Review: Company is in breach of contract.I purchased a car from them on March 19, 2013(BMW- [redacted]) 1. They never paid my trade-in off, now I have two auto loans. I have proof from [redacted]. Instead of paying car off (approx. $8,000.) they paid $1,000. and I am still being charged as well.2. They never validated the warranty (I have proof email from [redacted])3. They never provided me with owners manual as promised. 4. They initially tried to sell me a car with financing at 21% - I have proof.5. When I took car back to void sale after 2 days, they refused to honor my request. 6. They were disingenuous about car's mechanical problems.7. I have received 6 tickets from my trade in all dated after date of sale.Desired Settlement: They must return my trade-in,[redacted], to me in same pristene condition. ANDThey must work with [redacted] Dealer Services to accept BMW back, erase the purchase & debt. If this is not possible, they must buy the BMW from me at current financed cost by [redacted] Dealer Services by May 10. ANDThey must refund my total down payment of approximately $3,800 dollars by May 10. ANDThey must pay all tickets and write notarized letter assuming responsibility to the California DMV.

Hello,
Below you will find the details regarding the above
complaint.
On 3/17/13 the customer purchased her vehicle and signed a contract and declined an option to
purchase a contract cancellation agreement (page 7/7 of Retail Contract) which
would allow her to cancel her contract within 48 hours nor did she wish to have
the vehicle pre inspected (page 2/3 Buyers Order) " Vehicle Inspection. You
are purchasing the Vehicle based upon
your personal inspection, and are not relying upon any opinion,statement,
promise or representation of the salesperson, or any
other of our employees that is not contained in the written agreements you are
signing today." She stated that she did not have funds to purchase an
extended warranty and as courtesy, our company provided her with a
complimentary 12month/12000 mile warranty. The warranty was activated
instantly and has been paid for. That warranty has a value of $2195.00.
On 3/19/13 I, the finance manager made contact to give her
great news that I was able to obtain financing with a new lender which would
lower her payment and she was very excited. She came in and signed a new
contract and an agreement for the new terms which would void the old contract.
As part of her purchase, she traded in her vehicle and was advised that her
vehicle would not be paid off until her new loan is finalized (SEE PAYOFF
SECTION ON CONTRACT). In order to protect her credit, our company mailed a
large payment to her previous lender toward her payoff until the new loan was
finalized. Her previous loan has been paid off completely with no additional
charge to her or negative effect. Per CA Vehicle Code, it is the responsibility
of the SELLER to file a release of liability when they sale their
vehicle, however, as courtesy to her once more, European Motors Car Co. filed
that on her behalf on 3/27/13. We cannot accept responsibility for documents
that she receives from DMV or any other agency (citations) as all proper
documents have been processed on our end. She has proof that she no longer owns
the vehicle and can forward her concerns regarding the citation with the
appropriate agency (FILE RELEASE OF LIABILITY ON THE CITATION). Her trade
in has cost our company $2100 in repairs. We have not asked her to pay those
fees although she signed an agreement stating that the vehicle was in good
mechanical condition (page 2/3 Buyers Order)
A couple of weeks after the purchase, Ms. [redacted] made
complaints that her new vehicle was having mechanical issues and she was
concerned. Once again as courtesy to her and under no obligation, our company
paid $198.00 to BMW to have her vehicle inspected. Her vehicle passed the
inspection and a copy was provided to her.
We feel that Ms. [redacted] is not happy with her choice of
vehicle, which is in perfect mechanical condition per BMW and is making false
claims. European Motors Car Co. has gone above and beyond what is required to
satisfy Ms. [redacted] but at this point none of her complains are accurate and
we cannot honor the request to cancel her loan as she has signed a contract and
is under obligation. We wish her the best and will be here to assist her if
needed.
