I am a real estate investor who owns many properties
throughout Arizona, including townhousesMy HOA
erroneously deposited my three monthly HOA payment checks as electronic funds deposits rather than depositing the original checks The bank told me to just have them
redeposit the checks which I conveyed to the property management firm for the HOA The HOA was unaware of
this request because the attorney for the HOA, Clint G***, refused to allow me contact with the HOA
Then the HOA sent me letters charging me NSF's for each check, in which the account had three thousand dollars
They also threatened me in the letter that if the NSF's were
not paid within ten days they would turn me over to collection I appealed to the attorney with more than a dozen
emails to allow me to contact the HOA Board and meet with them to correct the situation but their attorney refused to allow it Arizona Statutory law clear allows this
The HOA attorney, Clint G*** told me not to contact him
anymore by email and threatened to charge me legal fees
he was charging the HOA for his interaction with me
This so called attorney, not only arbitrarily interjected himself into what was a very easy situation to correct,
in letter form denying me the right to contact the HOA Board
Then he had the unmitigated gall to charge the HOA for this and tried to intimidate and threaten me by telling me his was
going to have the Board place his fees on my account
He also threatened me with his attorney's charging me $10,in legal fees as well I will be filing with the Arizona Department of Real Estate to report this attorney's actions and have it heard before an administrative judge The solution was very simple, and it appears the only reason the attorney would interject himself between me and the HOA Board was to generate fees
