Gothic Butterfly Estate Sales Reviews (1)

-the sale was to be an actual estate sale using the garage, living room, dining room, and kitchen (as well as several items from these rooms). When we arrived Friday, we were informed the only items for sale from inside the house are now the sofa, chair, and bookshelf.HELP!!!!! I need an advice on...

legal matter I got an estate sale company to do my sale for me, and they worked about 4hours on first day to sort out stuff and throw out junks. -this is typical on our first day. We will sort through as much as we can to make sure the unsellable things are removed, separate items we feel the family would want to keep, remove trash, as well as to group like items together. We were to begin at 11am, however, since the homeowner was not there and her father is deaf, we were not able to gain access to the home. We decided to run some errands while waiting for the homeowner to respond. We did not get started until 1pm because of this. We left after 5pm. Any longer would have sent someone to the hospital as it was extrememly humid and we were working in the garage.- at the end of the day the homeowner returned and started explaining which items were all of a sudden not for sale. These were all high dollar items which we know customers would be on the lookout for. This was also a large portion of what we had just sorted and organized which ended up being a waste of time.On Second day a few more hours, but I saw them loading their car with my stuff. -we were to begin working again at 11am and decided to contact the homeowner prior to this time so we could be sure to get started on time, but yet again the homeowner did not reply timely, was not ther. We were again unable to gain access until around 1230pm. -as for items being loaded into her car? Around 330pm the homeowner pulled up as we were closing the rear of the vehicle. we had loaded all of our unused supplies we had brought to set up. We do this to avoid having clutter and unnecessary items laying around during the sale and to reduce time when cleaning up.- at the beginning of this day even more items were removed from the sale. Again, high dollar items and items customers would be on the lookout for. We understand that sometimes our clients see something they forgot they had and decide not to sell it after the contract has been signed, however our contract clearly states that If a significant amount of items (or dollar amount) are removed after contract is signed we reserve the right to increase our commission and charge commission on those items. The estate sale was supposed to be for Friday and Saturday, they only did it for a couple of hours on Friday and on Saturday they came to pack up their things and left with a letter on my door saying there was a breach of contract and I owe them commission but they will not ask for that since they will keep the money from the sale. -we began the sale around 9am on Friday and ended at 130pm. This was due to lack of customers and those who did come were very disappointed that this was essentially a yard sale now.-again we arrived and even more items were removed from the premises. Around $400 worth.-after calculating hours worked and commission on removed items (as contract dictates) we did not feel right asking the client to pay us the amount shown. We felt the most fair thing was to take the few dollars made on Friday and call it even; leaving all remaining unsold items on premises. We did not even charge her for the additional items removed on Saturday. There were also some errors in calculation which have been corrected, but were not included on her list totaling $1,079 (these are in red). But that's not all , they took a lot of my stuff that didn't sell, there were a lot of my stuff that filled our garage but when I came home most of good stuff were gone. -nothing was removed from the premises except for our supplies which we brought in and items which were sold. The good stuff she talks about was all removed by her. Most of the items sold on Friday was clothing and the few “good” things which were left.-her garage was quite full; however, when items are organized they take up a lot less space. Another reason she feels stuff was missing is because she removed it and took it into the house, but forgets that some things did sell. -A list of the items removed from the premises after contract was signed is attached. I have also attached a copy of the contract signed and initialed. I have also attached our text communication as well. Should l call the police ? I don't know what to do.-there is nothing to contact the police about as we did nothing illegal regarding this matter. Client was in breach of contract from the beginning but tried to complete the sale without success.
