After doing some extensive research into your complaint filed I was able to locate the account you are referring too which is under the name [redacted].  I have also received emails in which [redacted] has done everything possible to accommodate your family.  We have...

trainers available for [redacted] to utilize at the facility.  Because you are under a contract and we have fulfilled our part of the contract I cannot waive the last payment of $150.00 that is owed.  I will however waive the fees that have accrued and add 2 extra sessions to your account once the last payment is made.

I have attached the cancellation letter sent in that was dated for 11/17/2014 and post marked on 11/20/2014.  The payments on the account are set up to come out on the 11th of every month which would make the last payment 12/11/2014, as it falls within the 30 day cancellation policy we have in...

place from the date the letter was received. The account was not cancelled because of this.  Fitness 1 Gym would require the last $19 payment with all fees being waived in order to cancel. I have gone ahead and cancelled the account and am waiving the 30 days.

October 27, 2016               RE: Revdex.com Complaint #[redacted]     [redacted] signed a contract with Fitness 1 on July 29, 2016 for a six-month term....

  As well as initialed for the contract to fall into an auto-renewal to pay the monthly payment on a month-to-month basis until client provides a written 30-day notice as required per the terms of the contract to cancel the account.      A cancellation notice was received from the client and the auto-renewal on the account was cancelled as the terms of the contract had not been fulfilled as they agreed to pay a total of $769 for the total contract price.  Early cancellation terms are stated on the contract and the attached letter was sent to the client to remind them of the terms and conditions of the contract they signed.   No refund is due as Fitness 1 has and can fulfill our obligations stated within the terms of the contract.  The attached letter states how to cancel early.

Both our Personal Training Contract and our Membership Agreement have an option to cancel with a full refund as long as it is within three (3) days of signing.  Our Personal Training Contract is a binding contract.  Any early termination requests have to be done in...

writing and sent in to the address listed on the contract by certified mail or turned into one of our facilities as per our contract states.  I have never received such a request concerning your Personal Training contract and I show you attending your Training sessions up until the end of December 2014.  As for your Membership agreement we only require a 30 day notice in which to cancel.  I have on received a request to Freeze the membership for three (3) months at the end of December 2014 that Fitness One honored.  At this time I can cancel both the Membership Agreement, which has a balance due of $64.00, and the Personal Training Contract, which has a balance due of $220.00.

The refund on the account was authorized on 07/09/2015 through our [redacted] billing services.  It takes 5-7 days to receive the refund back.
