never been sued by a customer for defective work and Ms. [redacted]’ complaint is, to our knowledge, the first complaint filed against the company with the Revdex.com. Ms. [redacted]’ claim that Fresquez Construction “barely completed any work” is false. The lot that Ms. [redacted] and her husband own is located on a steep hillside on Green Mountain providing views of the Denver metro area. We moved a significant amount of dirt on the lot in preparation for construction of the home’s foundation only to determine that the slope on the lot was too extreme and unstable. We advised Ms. [redacted] and her contractor that a retaining wall would be needed at the bottom of the lot; the owner of an existing home located below the [redacted] lot had already expressed concerns to our company about the risk of heavy equipment and rocks sliding down from the [redacted] lot into their home. The owner of the lot directly adjacent to the [redacted] lot has constructed a large retaining wall to stabilize the lot prior to the planned construction of his home but Ms. [redacted] rejected our retaining wall recommendation due to the cost involved. We were interested in seeing the soils report obtained by the [redacted]es’ soils engineer to see if it contained recommendations regarding a retaining wall but we were refused a copy of the report. Excavation work on the [redacted] lot was delayed for weeks at a time due to the decision by the [redacted]es and their contractor to change the elevation of the foundation due to problems created by the excessive slope of the lot and the lack of the retaining wall we had recommended. Throughout these delays our company was forced to pay thousands of dollars of ongoing rental charges for heavy equipment we had rented to provide excavation services for the [redacted] project.Ms. [redacted]’ claim that we never returned any of her money is false; we returned $25,000 to the [redacted]es through their contractor, along with extensive documentation of where we had spent the remaining money paid to us. It is unfortunate that Ms. [redacted] is frustrated by the challenges posed by construction of her home on a steep hillside but her complaint against our company is completely unfounded.

Fresquez construction did not complete as much work as they are stating. I have photos showing the work that was done. They scraped the lot, put up a silt fence, and brought some dirt onto the lot. However, they never did any of the work to dig a hole for the foundation, they did not pour any concrete, and they did not do anywhere near $50,000 worth of work. They may have experience excavating. However, the lot we are building on is very steep, and therefore, it required an excavator and concrete contractor who would be comfortable working on that grade. It became very obvious how incompetent Fresquez Construction was to do the work when the new excavator we hired was able to complete the dig and the foundation with no questions asked in much less time and for a much lower cost than it took for Fresquez Construction to complete very minimal work.  There was most certainly not $50,000 worth of work done to the project. We have emails from Fresquez Construction staying that the entire excavation would cost around $28,000, so it does not add up that they completed $50,000 worth for doing only a few things. Also, some of the work they are claiming to have done was done without consent. One of the invoices we received was for a change order for $12,000 worth of work that we never approved nor discussed with them. We were told in an email, which I can also provide if needed, that the extra dirt would only cost a total of $3,000. We did approve this change order, but never even received an email or a phone call about the $12,000 change order.
