fully aware and signed a contractual agreement of the no refund ploicy discussed on 12/8/12.1 communicated with **. [redacted] about the unsuccessful breeding we expected in January 2013, and informed her of my attempts to make other breeding arrangements.In fact, she was aware of and updated of the lack of progression. I did 3 more breedings, after the one I did in December 2012. If she would like Id dispute that further, I am prepared to show any one from the Revdex.com and documentation and receipts showing my efforts to breed three more time. Despite **. [redacted]'s attempts to slander my business and bully me into giving her $100.00 back, the agreement we signed still stands; Not only will she receive a puppy (upon the remaining cost of the puppy) from the very next litter at CR Akitas, but she will not be receiving her deposit back.My deposit policy and contract was made In to effect years ago, In hopes to avoid any unforeseeable situation such as this. [redacted] Is the only customer that has ever placed a claim against me and Is the only one dissatisfied with this practice. However, despite this matter, I will still a hold a puppy for her from my next litter, if the details meet her specifications, and she so chooses to continue our business relationship.. I hope to provide another puppy of yet great quality and standards to another home and family. states in relevant part that I was to receive a puppy from the litter of a designed

I did not agree to wait longer than one year or whenever **.

In addition, I did not agree to apply the deposit to
whatever litter CR Akitas finally produced no matter how many years and months
later she achieved a litter.
It is now March of 2014, the deposit should be returned if
she read her contract and acted reputably.

Review: I drove to [redacted], Maryland (2 hours) and visited with CR Akitas and [redacted]. [redacted] on 12/8/12. At that time, she stated that she was expecting a litter of puppies out of - Sire: [redacted]’s [redacted] and Dam: [redacted]. I expressed my concern about the deposit being non-refundable and she stated that there had never been a time she was unable to provide a puppy to a consumer within the one year period and should that be the case she would certainly refund my deposit. With that assurance, I placed a deposit in the amount $100.00 on a puppy from a litter which she stated was expected to born in January 2013.

In January 2013 [redacted]. [redacted] stated that the breeding did not take and that she had several other breedings coming up and that I would be able to choose a puppy out of one of those litters in early spring 2013. I continued to keep in touch with [redacted]. [redacted] to monitor the future breedings and the selection of my puppy. On occasions she would respond that she was hopeful that one of the breedings would take and to please be patient with her.

I diligently tried to remain in touch with [redacted]. [redacted] and occasionally she would respond with an update that she still did not have any puppies. In late 2013 I contacted [redacted]. [redacted] again and inquired about puppies and she stated that she never had any litters in 2013 or since the date of my deposit. At that time, I requested that she return my puppy deposit ($100.00) since she never had any litters to offer me which she refused.

To date, [redacted]. [redacted] has stopped communicating with me and refused to return my puppy deposit. [redacted]. [redacted] is in breach of the contract for not providing any puppies to a buyer and simply keeping a deposit with no puppy to purchase or breeding to have occurred.

I know that you can’t simply take a puppy deposit from a consumer and never have any puppies to offer in exchange and simply keep the deposit.

I would ask that you place this on record and take whatever action you can to make sure this does not happen to another consumer. I truly wonder how many other consumers she has done this to and got away with it.Desired Settlement: Return my $100.00 puppy deposit.
