[redacted] has complained that we are not following the rules of CAN-SPAM as outlined by the FTC. He claims that we "refuse to take him off our email list." And has made three specific claims of wrong-doing toward our business. His first complaint: 1. Purposefully disguise the source of the mail by...

not labeling it "Pure Incubation." Intead, they label it Smart Tech Resource, White Paper Wizard, Enterprise Guide, etc. He is correct - we do send email from brands other than Pure Incubation. The ones that he cites in his complaint are in fact our brands. Pure Incubation is a holding company - we operated a number of subsidiaries under Pure Incubation, and we also have a number of d.b.a.s under Pure Incubation. Each of these brands that he lists is a dba of Pure Incubation. Those each correlate to a specific website that we own/operate at the subsidiary level. So - for example - Enterprise Guide ties to www.enterpriseguide.com - and we have a dba for Enterprise Guide. We are not purposely disguising the Pure Incubation company affiliation - to disclose that information to people who have subscribed to Enterprise Guide and affiliate with that brand would make no sense. We are not in violation of any law with this. His second complaint 2. Physical location address in their emails does not identify Pure Incubation. He is correct for the reasons listed about. The CAN-SPAM law, incidentally, requires the following "Tell recipients where you’re located. Your message must include your valid physical postal address. This can be your current street address, a post office box you’ve registered with the U.S. Postal Service, or a private mailbox you’ve registered with a commercial mail receiving agency established under Postal Service regulations." --- This is all disclosed in every email that we send. And his third complaint: 3 - we do not honor opt-out requests promptly. We include an unsubscribe option on every email that we send - and all unsubscribes are managed and processed immediately. Sometimes there is an individual who wants to unsubscribe who contacts us in a different way - via our online contact us form, by replying to an email they receive, etc. In those cases, the unsubscribe process is manual and does take up to three business days to process. If for some reason this individual attempted to unsubscribe and it did not work - that was not intentional. Our records show that [redacted] was successfully unsubscribed on 4/17/2017.
