Dear Ms. [redacted]:
Thank you for the opportunity of responding to Mr. [redacted]’s
message.
In the pictures Mr. [redacted] provided of the original
decking, please note the extensive network of that drainage system.  The network of ¼” drains ran the width and
length of the pool area and was adequate for any amount of water/rain that fell
on the deck. There never was any pooled water on the previous deck as there was
sufficient drainage to absorb the water and leave no pooling. 
Additionally, please note that the original decking slanted towards
the drains whereas the deck that Mr. [redacted] installed slants down towards the drain
and the house.  The slanting towards the
house can be seen in the pictures I included. 
Mr. [redacted] also stated at that time that the deck is too high and
should have been lower.  Because of the
slanting of the deck and the insufficient drains, water came into my kitchen
and has warped the outside door.  There
is also, most likely, some mildew and/or mold on the wall.
The three 3” drains that Mr. [redacted] states were never in
the contract is correct.  However, there
is no mention in the contract of the three steps that were installed in the pool
or the “special tiles” I purchased that he installed “at no charge”.  Further, the contract states that he was to
install (6) jets in the spa.  Since Mr.
[redacted] was not onsite during this process, (8) jets were installed, which
caused Mr. [redacted] needing to install a secondary pump.  Mr. [redacted] stated that he could give me a
used pump to handle the additional jets or, I could purchase a new one for an
additional $750.00, which I did.
The final point on the drains, I cannot confirm that the 3 drains
he installed terminate at the planters’ edge. 
These drains fill up much too fast [considering water pools to the area]
to go out the length of the deck to planters’ edge.  It is questionable as to whether the drain truly
runs out to the planters’ edge and instead the drains are only connected to
each other.
After the rain and coming home to a kitchen floor wet and
the kitchen door warped, I did call Mr. [redacted] a couple of times and left
messages.  Mr. [redacted] finally responded
and agreed to come to review the issue.  He
did not show the first time we had arranged a time and I called again.  We again set another appointment and, he was,
as usual, late for our meeting.  When I
explained what the issue was and showed him the problem, this is the point at
which he stated the decking was too high for the pool.  He then said we could “fix” the problem by
putting in a 55-gallon French tank for $1200 - $1500.00.  I told him I would need to think about this additional
expense considering I had already paid him $70,750. 
I thought about the proposal and had some additional
questions which I sent, via email, to Mr. [redacted]. He explained what needed to
be accomplished but, I was uncomfortable paying additional sum to Mr. [redacted]
since the problem should never have occurred. 
We scheduled to have Mr. [redacted] come back to my home on January 24th
to make final arrangements and agree on what was to occur.  I received a text message from Mr. [redacted] on
the 24th stating that “woke up sick” and wouldn’t be coming.  That was the last time I heard from Mr.
[redacted].
If Mr. [redacted] did show for our appointment, I would have
shown him the other problem with tiles on the wall and around the spa.  Since Mr. [redacted] feigned his illness and
never responded after that date, I was unable to show him the problem with the
tiles.  They simply were not cemented to
the wall.  They were/are loose and easily
removed which is a hazard and dangerous.

As per our conversation. On photos A will show you the original concrete deck he had and his drains only went to the end of the existing concrete spilling out just to the dirt. On our contract we had no drains mentioned because we figured since his drains went no where anyways that we could just...

tapper the new pavers to the end of the decking. As we started to lay out the pavers I decided to install drains for him with underground 3" pipe AT NO CHARGE which is photos B and take them out to the end of the decking as he had before. Mr. [redacted] said thats ok just take the pipe to the planter area which we did. After the one rain we had Mr. [redacted] called me and he asked what can be done to take the extra water and we said at the end of the Pipe we could install a large french drain in the ground filled with gravel to accommodate the over flow water and it will percolate into the ground, but that we would have to charge him. Mr. [redacted] was not happy with that so we did not meet. As for the tile coming off this is the first time I have heard about it.See photo's to follow.Sincerely yours, [redacted], Owener
