The process of year warranty site visits are to document the items the home owner has noticed that may require repairs. The items are documented and not necessarily considered deficiencies. When it became clear the homeowner was not satisfied and the builder was only able to resolve
some of the items as per the industry standards, the builder recommended the home owner go through the *** *** *** *** Claim process. A claim was filed with *** *** *** *** (***) to review the items referred to in this complaint. The *** assessor reviewed the items on March 29, The following is the result of each within this complaint: Countertops flecks: the issue is considered to be a property of the product and not a specific defect in material or Labour. The counter top supplier also reviewed the flecks and they as well determined this is typical of quartz countertops and met their standards As per *** no action requiredSink cut out: although the sink was changed during construction, the countertop cut out for the new sink was very similar in size and shape to the previous sink installation, therefore the replacement sink was installed in the original counter top No further action required as per *** report. Windows: the homeowner contacted the builder months after possession claiming windows were scratched in the home. The supplier was contacted to review the windows some windows with minor defects were replaced. No further action required as per ***Nook light position: Positioning of lighting outlets in ceilings is sometimes affected by the location of structural framing members and mechanical installations such as heating ducts. In this instance the light is located within a few inches of the location indicated on the plan. The homeowners were made aware of this, they had opportunity to review the light location prior to installation of drywall and on subsequent accepted it as correct at that time. *** also reviewed this item and determined that no further action is required

With regards to the windows; we have email correspondence from Erickson Homes throughout the building process which speaks to the wrong windows being installed in the bonus room during the construction of our home. In many emails and phone conversations we were promised and assured that the correct windows would be installed prior to our possession date. However possession date came, the windows were never changed, and we were then told that if we wanted the correct windows installed we would have to waive warranty coverage on them. Then during our year warranty site visit Erickson Homes reviewed the other damaged windows throughout the home. We had brought the damaged windows to the attention of Erickson Homes in March/(within weeks of possession, not months after possession as Erickson Homes claims); and were instructed to submit a claim through *** and to wait for the year warranty site visit to address further *** *** *** ** *** *** * *** *** ** *** *** *** *** ** *** *** *** ** *** *** *** *** ** ** *** *** ***). While looking at the flex room window at the year visit Erickson Homes stated that they noticed that window was scratched during the building process ** ** *** *** *** *** *** ** ** *** *** *** *** *** *** *** *** *** *** *** *** *** ** *** *** *** *** *** *** *** *** ** *** ** *** *** ** *** *** *** ** *** ** *** *** ** *** *** *** *** *** *** *** *** *** *** *** *** *** ** *** *** *** *** ** *** *** *** ** *** *** *** ** *** *** *** *** *** *** *** *** ** *** *** ** *** *** *** *** *** *** *** *** *** *** *** *** *** ** ** *** *** *** *** *** ** *** *** *** * *** *** *** *** ** *** *** ** *** *** ** *** *** *** *** *** ** *** * *** *** ** *** *** *** ** *** * *** *** ***. In emails dated January 16/I arranged to be home from work on January 30/as some of the defective windows were being replaced. Email from Erickson Homes stated that trades would be scheduled for this day. No trades arrived at our home on January 30/17; requiring that further time off to be arranged from work as the work to be spread out over multiple days Although we acknowledge that Erickson Homes were flexible with us with regards to considering our work schedules, they once again told us that trades were being scheduled when they were not. I placed calls to multiple trades on Jan30/who all said that they had nothing scheduled at our home that day ** *** ** *** *** * *** *** *** *** *** ** *** ** *** *** *** *** *** *** *** ** ** *** ** ** *** *** *** ** *** *** ** *** *** ** ** *** *** *** *** *** A claim was made under the *** *** *** *** *** (***) program. In the response Erickson Homes made to Revdex.com they did not include all the information regarding the outcome of this claim. I will provide further details from the claim here Countertop flecks: The *** assessment stated: “The chips noted on the edges of the pantry and kitchen island quartz countertops are due to damageThe circumstances surrounding this damage cannot be positively determined; therefore, the Homeowner’s concern is not a warrantable defect as per the New Home Buyer Protection Act.” The *** claim found the rust chips to be considered damage. No action is required because the cause of the damage cannot be determined; not because the rust is normally found in the product as Erickson Homes claims. The *** assessment recognized that the rust is damage and not typical of the quartz. Emails with Erickson Homes in January/state that they had conversations with the countertop supplier who agreed to come and do a onetime repair on the rust spots. The supplier came to our home in July/and fixed chip on the edge of the countertop. *** *** *** *** ** *** *** *** *** *** *** *** *** *** *** *** *** ** ** *** *** *** *** ** *** *** *** *** ** *** *** ** *** *** *** *** *** *** *** *** *** *** ** *** *** *** * *** *** *** ** *** *** *** *** *** *** *** *** *** *** *** *** *** * *** *** *** *** *** ** ** *** In discussions with the manager they stated “the original work order…was for chip fill which was completed”, *** *** *** *** *** *** ** *** ** *** *** *** ** *** *** *** *** *** * *** *** ** *** *** *** *** * *** *** *** *** *** ** *** *** *** *** *** *** *** *** ** *** ** * *** *** *** *** *** *** *** *** ** *** *** ** ** *** *** *** *** *** *** *** *** *** ** *** *** *** ** *** *** *** ** ** *** *** ** *** *** *** ** *** *** *** *** *** *** *** ** *** *** *** *** *** *** *** *** ** *** *** ** *** *** *** *** *** *** ** *** *** *** *** ** ** *** *** *** *** *** *** *** *** ** *** Sink cut out: The *** assessment stated: “This item is a contractual issue between the Homeowner and BuilderIt is not a defect in material or labour and; therefore, is not warrantable under the New Home Buyer Protection Act.” We are seeking the support of Revdex.com to help us resolve this contract dispute. We want the countertop to be cut to fit the sink that we paid for, instead of fitting the sink that was accidently installed. An oversight on the part of Erickson Homes who installed the wrong sink during construction and refused to ensure that the install was completed correctly with the proper sink Nook Light Position: The *** assessment stated: “This item is a contractual issue between the Homeowner and BuilderIt is not a defect in material or labour and; therefore, is not warrantable under the New Home Buyer Protection Act.” We are seeking the support of Revdex.com to help us resolve this contact dispute.
