Initial Business Response /* (1000, 5, 2015/04/17) */
April 17, 2015
Revdex.com
Akron, OH
case # [redacted]
Ms. [redacted] did schedule a birthday party for [redacted] on February 17, 2015. She was sent a confirmation email on that day which I have attached (doc 1). Ms [redacted]...

sent me a letter about her unhappiness with her party, which I also have attached (doc 2), as well as my response that I sent her (doc 3).
The party was to take place on [redacted], March **, 2015 from 3:00pm until 5:00pm. Ms. [redacted]'s party was scheduled to be for 10-16 children. She ended up having 23 kids and almost as many adults attend. The party included unlimited access to laser tag, rock climbing, Eurobungy, roller skating (skate rental included), Cannon Ball Blasters, Super Hero Kid's World, The Lost Tomb of Osiris, and Medieval Madness Crazy Cars during the duration of her party. It also included 10 video arcade tokens for each child for the arcade. As for food, it included 24 slices of cheese pizza and 3 pitchers of fountain beverages. Ms. [redacted] ordered an additional 36 slices of pizza. Her total bill with tax was just over $500.
As you can see in her complaint, Ms. [redacted] mentions no issue with any of the 8 activities in her package or the arcade. She mentions no issues with the quality of the food that she was provided. Her issues listed were that her party server was not efficient or thorough when serving the pizza we provided, nor the cake that she brought, and that Ms. [redacted] was asked to pay for additional drinks that she ordered for her guests, because she believed they should be free.
Ms [redacted] essentially tried to extort a full refund for her party by threatening complaints to Business Consumer Alliance and the Revdex.com. I believe that I offered more than adequate compensation by offering the full value in gift certificates for the ENTIRE portion of her party that she paid for food.- food that was eaten and without a complaint about it's quality. Due to the confusion of Ms [redacted] and her belief that all the children can have unlimited free beverages as well as the adults (who we didn't charge her anything for attending), we already did not charge Ms. [redacted] any money on her bill for the extra pitchers of beverages that she used. We charged only for the extra 36 slices of pizza she ordered.
If there were issues serving the cake, it was mainly caused by Ms. [redacted] exceeding the scheduled duration of her party and not allowing the cake to be served at the scheduled time of 3:45pm, right after the pizza as our policy stated in the confirmation letter that we sent Ms. [redacted] on 2/17/15. Ms. [redacted] wanted the kids to play more, even though her package was for a 2-hour party that includes @ 90 minutes of play and @ 30 minutes for food. Since she moved the time to eat cake after her party was scheduled to be over, her sever was already helping her next party. Because of this, [redacted] came and sliced the cake, while [redacted] and [redacted] came over and actually served the cake to Ms. [redacted]'s guests.
As you can see by the letter that I sent to Ms. [redacted], I was previously willing to compensate her regardless, to a substantial degree, whether she was to blame, or we were to blame. But what she is asking for is not customary or usual. It is excessive, exorbitant, and inappropriate. She is essentially trying to get her child's entire party for 23 kids and many adults at no cost to her. I am not willing to do this.
There were several things in her confirmation letter that I pointed out to Ms. [redacted] in my original attached reply to her. Ultimately, I believe [redacted] had a great birthday party and is anxious to come back soon.
Sincerely,
[redacted],

Initial Consumer Rebuttal /* (3000, 7, 2015/04/20) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I do not accept that response. Some things are not true in the statement that he wrote... yes their were 23 kids which I paid for the additional ones. Adults attend with their children. For the simple fact they couldn't be left alone. my bill was also not $500 it was $450 to be exact. I have receipts to prove it. Also [redacted] did not state to me that my cake will be served at 3 45pm she set my party food down and totally dissappeared. I had to hunt her down multiple times. I also asked him for at least $350 back I wasn't looking forward to the while amount... son things my son wasn't happy about seeing that he was almost the last one to get his cake when he is the birthday boy.. I felt like o gave my own party I served my food and beverages. He also stated that we got free beverages at the end which I didn't cause I refuse them. Due to me not being a happy the way the party turned out. Yes I refuse the gift cards Due to the fact I Dnt think I will ever visit their again.
Final Business Response /* (4000, 9, 2015/04/24) */
Ms. [redacted] claims that some of the things that I wrote were not true. The things that she points out are not my impression of what happened, but are the facts proven by the documents that I supplied with my written statement.
1. A copy of the letter that she wrote me that states, "In an effort to resolve this matter, I would appreciate a full refund." I have also attached the complaint that she wrote to the Business Consumer Alliance that states the same request for a full refund. The only place that states $350 is on the Business Consumer Alliance report under "amount paid", which is what she thought she paid for the party.
2. When the cake was to be served is also not up for dispute. It is seen in the confirmation letter sent to Ms. [redacted] (that I also submitted to you) that was sent to her a full month before her party. It states, "Your party hostess will serve your pizza and cake at 3:45 pm."
3. Ms. [redacted] also claims that I was incorrect about how much she paid for her party. Her total bill was $503.62 and this can be easily confirmed. Ms. [redacted] paid $50 on February 17, 2015, when she booked the party, and the balance of $453.62 the day of her party.
4. Her party was scheduled for 2 hours (3pm-5pm), as stated in her confirmation letter. As you can also see in that confirmation letter, "You have your party tables until the scheduled end of your party. If you arrive after your scheduled start time, please be aware that your party will still end at the original scheduled time. This is to make room for parties that are arriving after you." Ms. [redacted] was having her party at 5:30pm.
Other things which I stated that are also true, but I have no concrete evidence to prove are:
1. [redacted] did not "disappear". She set the first 2 pizzas down and walked back to the kitchen to get the remaining pizzas so she could serve them. Ms. [redacted] thought she disappeared when actually she was bringing the rest of her food.
2. Ms. [redacted] was given extra beverages at no charge. She ordered pizza for 23 kids plus adults and only was charged for drinks for the original 10 kids. There is not enough volume in 3 pitchers of soda to fulfill drinks for 23 kids plus adults. [redacted] provided those at no charge and only after she continued to ask for more did [redacted] tell her that extra pitchers were $4.50 each and Ms. [redacted] got upset as she thought she had unlimited drinks in her package. This misunderstanding upset Ms. [redacted] so much that this is what she complained to the manager and is why he offered her additional beverages at no charge.
3. Ms. [redacted]'s only complaints are about the food portion of her bill. Not of the quality, but how the pizza and cake was served, along with the her misconception of the cost of her beverages. The total she paid for all the food and drinks was $89.97. She claims inferior service and lists several items to support her claim. The things she mentions that upset her was:
1.That her son was not offered his cake first, (by the way, this was never mentioned in her first letter)
2.That too big a slice of cake was offered to a 17-month old toddler
3.She pointed out [redacted]'s failure to "manage" her party (something that the confirmation email states [redacted] is not responsible for and that Ms. [redacted] can purchase a party ambassador for if she desired more help for her party.)
For these items she wants a full refund (now apparently changed to $350).
Most of these things are personal preference. Ms. [redacted] had to only say, "Please give my son the first piece of cake", or "Please give the toddler a smaller piece of cake", and it would have been done. Many people feel that their guests should be served first and themselves last. Some birthday children actually like to deliver the slices of cake to each of their attendees and thank them for coming. No one can be expected to be a mind reader. If her son receiving the first slice of cake was a determining factor to her paying full price for her party, then she needed to inform us of such, as currently we had no agreement as such.
It unfortunately seems that Ms. [redacted] will not be appeased. Her perception of how she wanted her party to go, what was included in the package she purchased, and what level of service she was and/or wanted to be provided will probably remain in dispute with our views. We conduct well over 2,000 birthday parties per year and this is the first that has had a parent state they are unhappy and want a refund. We pride ourselves in being the number one place for birthday parties in Ohio. We offer more activities than our any of our competitors. It is unfortunate that Ms. [redacted] is allowing her lack of communication about how she wanted her pizza/cake to be served to ruin her son's party for herself, and perhaps him.
In the end, Ms. [redacted] had 23 kids that had access to 8 attractions, plus our arcade for a 2-hour party duration. They were served 60 slices of pizza and beverages that no one complained about the quality of the food or drink. She was allotted table space in our facility for at least 30 minutes past her scheduled time. Therefore, we will not be refunding her payment as we delivered what was contracted.

Tell us why herMs. [redacted]'s conduct was outrageous. To quote from statements: "... About 3-4 minutes after she gave me her shoes her mother comes over to the skating area yelling while using profanity on how she was upset about our trade in policy for the blades.  Due to the cost of her daughters shoes ($200) she requested for a manager so therefore I called one (Amber).  I explained to Amber the situation.  While Amber is trying to explain to her, she continues to yell at Amber and  curse."   from statement A.S." ...She screamed over top of my words, stepping to within inches of face and waiving and flailing her hands constantly in front of me in what can only be described as Hysterics."  from statement T.S."... As I am standing right beside the two of them, her hands almost hit Tom in the face again.  I stepped between the two of them and said, that's enough, while putting my left arm between them.  As soon as I got between them 2 ladies got in my face yelling and cussing at me as well as threatening to beat me up/fight.  I asked the ladies to turn down the language and they did not." from statement N.H."... I could hear her shouting, 'I don't agree!' over and over . She saw Tom at the hostess stand and yelled to him to come to her tables.  She continued to yell at Tom while he was trying to find out the issue. After about 5 minutes of yelling Nick went down to the party to figure out what the problem was.  Other parties in the area had already started leaving their tables because of the disturbance."  from statement A.G. Ms [redacted] was given 15 total wristbands. A happy birthday band for the birthday child and 14 green bands for guests.  The person that packaged our parties confirmed this.  It was also confirmed by the opening hostess that verified that count.  It was verified a 3rd time by Ms. [redacted]'s party host and indirectly by Ms. [redacted] herself  as seen by the following excerpts from statements:"... At the beginning of the party she had a total of 16 tokens bags and 15 wristbands (1 birthday unlimited band, 14 green bands, 15 regular token bags, and the bag of tokens for the birthday child with the 50 redemption tickets inside) Being the opening hostess, I always check all of the party bins to make sure the bins have the correct amount of bands, tokens etc." from statement O.E"... She asked me about a half an hour later why she was short one (green) band.  I told her there are 14 green bands and 1 Happy Birthday band, adding up to 15.  She thanked me for clarifying, and walked away." from statement M.L.I don't think Ms. [redacted] will understand what actually happened. She was never "racially and aggressively attacked". She was the attacker, abuser, curser, and screamer.  I don't think her actions had anything to do with race, as she did the same thing to all the staff members whether they were Caucasian  or African-American.  She was just a violent person that incited others in her party to threaten and fight over her misunderstanding.   We do not want our employees (mostly 16-20 year olds) to have to deal with threats and verbal abusive from patrons for any reason.  That's why we requested that Ms. [redacted] never return.e...

I am rejecting this response because:
GOOD DAY,MY CONCERN IS NOT WHAT SPECTATORS CLAIM TO HAVE SEEN. THE ESCALATION CAME BECAUSE I INFORMED THE STAFF/HOSTESS ABOUT THE NUMBER OF WRIST BANDS WHICH WAS A TOTAL OF 14 INCLUDING THE BIRTHDAY CHILD'S BAND. THE ESCALATION CAME ABOUT BECAUSE THEY ACCUSED ME OF BEING DISHONEST. SO ALL THE TALK ABOUT MY BEHAVIOR AND SO FOURTH AND SO ON DOES NOT ELIMINATE THE FACTS. I HAD 14 BANDS I GAVE THEM BACK 3 MEANING 11 GUEST. I SHOULD HAVE NOT NEEDED TO CALL MY CHILD'S PARTY GUEST BACK TO THE TABLE TO TRY AND PROVE WHO AND HOW MANY HAD WRIST BANDS. THE WHOLE CONVERSATION IS REDUNDANT AND NOTHING IS BEING RESOLVED. THE ACTIONS OF FUN N STUFF CAUSED ME TO REACT THEREFORE THINGS WERE SAID AND THEIR RACIST ATTITUDES AND RACIST BEHAVIOR WAS DISPLAYED. I DON'T KNOW AND I DO NOT CARE WHAT THE SUPPOSED TO BE WITNESSES CLAIM TO HAVE SAW. THAT IS NEITHER HERE NOR THERE. IF THEY WOULD HAVE LISTENED WHEN I INFORMED THEM/FUN N STUFF STAFF, THEN THE SITUATION MAY HAVE NOT GOTTEN ESCALTED. WHAT I SAID OR HOW I ACTED WAS A RESULT OF MY MISTREATMENT. IT HAS NO BARING ON MY MONEY $100.00 FOR MY CHILD MISSING OUT ON HIS TIME TO HAVE FUN THAT I PAID FOR. SO I REALLY DON'T NEED ANY MORE MESSAGES FROM FAKE WITNESSES OR ABOUT ANYTHING ELSE OTHER THAN ABOUT MY   MONEY. SO IF THIS CAN'T BE RESOLVED BY Revdex.com PLEASE PROVIDE ME WITH SOMEONE WHO CAN.RESPECTFULLY,[redacted]

I spoke to Ms. [redacted] and investigated the complaint.  I took statements from 7 people that saw her behavior or interacted with Ms. [redacted].  Macedonia Police were called as Ms [redacted] was yelling and being disruptive.  Some members of her group were threatening staff and wanting...

them to step outside to fight.  All 7 people that I took written statements from (one of which was African-American) said that Ms [redacted] was abusive and combative.  Four said they used profanity toward them or just out loud in general in view of other guests.  Her original complaint was that she was being overcharged by one attendee for her party. We eventually accepted that reduced payment (even though it was incorrect) after Macedonia Police came and waited while she gathered her items and left the property while be requested to never return.  None of the 3 managers that she spoke to ever got to hear any complaints about poor service as she immediately became so loud and antagonistic.  She would not listen to or allow them to speak until the police finally arrived.  The facts did not support Ms. [redacted]'s claim that was was treated differently due to race, but rather was treated the same as any other patron that behaved in that manner.
