DGW is defrauding the public, false contract, gleaned valuables from my father's estate and did not pay me for them.
1. Contract is not valid. The item descriptions of the decedent's belongings were not disclosed at the time the contract was sign in the morning but instead provided as an addendum to the contract in the afternoon filled out as the items were removed from the decedent's home.
2. DGW did not adhere to the lot numbers as assigned on our contract.
3. DGW broke the lots into smaller lot sized and did not pay the estate for many of the items they took.
4. DGW paid me for items that were not mine.
5. DGW paid me for items that were not itemized on the inventory but belonged to the estate proving they took items without adding them into inventory.
6. DGW fraudulently posed live on-line auctions every two weeks, but when two live auction companies DGW uses were contacted for records, the (liveauction.com, The saleroom.com) both disclosed DGW had only used their services twice in 2011, the year DGW claimed they sold the decedent's belongings.
7. DGW has failed to provide any photos or documentation to support the decedents belongings were even put on auction; DGW claim all records/photos were destroyed before providing me checks and settlement sheets.
8. The settlement sheets are full of errors and so not account for missing items.
9. High valued items like depression glass were not advertised by pattern name, but under general descriptors like "yellow glass" and sold for a small fraction of their value.
10. DGW bidding sheets show a sale date, lot number and describe an item that does not belong to the decedent. Then settlement sheet show same date and lot number with a description of one of the decedent's belongings, they do not match.
11. DGW gleaned items from the decedent's lots and sold them under separate cover for 100% profit, called shilling, a common practice with auctioneers.
12. The executor of the estate is accountable to the other heir and the probate court in the whereabouts of the missing items. DGW is refusing to account for the items they took, thus keeping the estate open until this is resolved. This matter has been ongoing for a year at a great cost to the estate.
