There was a discrepancy in the work done on a fencing job, the price I was quoted, and the amount of time that we were billed for. I spoke with office sales admin. [redacted] Rustemeyer about adding mesh wiring to the bottom of fencing that the company installed in our backyard in (approximately) November of 2012. At the time we had informed them that we had three small dogs and we wanted to have them be safe in our backyard. We commissioned the work before we moved to the new address (we moved in on December 14, 2012). After the move we noticed that there were large gaps along the bottom length of the fence. The plan was to address this in the spring and have the company return to correct this once the ground thawed after winter. I spoke with [redacted] about the job. She gave me an estimate based on adding meshing to the full length of the fencing. The work was done on Tuesday morning, April 9, 2013. The men arrived at 8:15. I was home at the time and went out and told them what was supposed to be done. I left shortly after for work, but another member of the household was still home. This other member of the household was planning to leave at 9:30am for work. He went out and asked the men working on the fence how much longer they had and was told "45 minutes to an hour tops". When he came home at 10:30 to let our dogs out, the men were gone. That night I noticed that the men had left 7 panels of fence un-meshed, and 1 gate. My assumption at that point was that they were going to obviously be charging us less than the quoted price since they they had done fewer panels than we had discussed. I called the next day and spoke to missy about this. She was rather short with me, but said that the invoice had been sent out that day. She said that I was being charged the amount that I was originally quoted. I expressed concern about this since they had completed fewer panels. I was told at that time that my price was based on the amount of time that they spent on my fence, which she said was from 7 am to 10:30 am. I explained that I was home when they arrived at 8:15 (not 7) and that they were gone by 10:30. She said that 7 was the time that they were :"dispatched" for the job to my home. I live 5 minutes from the business. At this point [redacted] said that I should speak to [redacted] (I am assuming the owner). I was given his number and put through to his voicemail. I left a detailed message. I received no response. The next day I received the invoice in the mail (invoice no. 2013-0022, invoice date 4/11/2013, amt. due $459.38). I again called to speak with [redacted] who again put me off to [redacted]. I left [redacted] another message. In total, I left approximately 11 messages, six of which were in the days immediately following these interactions with [redacted] in April. I received no response and so I stopped calling. I assumed that they realized that a mistake had been made and that they were handling it. Then on June 4th, 2013 I received a notice dated 6/3/2013 that stated "Although we have contacted you about the outstanding balance on your account, we still have not heard from you." This was signed by [redacted] Rustemeyer the office administrator. I was immediately angry since I had tried to address this with them two months prior, and had received NO RESPONSE whatsoever! I immediately called, spoke with [redacted], and was again told to speak to [redacted]. Over the course of the next three days, I called five times and left [redacted] 5 messages, (both voicemail and with other people in the office) without a response. Finally on 6/7/13, I called and was connected to him. He was extremely rude, and told me that he recalled that he had been "busy" in the spring and that that is why he didn't respond to me. He said that I was not charged by the hour (which [redacted] clearly said that I was). He said that I was being "nit-picky" and that clearly I had "misunderstood". He offered me no resolution to the price quote or the fact that the work was unfinished. It ended with him hanging up on me after calling me names ([redacted], [redacted], [redacted]), after I questioned his business ethics.Desired SettlementInitially I was willing to simply have them fairly bill me for the time spent and the amount of work done. It is clear to me however, that [redacted] will not acknowledge that [redacted] gave me different information about how I was being billed ([redacted] very clearly said based on the time spent on the job, but [redacted] says that that is not the case and that I "misunderstood"). At this point, if we are going to pay the $459.38, I want the rest of the 7 panels of the fence to have the same wire mesh put in and the 1 gate that was left without the wood block placed beneath it to be completed. We, with his direction (after wire had been cut and we arrived to install wire) did not dog proof 30 or so feet of wire. We will go back if he wants us to. We do not quote jobs on a per hour rate. Our experience (58 years) and knowledge of our installers (25+ years), we know roughly how long it will take them to complete most installations. We knew his fence and footage. [redacted] hollered at [redacted], called him insulting, derogatory, and demeaning names as [redacted] was trying to get to the bottom of his complaint. [redacted] offered to come back to do whatever he wanted and he continued with slurs. He said he was not going to ever pay [redacted] Fences.Consumer's Final Response (The consumer indicated he/she DID NOT accept the response from the business.)First, [redacted]'s account is dishonest and incorrect. To begin with, I do not understand his notation of 8:15 to 10:30 as 4.5 man hours. That is 2 hours and 15 minutes. In addition, I NEVER said anything to the [redacted] (with whom I spoke) about our soil washing away! That was never the case. We also NEVER told them in the fall that we would fill anything in with soil!!! Why would we pay to have a fence installed so that we would need to go back after the installation to correct the work that we had paid to be completed? This is dishonest of [redacted] and actually makes no logical sense. He also contradicted himself in his statement when he said that we told him that we would "fill in the void with soil" when he said that I called in April to install the wire because the soil was "washing away". That would suggest that all of the new soil that we had supposedly put in had washed away in the winter snow. As I stated before, they completed the work in the fall, but we did not occupy the home until December. It is also of note that [redacted] says that they do not quote jobs by the hour. I would have no way of making any assumptions about how they quote jobs. I was given that very specific information by his [redacted] when I called the day after the work was done to inquire about the incomplete work. I am also insulted that [redacted] would lie and say that I "hollered" at him and called him "insulting, derogatory, and demeaning names" as he was trying to "get to the bottom" of my complaint! His statement would be laughable if it wasn't such a lie. Remember, I had been trying to have a simple conversation with [redacted] for almost two months and he never attempted to reach out to me! This is not the behavior of someone who was simply concerned with getting "to the bottom" of my complaint. [redacted] knows that this is dishonest. He also knows that he was the one to insult me. I did say to him that I was confused as to how he had been able to run a business for all of these years and treat his customers with such disrespect. Surely this is not the same as calling him names. [redacted] never offered to come back and finish the work. In fact, he told me that I was being "nit-picky" for making such a complaint. I also never said that I was never going to pay the company. As a matter of fact, just before [redacted] hung up on me, I said that I would just pay the invoice amount because it felt clear to me that we had no recourse and that he would not acknowledge their poor work or the possibility that they had been dishonest in their pricing. It was not until I was hung up on that I spoke to other family members and friends who encouraged me to seek a resolution through the Revdex.com. One final point: [redacted] talks about his 58 years of "experience". One would assume that that would lend itself to some basic honesty and common sense practices in his work. The invoice that we were sent early this month demanding payment states that it was for mesh wire installed "OUTSIDE" of the fence. It is of note that the wire that was installed was installed INSIDE our fence!! This makes it impossible to trim weeds growing against the fence when we mow our lawn, which aesthetically looks unappealing as a result. I was not planning to bring this up initially, and did not include this in my initial complaint. However, since [redacted] sees it fit to lie about the work done, the communication between us, and my behavior towards him, then I see it fit to put all of my cards on the proverbial table. At this point we will likely have to take the mesh wire down ourselves so that we can properly maintain our yard. The work was incomplete, incorrectly installed (even by their own invoice), and dishonestly priced (or at the very least, dishonestly communicated pricing). I would like the work corrected and completed for the price that we are being charged or the fee to be waived to reflect the poor and incomplete job that was done by [redacted].

My family had Fitzgerald Fences, [redacted], Massachusetts install and repair fences on four different properties since about 1967. We were always satisfied with the quality of the product, the workmanship and the fee charged. About three years ago, the service started to change. We have had three experiences with the company which have been a cause for concern. In each case, there is documented proof that Fitzgerald Fences made mistakes. The proof is written in their own paperwork. When the company was informed of the errors, we had to deal with anger, false claims, and/or no response.1. We received a bill for a job which was clearly and correctly stated in the bill. When we happened to go to the said property for another purpose we noticed that the job was not done as stated on the bill. It is important to note that we were not concerned about this mistake, at all. We went to [redacted]'s office to have the job corrected. Three employees of the company in the office were visibly angry with us. One actually lied, another asked me who wrote the bill and the third person was so angry that he stormed out of the room. Eventually, the work was corrected.2. We never told [redacted] about the second situation since the mistake was caught before the employees installed replacement posts on our neighbor's fence.3. The latest issue is what brings me to write this complaint. We ordered a fence to replace an older and smaller fence where we reside. An employee came to the house to review everything and to take measurements. He noted that there was one obstruction that needed to be removed, "brush". The brush was removed far in advance of the installation of the new fence. On the day of the installation, a second employee came to check the area. He said everything was ready. Neither employee mentioned that we were responsible for removing the smaller fence. The only obstruction to beremoved written in the contract was the brush. When the installers arrived we were informed that it was our responsibility to remove the smaller fence. The employee pointed to the contract telling us it was written that the fence was an obstruction that we had to remove it. He obviously made a mistake. My husband (age [redacted] removed the fence, put the material in his pickup truck and eventually discarded the material. I wrote a letter to [redacted] explaining the situation and requested that the fee for removing the fence be removed from the bill. He did not respond. The bill came without any corrections. I paid the bill in full and included a second letter detailing the company's other mistakes as well as this one. Still there was not any response.In recent years there have been other complaints from customers including one to the Revdex.com. What do I want? If they had responded,the issue could have been resolved at that time.We were ignored! [redacted] only responded after the Revdex.com was contacted. The installers misread the "Proposal". Removing the fence was never mentioned in the Proposal or when Steve and Chris,each at separate times,visited the property and spoke to us. The bottom line is that we were told by the installers that they would not be able to start the installation work until the old section was removed by the customer or we would be charged if they had to remove it.We wanted the fence installed without a new charge being added on the bill. The removal of the "brush" by the customer was brought forward by the company and written in the proposal. This was understood, accepted and addressed.That is what we agreed to do.The removal of the fence by the customer was sudden, unexpected and stressful. It was not in the contract. What does [redacted] specifically propose to do to remedy this situation? We are not angry about the work. We are upset about the terrible communication brought on by [redacted]'s office. If they had responded,the issue could have been resolved at that time.We were ignored! [redacted] only responded after the Revdex.com was contacted. The installers misread the "Proposal". Removing the fence was never mentioned in the Proposal or when Steve and Chris,each at separate times,visited the property and spoke to us. The bottom line is that we were told by the installers that they would not be able to start the installation work until the old section was removed by the customer or we would be charged if they had to remove it.We wanted the fence installed without a new charge being added on the bill. The removal of the "brush" by the customer was brought forward by the company and written in the proposal. This was understood, accepted and addressed.That is what we agreed to do.The removal of the fence by the customer was sudden, unexpected and stressful. It was not in the contract. What does [redacted] specifically propose to do to remedy this situation? We are not angry about the work. We are upset about the terrible communication brought on by [redacted]'s office. [redacted] and [redacted]Final Consumer Response (The consumer indicated he/she ACCEPTED the response from the business.)[redacted] accepts the compensation of [redacted] for his labor in removing the fence and the disposal of the material.The compensation is fair.[redacted] and [redacted]Final Business Response Fitzgerald Fences Inc. acknowledges that we made several errors on the project and that we will compensate the [redacted] for our mistakes.Mr. [redacted] acknowledges that the employees of Fitzgerald Fences made several mistakes.
