I am rejecting this response because:Ducky's Boats agreed to deliver boat on or around June 15th, 2014.  Said down payment was never said or implied to have been non-refundable.  Mike (sales rep at Ducky's Boats) even went so far as to tell me almost everything was in stock and wouldn't take long to put on.  Ducky's Boats provided ZERO communication on when the boat would be delivered, other than to promise no less than 12 return phone calls, which they did not manage to make a single one.None of these items are considered one-off items, in fact Ducky's has a reputation for building boats similar to this one, as evidenced by their website and You Tube page.  From their reply, they state the jack plate wasn't even shipped until the 26th, how could they have possibly delivered it by the 15th??I would like a full refund of my deposit in the amount of $3,000.00 due to the complete lack of communication, the inability to complete the boat by the agreed upon date, and the fact that I was never told it was non-refundable.

I am rejecting this response because:  As you can see from the sales document I attached, filled out by Tom C[redacted] Ducky's Boats Inc, that we were purchasing a "new boat' and "new trailer".  The boat description has 2015, however, the trailer's description doesn't, it just has the VIN#.  You can also see that the price of the boat is $33,500.00 and the price of the trailer is $3,200.00.  When we were looking at the boat, I asked Tom if the trailer it was sitting on came with the boat he said no (not a package).  In the office we told him that we would like to purchase a "new" trailer in addition to the boat.  I really don't care what the paperwork Ducky's provided says about "package",  if this were a package deal we would have paid one price for both not have separate prices for the boat and trailer.  I noticed that the original sales receipt that Ducky's provided the Revdex.com is mysteriously missing everything but our names and our signatures.  When we contacted Ducky's about returning the trailer because of the issues with the lights and that we were concerned that since the trailer was a 2013, it would not be under warranty, the owner of Ducky's, rudely, told us that the warranty started the day that we purchased the trailer.  Since then we have had an issue with grease leaking out of the axle hub (see attached pictures).  One of the rubber hub caps fell off on the way to the beach this past weekend and all of the grease leaked out.  I spoke to [redacted] in the [redacted] warranty department and he informed me that issues with lights and axle grease leakage is not normal for a "new" trailer.  He also informed me that, contrary to what Ducky's told me, the warranty started the day Ducky's purchased the trailer, sometime in 2012 or 2013, and that the warranty has expired.  I am forwarding all of the information to [redacted] and he is going to pass it to the [redacted] sales rep who deals with Ducky's.  They are concerned about Ducky's business practices.   I really should have said something when I noticed that the trailer title had 2013 on it, but this being our first boat and trailer purchase, we wrongly assumed that Ducky's was a honest business.  Another red flag should have been the invoices that have ALL SALES FINAL stamped on them.  What reputable business sells new vehicles all sales final.  We feel that we have been victums of a bait and switch.  We were under the impression we were buying a new trailer and they had a trailer that was out of warranty that they needed to get rid of.   This complaint definately is not resolved.

Review: Ducky's Boats and I agreed upon terms of a boat, motor, and trailer purchase in May of 2014. I was approved for a loan through a lender with Ducky's. A check was sent overnight to Ducky's Boats in the amount of $3,000 for a down payment on my loan. Ducky's was to perform several modifications to said boat and deliver on or before June 15th, 2014. I was leaving on vacation on June 22nd, and was promised I would have the boat to enjoy before then.

The time came and passed, and I was told that the boat wasn't ready but would be next week (on three separate occasions). When I told them I was out of town, they responded that that would be great, they could take their time and finish the boat before I got back and deliver it to me.

It is now July 11th, 2014 and I have yet to see the completed product that I signed and sent a down payment on. 4 pictures have been sent to me, and they show everything except the correct trailer.

I have spoken with several dealers, all say that an in-stock boat with that level of modifications should be completed and delivered in less than a week. Total time billed for the modifications would be under 12 hours. All of the parts could be sent [redacted] or [redacted], resulting in delivery in less than 5 days at their most inexpensive shipping option.

I have yet to have one single inbound phone call from Ducky's Boats after they deposited my check, that would be approximately June 12th, 2014. Every attempt to contact them has resulted in a promise to have my call returned, only to hear nothing.

The bank approval has expired, due to the amount of time it took them to install said accessories and complete said modifications. The bank is unable to re-approve my loan, therefore I can not purchase the boat.

Ducky's is refusing to refund my $3,000 down payment, stating that since they did the work to the boat they won't give it back. I was never NEVER told it was non-refundable, or I would have never purchased a boat 3,000 miles away.Desired Settlement: Refund my $3,000 to my address you have on file. I will accept a refund no later than July 18, 2014.

Review: I purchased a pontoon. I wanted a different fishfinder/GPS device installed on boat. [redacted]. showed us an Lowrance elite 5 gold series model. He said this one is easier to read due to the size of the screen, especially when in the split screen mode. Also it has features built-in that have a map with depth charts in the area where we would be using our boat.([redacted]) We agreed to a price of $764 for the unit and installation.

Duckys installed a Lowrance mp4 fish/GPS. This is a much smaller unit and it was discontinued in 2011. We purchased our boat in March 2013.

We have contacted [redacted]. He says he will replace the unit when he can. I asked for a letter or email confirming a date. He will not commit to a date.Desired Settlement: I would like a refund in the amount of $764.

I am rejecting this response because:

At the time of purchase [redacted] showed me and my wife the actual fish finder that was to be installed into the boat referenced in the original complaint. Once we discovered that we did not receive the correct product, we contacted [redacted] and he indicated initially that he could not fit the finder into the space provided. After we called the manufacturer and discovered this was not true, we contacted [redacted] again. This time [redacted] indicated that he put the wrong fish finder in by mistake. Now his story is that we never agreed specifically. We have made several phone calls to the boat manufacturer and Lawrence, the fish finder manufacturer, and discovered that the one installed has been discontinued since 2011. It clearly does not make sense that we would pay $764 for a product that is no longer in existence. This is fraud and we are unwilling to take the responsibility of removing the current fish finder and mailing it back so that we can get a refund, unless [redacted] is also prepared to cover that cost of removal and reinstallation, which would have to be agreed to in writing.
