Review: I signed up with Downtown fitness with a first and last monthly payment along with an annual processing sign up fee. I signed a contract for a year membership with a $100 cancellation fee if cancelled prior to the year. I went into the place of business to cancel my membership on May 21st and spoke with Andrew. He gave me paperwork to sign, I paid the $100 cancellation fee and he assured me that I would no longer receive any monthly fee's. On May 28th I received another automatic billing charge on my bank account for the $29.99 monthly membership as well as a $33 NSF from my bank as there wasn't enough funds to cover the cost of the membership. I paid the first and last month as well as a cancellation fee. I should not be charged with an additional month as well. My last month should be paid for already as it was included in the sign up fee. I called several times to speak with the owner as he is the only person who can refund any account. He was unavailable and his employees couldn't say when he would be available. None of the employees seemed to be interested in helping me and none of them understood the cancellation policy. Everyone had a different idea of what the policy was. I was finally able to get ahold of the owner by coming in to the place of business. He was very rude, and wasn't helpful at all.Desired Settlement: I would like a refund for the final payment taken on May 28th of $29.99 as my membership was cancelled on May 21st. Along with my NSF fee of $33.

In response to our disgruntled consumer, I would like to validate that the customer's complaint is not entirely false. However, each of our customers are held to the same standard 30 day cancellation policy with no exception.

This particular customer had an outstanding balance of $29.99 based on our 30 day cancellation clause and had submitted her cancellation request along with payment for the fee in which she knew she had to pay for canceling her membership before fulfilling the agreement that she willingly signed.

All of the cancellation policies are stated in black and white on our membership agreement and it is our job to uphold our end of the agreement and we expect that the customer do the same.

Our customers are given a copy of their membership agreement to be able to review the policies at a later date. Our agreement allows are members a 5 day grace period to cancel with no charge in the event we have falsified any information about our facility or if the customer is dissatisfied with any of our written policies.

We are honoring the contract and we will continue to hold our staff, and our customers, accountable to all of the policies that have been outlined on our agreement.

The member paid for her last month up front which is still being honored by our company by allowing the customer to have access to the club for an additional month past her final payment.

We will continue to institute the rigid policies we have established to hold all parties accountable to the agreement they signed. Also, we take pride in our long proven track record for implementing and upholding proper business practices and fair, ethical treatment to all parties who have signed on our membership agreement and subsequently have access to utilize our services.

Review: This company has continued to charge my credit card even after I cancelled. They claimed they have no record of my cancellation. Other customers have experienced the same treatment. The gym itself is unkept and full of dust. They continue to try and charge my credit card, and harass me with phone calls and emails.Desired Settlement: They claim I have an outstanding balance of $280. I want them to adjust my balance to zero, and stop contacting me.
