Review: On December 15, 2013 our daughter, [redacted], purchased a new [redacted] from Darcars Imports Inc., [redacted], MD [redacted]. She completed the purchase with the Financial Service Manager, [redacted]. We had loaned [redacted] $10,000 for the down payment. We made a mistake, and wrote the check on the wrong account. On December 17, our bank notified us that the check was being returned marked Non Sufficient Funds (NSF). On December 18, my wife, [redacted], contacted Darcars asking to speak to [redacted], and was told he would not be in the office until noon. [redacted] called back after noon, and explained the situation to [redacted], explaining that we had transferred the $10,000 to the account and requested that they resubmit the check. [redacted] told [redacted] not to worry, he hadn't heard from accounting, and they'd contact us when the check was returned to them.

On December 23, [redacted], who purchased the car, received a call from Darcars stating that they must have a cashiers check to replace our NSF check, and that they would not resubmit our original check. Darcars demanded of [redacted] that they must have it that same day stating that vague unspecified action would be taken if they did not get a cashier's check today. [redacted] delivered a cashier's check later that day, but forgot to retrieve our original NSF check. When she returned to Darcars within an hour she spoke with [redacted]'s supervisor ([redacted]?). Darcars refused to return our original NSF check stating that they kept it on file for reference per company policy. **. [redacted](?) then called the controller who reiterated, via speakerphone, their refusal to return our original check even though we have given them a cashiers check as a replacement.

We consulted with our bank, and were told that the original check is still a negotiable instrument, and that Darcars should have returned the check to us immediately upon receipt of the replacement.Desired Settlement: We want the original check back. Darcars can mail it to us at the address printed on the check, they can mail it to my daughter, [redacted], who purchased the car, or we'll pick it up in person. It can be marked void if they wish, but we want the original check back. Telling us that a negotiable check is being held "for reference" or that the check has been destroyed is not an acceptable alternative.
