At this time, I have been contacted directly by Irizarry Contracting regarding complaint ID [redacted] , however my complaint has NOT been resolved because: We have made arrangements with Raymond I [redacted] to refund us a portion of the debt he owed to us, rather than proceeding with legal... litigation. At this time, he has signed a re-payment contract which has him making monthly payments to us to recover some of the loses. Even though we have recovered some of the debt, we still want our complaint made public to warn other potential customers of his unethical practices as a contractor. To Whom It May Concern: My name is *** *** and I am an attorney representing Fryeburg Family Medicine with respect to the above-numbered complaint to the Revdex.com (“Revdex.com”). I understand from recent communications that the Revdex.com has closed this Complaint as “No Response,”
meaning that the entity failed to timely respond, which could result in an F rating with the Revdex.com. Please note that Fryeburg Family Medicine takes its reputation very seriously, is saddened by the allegations in the Complaint, and had no intention of not responding to the Revdex.com. Although Fryeburg Family Medicine timely referred this matter to the Quality Assurance and Risk Department of its parent entity, *** *** ***, as a result of recent turnover in that Department, there was a delay in relaying the Complaint to counsel. Thereafter, the matter was referred to counsel, resulting in further delay while counsel investigated the matter and considered (1) whether the Health Information Portability and Accountability Act (“HIPAA”) permitted a health care entity to substantively respond to a Revdex.com complaint when a response would necessitate disclosure of a patient’s protected health information; and (2) an appropriate response, in light of HIPAA privacy concerns. Thus, any delay in response is attributable to conduct completely outside of the control of Fryeburg Family Medicine. With respect to the substantive response, notably, contemporaneous with the filing of this Complaint with the Revdex.com, the Complainant filed similar Complaints with the Maine Board of Licensure in Medicine and the Maine State Board of Nursing. Fryeburg Family Medicine denies any and all allegations of misconduct and intends to vigorously defend against the allegations in the Complaints. Still, with respect to the Board of Licensure in Medicine and the Maine State Board of Nursing, the Complainant was required to execute releases, allowing the responding providers to discuss the patient’s private health information with the Board. Although it vehemently denies that it engaged in any misconduct, absent a similar waiver from the Revdex.com, Fryeburg Family Medicine is unable to respond substantively to the Complaint. In the event the Revdex.com obtains and provides Fryeburg Family Medicine with a release allowing it to disclose the Complainant’s protected health information for the purpose of responding to the Revdex.com Complaint, Fryeburg Family Medicine would be happy to respond substantively. Otherwise, without the ability to directly address the Complainant’s allegations, Fryeburg Family Medicine merely denies the allegations and asserts that all of its interactions with the Complainant, by and through its staff, were reasonable, necessary, and appropriate.
