In response: 1. The Department of Social Services mailed a copy of the Notice of Decision dated September 1, 2015 to [redacted] directly. (I have requested a copy of this document from DSS) It is not ElderNets practice to send a copy simply because we are sent the copy from DSS. The client gets the original. And so their application was approved effective August 1, 2015. In the meantime, 2. The NYSARC Trust was established in a timely fashion. From the time all required documents are sent to NYSARC until there is trust approval can takes little time. Once we had approval of the submitted signature on the document the trust would have been established. I have contacted NYSARC and found out that [redacted] called NYSARC on two occasions including March 10th, canceled the pooled trust application and requested the $300 be returned to her. This is the only reason this trust was never approved. It was canceled by the client's daughter.3. Reading all notes on the file will show that due diligence was maintained by ElderNet throughout this entire process. The Notice of Decision for [redacted] clearly states that his income is over the allowable Medicaid income limit in the amount of $1,254.36. These monies had to either be turned over to the Department of Social Services each month or go into the pooled trust where the client has use of the funds in order for Medicaid services to be available to Mr. [redacted].I do not know why Ms. [redacted] decided to cancel the pooled trust, nor do I know why she chooses to claim that NYSARC took it upon itself to cancel the trust because that is simply not true. NYSARC has record of Ms. [redacted]'s request to cancel and her request for reimbursement on file. Ms. [redacted] contracted with ElderNet to get Medicaid approved for her Father. We did that. She also contracted us to have a NYSARC trust set up for him and we were in the process of doing that also, until she, herself, canceled the application. Honestly, I do not know what more we could have done.I truly do not know what else to say. There are some cases that take a year to come to fruition, through no fault of ElderNet. I apologize to Ms. [redacted] for her continued dissatisfaction with the process, but like all Government Agencies, these things take time.
