In response to the Association's disclaimer, the Association cannot disclaim the statements made in this case, as the attached fax confirmations clearly prove that faxed notifications were sent to the Association's agent, which then forwarded the information to the AssociationEvidence from the Association's agent that the Association was in receipt of the faxes can be forwarded upon request
There were additionally more than a dozen emails regarding the mold issue sent to the Association's agent prior to, during, and after the faxes were sentEvidence of these emails and evidence from the Association's agent that the Association was in receipt of the emails can be forwarded upon request
In addition, a building inspection company (Oakbrook Home Services) which was hired by the Association reported to the Association in September that there was mold growth in the building, so the Association cannot deny and disclaim any knowledge of the mold growth in this regard
With respect to claims against an Association being submitted through the Revdex.com, Associations don't have to be a member of the Revdex.com in order to be subject to a complaint through the Revdex.comWith respect to private organizations with a limited set of members, those organizations are beholden to people that they are supposed to represent, and to this extent a private organization is not exempt from a complaint being filed against it through the Revdex.com
Since considerable financial cost will be incurred by the homeowners due to the Association continued failure to remediate the mold issue in the common area of the building, and since the Association has now admitted to the Revdex.com that they will continue to ignore the mold issue, mediation of this case through the Revdex.com is now being requested
