Per conversation with [redacted] at ***'s Flooring and BBB: We did finish the work. Three of us went to her house and she pointed out every area in her house that she wanted repaired and we did so with a discount. Here is an email dated September 11, 2014 from consumer to [redacted] , Design Consultant and consumer, Mrs. [redacted] stating our policy regarding the warranty: From: [redacted] H < [redacted] @gmail.com> Date: September 11, 2014 at 10:50:15 AM CDT To: [redacted] < [redacted] @att.net> Subject: Re: There's a white blob on one of the shower floor tiles. ??? Mrs. [redacted] , I have spoken with my office Manager (***) and with the Owner (***) about your request. We will be more than happy to write you up a warranty once your bill is paid in full with out discounts. It is our policy to void warranties if we are not paid in full or have to give discounts. Let me first point out that the moment Mrs *** called to let us know she was unhappy with some of the work we had performed we immediately arranged a meeting with her, *** (the sales person), a manager and the installer We all agreed with Mrs *** that the areas she pointed out to
us were not satisfactory and did in fact need to be replaced
To address the matter of the time it took to complete the project, it needs to be stated that when Mrs *** called us out to begin work, we showed up and the contractor still had other crafts performing work in the area Flooring Design Center cannot begin work with painters or carpenters in the area Second, it is true that the tile had not been ordered when we began the project, but Mrs *** had not approved her scope of work yet She was aware that it must be approved before we can proceed
The drain adapter kit was discussed with Mrs *** It was an ato the job because her contractor did not move the existing drain as was his responsibility to do so We then had to use this kit because a drain would not work However, the price of this new drain was the same price as the drain that was in her original bid The only thing that changed was the actual type of drain
Our billing system can be hard to read if you are not used to looking at it It is in the flooring language so to speak; however, this is why we summarized any and all work being done in a scope of work that we proved the customer Mrs *** was provided this scope, which she then signed She asked for a better breakdown of her job and our invoice was what we are able to provide
When Mrs *** decided to cancel the installation of her second bathroom we subtracted the installation price of the bathroom off of her invoice We charged her for the tile that was ordered to cover both bathrooms like she requested The reason the bid increased was because we had to order additional material to cover the bump-out sides that were added after we bid the job
The t-mold had not been ordered yet because we were waiting on Mrs *** to provide us with the color
Her complaint with the Revdex.com was lodged on 9/1/and the following day we were back at her house with *** and two managers following up on the areas that the original installer repaired Mrs *** pointed out a number of areas that were still not to her satisfaction and requested we complete the repairs with a different installer She also asked for a discount at this time Please note this was the first time a discount had been mentioned
We gladly provided her with a different installer The repairs that she requested were completed on Friday (9/5/14) and Saturday (9/6/14) We offered her a $discount This was an unsatisfactory amount, she asked for $and we agreed
On Tuesday (9/9/14) Mrs *** called again to inform us that her glass door did not fit and that we needed to fix it However our owner, *** ***, spoke with the glass installer over the phone and he confirmed the glass was measured after the tile was installed Flooring Design Center is not responsible for a glass company's ability to measure This is their responsibility to correct
To date Mrs *** has not paid her final balance, although the repairs are complete, her discount was granted, and the job is done Also she has requested a warranty contract, which we will provide to her only when her balance is paid in full with no discount taken off

Complaint:
I am rejecting this response because: Several points that were interjected here are not accurate.1. To address the matter of the time it took to complete the project: First of all, a 7-day project took weeks to be completed. The first day Flooring Design (FD) was scheduled to work was on 7/23/and although its true the contractors crew was here working, when ***, FD's installer, told me it would be too crowded for him to work with the painter in there too, I immediately called the contractor to explain and he instructed me to have the painter leave. Which I did, so that did not cause a delay. *** began his work as scheduled2. The delay came when FD had finished removing the existing tile flooring in the master bathroom, which was on the 7/23/14, and *** informed me that the tile for the floor had not been ordered because I had not come in to pay for it. At that time, I had approved the original scope of work dated 5/14/and had paid $$$ on 6/13/14, which is when ***, ***'s assistant, called to tell me they could not order the tile for the shower until I paid for it. Therefore, when *** began work on 7/23/14, the tile for the shower was in. That was the first I had been informed I need to pay so I immediately asked *** if she could take a payment on MasterCard by phone which she did. The second scope of work is dated 7/9/14 as I had asked for a price on granite for the hall bathroom vanity. During the next to 1/weeks, I chose to put the same tile as the shower walls on the floor in the master bathroom and the hall bathroom. The third scope of work is dated 7/23/which includes the tile flooring, the shower tiles and the granite for the master bathroom, the granite, the tile flooring and the t-mold for the hall bathroom. No one ever asked me to find out the color of the t-mold or I would have. There had been no mention of making a payment before the tile for the flooring could be ordered, hence, after the master bathroom floor had been removed, *** then told me I needed to pay so they could order tile. I went to FD and made a payment on 7/23/14. They put the shower wall tiles on the floor so we would not have to walk on concrete for 7-days until the floor tiles came inThe drain adapter kit: The exact conversation on this consisted of, "We're going to use this", *** said to me, period. It is stated in this answer from FD that "it was an add-on" and they also say "the price of this new drain was the same price as the drain that was in her original bid", so was it an aor included in the original bid? Nevertheless, it was understood by *** before the work began that there was no need to go to the expense of moving the drain, per my contractor. *** was also informed during the planning stage of the shower that there would be a need to reinforce the walls to hang the shower enclosure which is the bump-out sides mentioned here. Bull nose tiles were needed to surround that but were not ordered. Another delay.4. Billing system break-down of pricing: There is no way to decipher from what they gave me what I have paid for and what I have not, flooring language or not. Is this by design? The summarization of work consisted of a statement of what work they would perform and a lump sum for material and labor. My definition of a summary is exactly what the tile costs, and materials needed to lay the tile, etc. Items are stated in their lump summary work they were supposed to do but did not. The shower floor tiles were supposed to be sealed twice before and once after installation and they were only sealed once after installation. They were to installed a shaving niche but I opted for a soap tray to be installed instead....this was not done. Their scope of work also included undermount sinks which I informed *** that I had already purchased. She then said that was for the installation of undermount sinks. If that is the case, it should have stated "installation". 5. Complaints: It is true FD came to see the many complaints I had with the project and did fix some of them, but there are some areas that are unable to be fixed without another complete tear down of what has already been installed. Meaning the project would go on That is the reason the shower enclosure would not work. In light of all the problems, I told *** that I wanted to be able to use the shower before making the final payment. The shower still doesn't have an enclosureThat is also the reason I want a warranty contract on the project. Yes, Flooring Design gave me a discount but to be given a discount and then Flooring Design take it back if I want a warranty contract is not an ethical business practice. in other words, they are giving me a choice of a warranty contract OR a discount. The discount was for unprofessional work performedSo why would I not want a warranty contract? I understand that a warranty contract will not be issued until the balance is paid in fullWhy do they not want to issue a warranty contract on the work as well as give a deserving discount?
Sincerely,
*** ***

I light of the lack of response from Jan's Flooring Design, only a reiteration of previous conversations, I am requesting through Revdex.com that we go to mediation in the near future.
