Hi Sean,

Dear Ms[redacted],
" margin: 0px; background-">
We do understand that it can be startling at first to find your information online, but the data is made publicly available through the Freedom of Information Act (FOIA) at the state and federal levelThe Freedom of Information Act provides that any person has a right, enforceable in court, to obtain access to federal agency records, except to the extent that such records (or portions of them) are protected from public disclosure by one of nine exemptions* (see exemptions at end of message) or by one of three special law enforcement record exclusionsA FOIA request can be made for any agency record
Our primary data sources for our financial advisors listings are public filings obtained from the Securities and Exchange Commission (SEC) and the Financial Industry Regulatory Authority (FINRA) in accordance with the Freedom of Information Act (FOIA)Supplementary information may be provided by listed advisors or their representatives
Our team would be more than willing to update any incorrect or out of date information that may currently exist on the listingMs[redacted] is also welcome to edit the information at any time by creating a free user account on our websiteIf she would be more comfortable having us make the changes she can send us the correct information and our team will make the appropriate changes
Please let us know if you have any further questions or concerns by emailing us at [email protected] truly value your opinion and appreciate your thoughts
Sincerely,
The FindTheBest Team
*Exemptions and Exclusions
Not all records can be released under the FOIA. Congress established certain categories of information that are not required to be released in response to a FOIA request because release would be harmful to governmental or private interestsThese categories are called "exemptions" from disclosures. Still, even if an exemption applies, agencies may use their discretion to release information when there is no foreseeable harm in doing so and disclosure is not otherwise prohibited by law. We do not believe that your information currently falls under any of these exemptions
Congress has also provided special protection in the FOIA for three narrow categories of law enforcement and national security records. The provisions protecting those records are known as "exclusions." The first exclusion protects the existence of an ongoing criminal law enforcement investigation when the subject of the investigation is unaware that it is pending and disclosure could reasonably be expected to interfere with enforcement proceedings. The second exclusion is limited to criminal law enforcement agencies and protects the existence of informant records when the informant's status has not been officially confirmed. The third exclusion is limited to the Federal Bureau of Investigation and protects the existence of foreign intelligence or counterintelligence, or international terrorism records when the existence of such records is classified. Records falling within an exclusion are not subject to the requirements of the FOIA
**The employer information pertains strictly to the firm of which the individual is employedBecause many of these firms provide a variety of products or services, the individual may or may not be registered to operate under all services provided by the firm.[redacted]Please note that the IAR is required to provide past employment information only while registered with an investment advisor firm and the information is not updated through Form Uafter the IAR ceases to be registeredTherefore, an employment end date of "Present" may not reflect the broker's current employment status."

I completely agree. Our home is an active real estate listing and we close on our new home in a week. These yahoos have listed incorrect info about our home stating that's its value is in the BOTTOM 10% of all homes in our area and the lot is among the smallest. Surely this is hurting us because the info comes up while performing a BASIC Google search of our address unrelated to this company.
We've done landscaping, painted from top to bottom, new flooring, new mechanicals, new roof etc.
They excuse this practice by stating they got the info from a local government website. Fine, but the problem comes from this: they want me to SIGN UP for an ACCOUNT by providing PERSONAL info about myself in order to gain access to and edit the info so that it's correct. That's bull.
I've got a request in to customer service for THEM to remove my listing or my lawyer can tell them to remove it. I shouldn't have to give out my personal info (which they're going to use for telemarketing) to have them remove info that's not only wrong but may also negatively impact my finances.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID 10588404, and find that this resolution is satisfactory to me.
  Complaint # 10588404 has been resolved .

I am rejecting this response because:
Public data is public and I have no issue with a government agency maintaining data.  HOWEVER, you are a FOR-PROFIT company that is using my personal data for profit without my permission.
You spend a great deal of money promoting your services and have created systems to make sure your company's data appears first in Google searches.  If I were to create an account with your company merely to edit or hide my information, that is tantamount to me APPROVING of your company using my personal data for profit, which I do not.
I take this very seriously and will continue this until my information is no longer presented on your FOR-PROFIT website.
Regards,

Dear [redacted],
Thank you for working with Dun and Bradstreet. We apologize for any inconvenience or delay. We had not yet received an update from...

Dun and Bradstreet that you removed the information which is why it was not removed. Complaint: 9914328
I am rejecting this response because:
It fails to address the issue that  IAR information  under the Freedom of information act would need to be from a state where I am an IAR.  I am and have only been an IAR in one state, California. Information regarding my IAR history gained from anywhere other than California (where I am registered) would be from a source that technically is not in the position of providing public information  about that element of my licensure.
As you know, when I began this request the states in which you showed my registration were CA and MA. The fact that your firm has now changed it to other states, and FL is now the reporter, does not remove the fact that I am only IAR registered in CA; which considers IAR information you are publishing to be non-public.
Since your firm has blocked this information before, it is clear at some point it was recognized, there was a problem with this disclosure. I am not sure what the disconnect is now, but if your next
response will be reiterating your company's right to use FIOA for what you
are publishing, you may save the effort.
My attorney will be in touch.
