I had the system installed on my car in June, and the device has been having issues since day one The blow, hum, inhale combination ends in a abort out of times Even the installer had trouble getting the device to work After having a replacement set/camera sent to me, I had the new device installed with software update I was stuck in the installer's lot for more than a half hour trying to get the machine to pass On my way home, the machine beeped for me to take a random test so I pulled over and did It took me at least five minutes of blowing before it would pass Then, I drove to my house to greet my daughter from camp, never turning off the car and put it in park for approximately ten minutes I then drove to my bingo game and the machine beeped at me again to take a random test I pulled over again and blew several times with mo success I finally got it to analyze and it displayed "Failed" and told me to turn off the ignitionI did that, waited minutes

The guardian interlock is a piece of junk its locked my vehicle twice in one month with no drinking had to have it towed twice once they charged me more money the second time the said it was a defective hand setIt takes on average minutes to start my car and has me retest normally before I get out my drivewayOn average it takes about times of blowing in the handset before it doesn't abort and make me start overI've never used any other device so I don't no about them but guardian is junk

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

No this is not resolved yet.   I am showing him my bank statements if all the fees.  He said I only recieved one fee.  That's a lie.  I received like 8.

Good Morning,The PDF file I have attached shows the part of the contract that [redacted] has signed that she read and shows what fees my apply if a violation occurs. Also you will see the RR Refused on 7/28/13 that the fee was charged for and her signature on the form showing she had been shown this. There is also a violation report that shows 3 RR Refused happened before this but was only a few days after the installation was done and we are understanding of that and did not charge her at that time because she had just had the interlock installed a few days prior. The fee that [redacted] was charged on 7/24/13 was not for violation but shows a lease payment for leasing the equipment but she was removed on 8/09/13 and was not charged a contract cancellation, (which you can see on Line 10 is $100.00) because she had already paid for her next month of leasing the interlock. I have informed [redacted] that we can help her with extension she may have received from the Arizona Motor Vehicle but she sent me an extension that was received and dated 9/17/13 which is well after she was removed. The data is electronically sent to the Motor Vehicle at the time of service so anything sent by the Motor Vehicle would have been dated while she was with us. Below is the data that shows when the Random Retest was requested and 6 minutes after shows refused. She has stated she has a video that shows different but I have not seen it and can only go off what the data shows because the system are designed to just download, transmit to MVD, and are locked and cannot be altered in any way. It was designed this way for the client's protection as well as ours. I hope this helps clear things up and if there is anything else I can do to help please let me know. I received an email this morning regarding a complaint from one of our client’s that stated she was...

being charged a violation fee, was perm-locked, and also extended. The charge is $25.00 for the client being seen for an extra visit which is caused by a violation occurring, which in this case was not taking a Random Retest within the 6 minutes that the device gives the person to take the test. This fee is stated in each client’s contract when they sign up and is informed to them at that time.   A Permanent Lock Out will occur if the client allows the handset to go past -7 days. Each person is given an amount of days into the device to be seen for their next scheduled appointment and also given 7 day grace period in the event that a client is unable to make it into that appointment but if the days so past the grace period of -7 days it will then go into Permanent Lock Out and the client at that time will either have to bring in the handset or tow the vehicle into the shop. When a violation occurs the days will go into an early service mood which drops to a -5 days allows 3 days to have the device brought in for a reset or again a Permanent Lock Out will occur after -7 days. If a violation is found in the data when a download is done on the handset it is sent to the MVD Ignition Interlock Division electronically and will  cause a letter to be sent to the client saying they have been extended. On the back of this letter the MVD allows everyone to request a hearing where the client can explain why the violation had occurred and if ADOT’s Hearing Office feels the violation is excusable they will clear the extension. When a missed Random Retest occurs the MVD will send a letter that says evidence of tamper has been reported. Thank you for your time and I hope this helped explain why the client had to pay the fee and received an extension.
