RE:          Case ID [redacted]                   In response to these allegations, Governor Square seeks to provide all information that may be relevant or helpful. ...

In response to your letter received on January 20, 2017 dated January 18, 2017, please find below a summary addressing the timeline of events surrounding [redacted].   Governor Square is an apartment community that is part of the Buckingham Companies portfolio and is located in Carmel, IN.  Ms. [redacted] resides at [redacted] in the Governor Square community.  Ms. [redacted] is a current resident and moved into her current home on December 26, 2015.   On January 2, 2016 the office was notified of a window that has a draft. The maintenance team responded on January 6, 2016 and discovered that the coldness that Ms. [redacted] was experiencing was a result of the windows being older, not that it wasn’t working or closing.   On May 31, 2016 Ms. [redacted] notified the office of ants throughout the apartment and potential cockroaches. On June 3rd, 2016 our representative from [redacted] Pest Control treated the apartment on their regularly scheduled visit to the community.  No further communication from the resident was received stating there was still an issue.   On October 19, 2016 at approximately 4:02pm Ms. [redacted] notified the office of her garbage disposal not working properly and that it had backed up the kitchen sink. At approximately 4:49pm on October 19, 2016 a member of the Governor Square maintenance team unclogged the garbage disposal. No further communication was received from the resident in regards to the kitchen sink.   On November 4th, 2016 the office was notified that both bathroom sinks were clogged and not draining. The Governor Square maintenance team was not able to clear and contacted a plumber who was able to clear the drains the same day. In regards to the notice period required to vacate the apartment. The lease states in section 3 on page 1 it states the following:“This Lease Contract will automatically renew month-to-month unless either party gives at least 60 days written notice of termination or intent to move-out as required by paragraph 36.”Ms. [redacted] lease expires on February 25, 2017. She received notification on November 1, 2016 of her lease expiring and renewal options along with a reminder that notice was due by December 1, 2016. On December 5, 2016 Ms. [redacted] received a 2nd notice outlining renewal options and notification that a 60 day notice was still due if planning to move out of the apartment. On January 10, 2017 the Property Manager left a message for Ms. [redacted] regarding renewal options and a 60 day notice.  The Assistant Property Manager received notice from Ms. [redacted] on January 12, 2017. The Property Manager reached out to Ms. [redacted] and said she was moving to Gramercy apartments.  Because Ms. [redacted] is moving to another Buckingham community, Governor Square is willing to waive the rent for the 15 days that the notice period is short.   Please feel free to contact me via telephone at (317) 554-6742 or via email at Kristin.L[redacted]@Buckingham.com with any further questions or concerns about this matter. Sincerely,Kristin L[redacted]Regional Property ManagerBUCKINGHAM COMPANIES
