We have reviewed Mrs. [redacted] complaint and our company's standing is as follows: Mrs [redacted] purchased a 2011 Chevy Silverado with 176,425 miles on 5/27/16.  This was an extremely high mileage truck and was sold As-Is and without warranty from Diesels Direct.  We...

provide all of our customers the opportunity to have any vehicle they are purchasing inspected at a service facility of there choice before purchase.  Mrs. [redacted] did not do this, however she did have her son (a mechanic) test drive and inspect the truck before taking delivery.  He deemed it in acceptable condition even considering the high mileage and was 100% fully aware that the truck had aftermarket modifications to increase the performance and fuel mileage. As far as any emissions compliance goes we leave it up to the customer to know what there state and local laws are.  We sell trucks in all 50 states and simply can not know what every law is in regards to modified vehicles, however we have tried on several occasions to reach out to Mrs. [redacted] via phone to discuss and she refuses to take our calls.  In reguards to to her windshield chips and door handle we did send her a good faith check for 250 dollars for her inconvenience and consider our business with her closed. Sincerely Management

Everything that was promised to the customer per their purchase agreement was fulfilled by our company.  Not additional moneys for shipping are do this customer.  We consider this transaction and this matter closed.

[redacted] NYS does not make inspectors do an emissions test on the vehicle but the vehicles emissions system has to be factory. It is a federal epa law. The epa has been notified and a report has been filed with them. I was never notified that there was this much wrong with the truck. I do not want this truck and want it returned or I want it fixed! I'm not paying 30+ grand for a vehicle with this many issues. I get that there could be a couple problems that you probably didn't know about. But all the suspension issues, tires and emissions is rediculous. As is doesn't mean here now go spend thousands of dollars to make the vehicle legal and safe! The emissions especially is a federal law!

Revdex.com[redacted]  review of our company and actions are off base.  In this case both the title and the Carfax were clean.  [redacted] looked at and test drove his truck on 2 separate occasions prior to purchase and had no issues other than some wind noise that was...

addressed.  We have over 200 trucks in stock and this is the truck HE picked because it fit his budget, furthermore he could have had any independent shop do an inspection just as many people do with a heavy duty truck purchase. As far as our MO of buying rebuilt junk trucks from Texas, that is simply untrue.  Every truck, car or van we sell gets a thorough mechanical inspection that we pay for ahead of time as well as a complete service at our shop.  Is it true that some trucks cosmetically are nicer than others?  Yes, and that is why we stock a large inventory, so the customer has a selection to pick from.  What may be a nice truck by one's standards may not be nice to the next person.  That being said we are always here to support our customers in a reasonable fashion.  If [redacted] is truly that unhappy with the truck HE picked and purchased we would be willing to discuss trading him out of his current vehicle and into something else as a show of customer support on our end.  Assuming there are reasonable trade expectations on [redacted] end.SincerelyManagement

This Dealership and it's general manager are extremely unprofessional.  The General Manager ([redacted]) has texted me several times telling me that he would pay off the "lien" on the car that I traded in, only to back out of it when I agree to pick up the check or give them the info to get it paid.  The truth is this dealership sold my trade with the lien still on it.  I have been told several times by [redacted] to work something out with [redacted] (sales manager).  I have several text messages from [redacted] stating that they have obtained the payoff information and that it will be paid.  The latest of which was on Monday September 21, 2015, which states that he would have a check on Tuesday and it would be paid off.  The latest in this Drama, was [redacted] texting me on Tuesday September 22,2015 stating that he would sign a check to pay off the lien on the trade if and only if I agree to rescind this complaint and the one I have filed with the attorney generals office of Ohio, and admit that I traded the car without telling them about the lien and admit that I tried to commit fraud.  Photo of Text is attached.  They are now attempting to blackmail me.  I told them no less than 6 times about the title loan on the date of purchase.  My 16 year old daughter was there and can verify.  [redacted] (general manager), was not even in the studio on the date I purchased the car, and to this date, has never even met me in person.  He has no idea what was discussed with his finance manager, who filled out the paperwork improperly.  If you look at the paperwork that the dealership has posted, there is a total of $2600 listed with trade-in value and the $1100 they told me I had to give them as a down payment to come up to the $2600, which is the exact amount owed on the lien.  I have traded in many cars when purchasing a new vehicle, and the dealership has always paid off the traded vehicle as part of the deal.  [redacted] the finance manager, failed to add the $2600 to the purchase price, as she could only get the deal approved for $8700 according to her.  She conveniently put in the $2600, however did not include the payoff, so that she could try to get it out of me at a later date by telling her gm, [redacted], who again was not there the date of purchase, that I did not tell her about it, so that she could get the deal funded and cover her butt on the $2600.  [redacted] has also called me on my cell phone several times with harassing phone calls.  He constantly is using profanity and in the last call,( which I have a recording of), called me a "f$ing ae" and told me that this has nothing to do with paying off the lien, or the money, but about "shoving this deal up your ae".  [redacted] has made several offers via text message that I have agreed to, only to rescind the offer after I accept it.  We had originally agreed to just cancel the deal and I would give back the car I purchased and they return my trade and $1100 deposit.  I even showed up at the dealership the day that he demanded this offer by 6pm.  I showed up at 4pm only to be told that my trade had been sold and that they were waiting for it to be returned.  At 10 pm that night, after they told me the buyer was on his was 4 times and would be there by 6, was then told he was not coming.I have numerous text messages which, according to Ohio law, are as good as a written contract stating that the lien would be paid off.I am still seeking the payoff of the lien, as agreed, so that it can be removed from my wife's credit.  We are receiving calls from the lien holder wanting payment.  The lien holder has also told me that Fiat of Strongsville representatives have called requesting payoff information, but have failed to show up to pay, as promised.

Thank you for giving us the opportunity to answer this complaint. With having time to go over the details of this deal I would like to answer some questions about the tire situation. I have personally spoke with [redacted] and went over these details.  The customer was here and we were working over...

some details about the car and the trade in. With her here she and a friend had a opportunity to look over the car then she went inside the showroom to make sure that everything was going to work out. [redacted] didn't have her trade in here but she did have some photos of the vehicle and the VIN... We gave her numbers on what she showed us and set a time for her to come back and finish the deal.. When she came back her car had a complete set of different wheels and tires on it... We proceeded and went on to make the deal even after she defrauded us by not representing the trade in as shown. With all of this being said she had plenty of opportunity to look over the car that she purchased and there was nothing ever brought up.With speaking to the customer they brought the car in and had tires put on without giving us a opportunity to work the situation out before they bought there tires. We will help the customer in this by giving them a one time Good Will gesture of $200 for them to us towards the cost of the tires.

As we stated in our prior answer, any truck we sell with 176,000 miles is sold as is, but we offer every customer the opportunity to get an independent inspection.  We also can not know all 50 states emission laws and that is why we leave it up to the customer.  We have researched NYS law in an attempt to help Mrs [redacted] and all diesel trucks under 8500 lbs  are exempt.  Please see #5 in the attached copy of NYS emissions code.  We have serviced Mrs [redacted] in matter that is fair and equitable to both parties and our business is concluded. SincerelyManagement

This is a response to the complaint from [redacted]. [redacted] bought his truck from us and it was quite a process. After doing our best to help him work out what truck he was interested in we had to have the Sales Manager get involved because of the combative nature of this customer. After...

the deal was set [redacted] called in to the store with a problem with the truck, a check engine light came on and we asked him to bring it back so we can see what the problem was. After the truck came into service our repair shop said there was a bad sensor and we replaced it. After a few days the light came on again and we asked [redacted] if he could bring it back and we will make sure the problem is taken care of. With parts on order we tried to get [redacted] back so we can make sure the issues where taken care. In the mean time [redacted] took the truck to a local [redacted] dealer and found out there was a recall on the truck to cover this repair. After this repair was complete (EGR issue) by a new car dealer we received a call saying that this truck does not have a catalytic converter... We as a new car franchise know that if emissions tampered with a new car dealer will not cover any repair and the factory warranty and all recalls and no longer valid. We have no notes as to there being any modification's to this truck as in pictures you can clearly see the DPF tank and full factory exhaust. With the claims that [redacted] is making towards our dealership we believe that he just has buyer remorse. The first issue was that there were spelling errors on our printed out buyers order. All of the threats that he has made and saying " I love a good fight" we think that this is just that person that if its not his way its wrong. We as a dealer make sure to go above and beyond and our reviews prove that. With all these things being said we would like to make sure we can at least make the truck right for the customer. We would like to send it to a local [redacted] dealer and check the truck out and we will also provide a vehicle for his use, after that we would like to make sure that [redacted]'s truck is everything that he hopes it was when he bought it and gives him years of good service.

I had the opportunity to speak to Nick and we will make sure to take care of this situation. With that being said this truck was sold to a out of state customer with no further instructions on where to send the title to except for the titling address. The title was sent out before the tag expired...

and us as a dealer did all we could do. This complaint was sent by a 3rd party that works for a auto dealership.

Attached is the "We Owe" document which clearly shows "tires shipped."  Therefore the dealership does still owe the amount of $121.84.  This is shown on what was charged to the customer contrary to what is documented on the "we owe" document.  The unethical markup of the tires is reflected as well on the Tire Rack Invoice, of which the handwritten notes from [redacted] is on there too.  The dealership AT A MINIMUM OWES $121.84.
