I am in receipt of the complaint filed against Flynn's Remodeling by *** *** on August 15, 2014.Again, I apologize for the delay in my response; I was out West on vacation when the letters came to myoffice.I am disputing these charges for a number of reasons:No Evidence of a
ContractAfter playing phone tag the week of June 21st, my *** ***, ***, spoke to Mr*** on June24thHe stated he was calling to get a copy of our insurance certificate because we were doing work forhim*** asked Mr*** to fax us a copy of the contract so that she could address the certificatecorrectly, and have them added as additional insuredHe said he would do soNo contract wasforthcoming.No Evidence of Scope of WorkAfter receiving an "urgent call" from Mr***, I returned his callSince I was unfamiliar with hiscompany, I asked him again for a copy of the signed contract he had with Flynn's RemodelingHe statedthat he did not have a contract, but damage had been sustained at a home he was working on and hedemanded a copy of the insurance certificate so he could file a claimSince I had no knowledge of this, Iasked for details and told him I needed to speak to the subcontractors involved before speaking to himabout any insurance claim.Event DetailsAt the time, I did have a few subcontractors in ***, sent to assist with clean up from thedevastation left by storm damageI spoke with them and they did confirm they were working on thehome at *** *** *** *** **They were instructed by Mr*** to remove all ofthegutters, someone else would be delivering the new gutters for installationOne of the subcontractorsasked the home owner if they had any problem areas they were concerned aboutThe homeownerstated every time it rairr" water comes down off high roof to low, overflowing and flooding thebasementThe subcontractor confirmed with the gutter company and Mr*** that the gutterswould be delivered between 7:and 8:amHe proceeded to pull the gutters down (Hip roof allgutters are connected so taking down only certain sections was not possible)Given the anticipatedtime of arrival of the new gutters, there should have been no problem getting the gutters installed inone dayBy 9:00, the new gutters still weren't there so the subcontractor contacted both Mr***and the gutter companyAt that point the homeowner was concerned for the safety of their dog andwanted all of the old gutters now off the roof immediately removed from the property which was doneaccording to the homeowner's requestThe delay of the gutter delivery, wrong outlets and accessories,etcas well as a damaged gutter caused a serious delay in hanging of the guttersAlthough the job wasstarted, it could not be completed until the following day.On June 22"' , the subcontractors were notified by Mr*** of damage sustained to the home at theaddress above in the same area the homeowner previously complained about constant water intrusionafter each rainWith the knowledge of this discussion with the homeowner, our subcontractorrequested the opportunity to look at the property and inspect the "alleged damage"Mr***denied them the opportunity to do so.Solution OfferedAfter reviewing the details with the subcontractors, I spoke to Mr*** again and offered thefollowing choices:• I had been informed by the subcontractor that they had installed gutters on previous homesfor Mr*** and he had an outstanding balance for those jobs of $2,Knowing this, Isuggested we work out a written contract with him (which should have happened prior to anywork being done)Upon so doing and receiving full payment of the $2,already owed, Iwould file an insurance claim without any additional questions asked.• OR- I would write off the $2,and the additional charges for the work completed on thishouse and call it a day.His statement that suggests we offered to cover the cost of damages is absolutely falseWhy wouldanyone do so without any opportunity to inspect the alleged damage in the first place? Thesubcontractors did what they were asked to do according to the information passed on to me; LudwigConstruction did not produce the new gutters for installation in a timely fashionThat is of no fault ofthe subcontractors I employedWithout having anything in writing, and contrasting reports from bothparties, I felt either solution offered was reasonableMr*** declined both and still refused anyopportunity for inspectionWe promptly discontinued any involvement with him or his company.Thank you for the opportunity to provide a response
