The customer was at breach of contract. She would not let me come back out to the house and finish the job. The drywall that was started was completed except for some parts that were still wet, that I could not sand down. I was going to come back and finish but she wouldn't let me. She had...
changed her mind about the second part of the job after signing the contract also. I was always in contact with her, even after I received the check. I had spoke with her husband on the phone twice and was in contact with her on messenger/text about what she wanted to do with the bathroom. She couldn't make her mind up about the bathroom from what she had already agreed to and signed for on the contract. Then tried to talk down on the price, drywall job was $500.00 and the bathroom job was $1600.00. She gave me a down payment of $1100.00. When I started the job Wednesday night I tore pieces of drywall out, had to fix 2x4's, patch a hole in the wall, replace missing drywall then had to mud and sand it down. I spoke with her husband that night in person but she walked away from me. I told him I would be back the next day to finish sanding it down and he agreed. We even talked about her not being able to make up her mind about tile or surround in the bathtub, he said he would let me know. The next night I came out to sand, when I got there part of the mud on the walls was still wet and I could see my finger marks where I was checking it. That night I had medical issues so had to leave, the next morning my fiancé contacted them and let them know what happened. Communication was kept with them and was told that he would come finish the job because he had until Wednesday. Their response was leaving a negative/slander message on his work page, and threated to contact a lawyer before contacting about status of job. I had spoke with her a few times after that so saying there was no communication is not true. Therefore she is breach of contract because she refuses to let me finish the job.
