Initial Business Response /* (1000, 15, 2015/07/22) */
We installed a snap together vinyl fence that she picked out, and other landscaping material, in the summer of 2014. On April 11, 2015, [redacted] contacted me via text message to state that her fence was coming apart and asked that I come to look...

at it and fix it. I sent my landscape foreman to look at the fence and figure out a solution to keep it together. He snapped the fence back together and applied a clear epoxy glue to help keep the fence together. She also stated that posts are not level, which some of them have settled over the winter. Over several text messages (which I have copies of) I wanted to meet with [redacted] to discuss a plan of action to fix her fence that would satisfy both parties. The top of the fence poles are not level because the elevation of her land is quite steep and we installed the fence to keep the bottom as close to the ground as possible as she specifically instructed us to do. If we were to install the fence with the top being completely level, she would have roughly a 1 foot 4 inch gap at the bottom of the fence to the ground. I tried a couple of times to contact [redacted] by phone and she did not answer, I left a voice mail each time explaining that I would like to meet in person at her residence to discuss the issue with the fence and what we could do to help her. I at no time said I will "NOT" fix her fence. What I did state to her was that before I proceeded to tear out her fence that I needed to meet with her in person before any work is to done on her property. She replied by text message after the phones calls that she did not want to meet in person and she wanted her fence fixed. She refused to meet with me which I feel is vital to ensure there is no misunderstanding between either of us regard what is expected and what the end result would be. I feel proper and thorough communication cannot be established through text messaging. I simply wanted to actually speak with [redacted] before fixing the fence, which I feel in no way unreasonable.
Initial Consumer Rebuttal /* (3000, 17, 2015/07/27) */
(The consumer indicated he/she DID NOT accept the response from the business.)
the poles move, they sit sideways- I understand the slope- but they sit sideways opposite of the slope- I would never use this company ever again. His former employees have offered to fix it for free, stating that they knew it wasn't satisfactory in the first place but that they did as they were told. Like I said, now that these former employees work on their own, they are doing the right thing and volunteering THEIR TIME AND LABOR to FIX what BRIAN didn't do right the first time.
Final Business Response /* (4000, 19, 2015/08/05) */
Once again, I have NEVER stated that I would not fix Ms. [redacted]'s fence. I simply needed to meet with her and discuss everything with her before tearing the fence/property apart, if needed. This is a completely standard practice for me and I feel it is necessary to prevent any misunderstanding which too often occurs when communicating is done only through text messages.
Once she met with me face to face, I could proceed with fixing it, if needed. I feel this was in no way an unreasonable request; nor would it have been unduly arduous for her to comply.
If my previous employees want to fix the fence/alleged problems for free, they certainly can. Although, since they are the ones who installed it I am not completely sure why she would want them to. As previously noted, they are PREVIOUS employees. I am saddened that lies are obviously being purported by either Ms. [redacted] or my previous employees, as evidenced by Ms. [redacted]'s previous reply; some statements made therein were completely false. These previous employees were the ones who actually installed the fence. They mostly worked unsupervised by me, which is common practice when you have a landscape foreman to do work site supervision (one of these previous employees was the foreman). I at no time forced them to install the fence a certain way.We discussed/planned the installation of the fence collaboratively. If they stated otherwise, they are being deceitful. Unfortunately, due to my experience with them, I am not completely surprised by this; disappointed, yes, but not surprised. If they did in fact say the things that Ms. [redacted] claims they did, I feel it must be in a disreputable attempt to obtain business for themselves.
I am still perplexed as to why all of these instances of libel have occurred by Ms. [redacted] when this whole issue could have been taken care of already had she simply agreed to meet with me. How was that request unreasonable?
I hold a degree in landscaping (There are two landscapers in Pipestone that have formal training/holds a degree) and my company has been in business for eight years with numerous satisfied customers. It is truly my desire that all customers are completely satisfied with the work that my business does for them; unfortunately, in speaking with other multiple business owners, it seems apparent that there are certain customers that refuse to be assuaged.
