complaint it appears as though he is contesting his current Due Date and the method by which we calculate it. Our records show that Mr. [redacted]s account is currently due for March 26, 2016. Please see attached payment history (Exhibit A). It is evident from this exhibit that Mr. [redacted]'s payment practices are very irregular. He has been late in making these payments on a regular basis (14 times). He was even late with his very 1st payment. He also had a payment returned as NSF one time (06/08/15). On four separate occasions he has made payments for less than the minimum amount (11/25/15 through 02/03/16). These "partial payments", individually, will not advance his due date, but the system will accept them and will grant full due date credit as subsequent payments or partial payments are made. When a loan becomes "past due phone calls are regularly placed to the member as payment reminders and if those do not work then delinquent notices are mailed at regular intervals, all of which Mr. [redacted] did receive. In addition to this Mr. [redacted] received a coupon book upon loan origination to remind him of his payment schedule as well as receipts of quarterly statements on his account that fully detail his account and loan history. I have also enclosed an Amortization Schedule of his loan. (Exhibit 3). This exhibit shows what his loan balance should be at any point in time. This exhibit clearly supports our standing that Mr. [redacted]'s loan is indeed past due. Had he made all his payments on time and in the full amount, then his current loan balance should match the balance on the amortization schedule; which it clearly does not. If he has made payments on his loan that is not reflected on his loan statement, we would be glad to research it and adjust his account provided that proof of such payments can be supplied. As for Mr. [redacted]'s issues with our policy for automated payments I can offer this explanation Yes, we do charge a $15 processing fee if a member wants to make a one time payment electronically. This is done to defray our processing costs. He can avoid this fee if he agrees to make this electronic payment re-occurring payment on a set date each month. Our electronic/Auto payments gets processed on a daily basis and settlement/fulfillment take no more than 1 business day.  It does not take 10 days for us to process these types of payment plans if the Credit Union initiates the request.  I cannot comment on the processing time if he takes this request to his financial institution to remit payment to us.The Firefighters Community Credit Union was established in Cleveland in 1936 and has been faithfully and professionally serving its member-owners for 80 years.  We pride ourselves in offering a wide range of financial products and services at better than market rates and by delivering them with exceptional member service. Sincerely,Terrence J. grant the Fresh Start Repayment Plan under specific circumstances and this situation did not meet those criteria. I do see that the credit union made an exception to this standard procedure in the past in an effort to accommodate your situation. However, our account disclosures, which you would have received at the time of account opening and are published on our website, very clearly indicate that the credit union reserves the right to transfer funds between accounts owned by a member in order to bring a negative account current. Additionally, at the time you were granted a previous Fresh Start Repayment Plan your overdraft privileges were revoked. This is consistent with our standard procedures and guidelines related to the product.
